Accident Reports, Incidents, and Crime Reports: can be obtained from the Records Bureau as soon as they become available. You may request the report in person, but reports take time to prepare and we strongly recommend that you call ahead for a copy of a report so that we can have it available to you when you come in. If the report you are interested in obtaining is for insurance purposes or for a lawyer, you may prefer to have them request the report for you.

Accident Reports:

You may obtain a copy of an official Accident Report that the officer completed if you were an operator of one of the vehicles in the accident, or the owner of a vehicle involved in the accident, or an injured party, or an insurance company requesting on behalf of their clients, or attorneys representing clients in a civil action. Accident Reports are obtained from the NH Department of Safety Division of Motor Vehicles by completing Form DSMV 505. For any assistance, please contact the Division of Motor Vehicles at 227-4040.

Incidents:

An incident sheet is a very brief description of calls that officers respond to. An incident sheet is typically one page of information that includes the date and time of an incident, the location, and the name of officer who responded to the scene. There is a $1 processing charge for the copy of an incident page.

Police reports are tailored to fit the specific event they document. For example, an automobile accident report calls for different details from those for an incident or crime report, so the report for each of these is different.

What Do I Do If The Law Enforcement Agency Does Not Respond

Every agency is required by law to respond and produce relevant, non-confidential documents that they do not otherwise have the right to withhold. If they have records that they need to disclose and do not, they are in violation of the law. You should first follow-up with the agency in writing and continue to request the documents. If they still do not respond, you can enforce your right to this information by bringing a lawsuit in Superior Court. If you win your challenge the agency can be required to pay your attorneys’ fees.14 So, you may be able to find a lawyer to represent you on contingency, who will get paid only if you collect the fees from your lawsuit.

Cleveland Police Use Of Force Reports Are Generally Public Records Available To The Public

From State ex rel. Standifer v. City of Cleveland, decided Thursday by the Ohio Supreme Court:

Cleveland’s General Police Order 2.01.05 requires that a UOF report be prepared whenever a Cleveland police officer uses force rising to in the course of the officer’s duties. UOF reports provide a “detailed account” of the use of force, including the reason for the initial police presence, a specific description of the acts that preceded the use of force, the level of resistance encountered, and a description of the force used. General Police Order 2.01.06 requires review of UOF reports through the chain of command to determine whether a use of force was proper.

Cid Standifer, who writes for the Cleveland Scene, sought the detailed UOF reports under Ohio public records law, but the city denied them based on the “confidential law enforcement investigatory record” exception to that statute. The court of appeals agreed with the city, but the Ohio Supreme Court sided with Standifer:

  • Records related to incidents where the agency found that an officer engaged in dishonesty in the investigation, reporting, or prosecution of crime or police misconduct. This kind of dishonesty could include filing a false report, testifying untruthfully, or planting evidence.3

You are entitled to any documents still in an agencys possession, no matter how old they are.

Many types of police records are exempt from public disclosure and are not public records. There are two main reasons why they arent publicly available. First, disclosing the information could undermine an ongoing investigation. Second, it could jeopardize someones privacy and safety. To submit a request send the request via mail, fax, or email to the agency. Some agencies list specific departments or people whose job it is to respond to PRA requests, so check their websites or call them for further info. Always keep a copy of your request so that you can show what you submitted and when.

The Department redacts the names of all victims, all non-involved parties, all juveniles/minors and all suspects unless they have been booked into jail. This is a major reason why it takes time to prepare crime reports for online posting.

Where Can Police Report Records Be Found

Not all police report records are available online. This is because the details in the reports may be crucial and on a need-to-know basis. An online police report doesn’t contain sensitive information.

Also, police records aren’t part of the court system and are, therefore, kept at police departments. So how can one make records requests for these records?

  • The local precinct where the police report was filed. Most police departments maintain a records office, requesting such documents. Making a report request becomes significantly easier if one has the report number.
