California law allows people who were arrested but never convicted to have their arrest records sealed and destroyed as a matter of right .

Sealing an arrest means the record will not show up on most criminal background checks, and that records of arrest such as police reports, fingerprints, booking photos and rap sheet entries will be deleted.

The law originated as California Senate Bill 393. SB 393 is now codified in Penal Code 851.87 PC. This section allows people to have their arrest record sealed as a matter of right when:

  • no criminal charges were ever filed,
  • criminal charges were filed but later dismissed,
  • the defendant was found not guilty in a jury trial,
  • the defendants conviction was vacated or overturned on appeal, or
  • the defendant successfully completed a pretrial diversion or pre-sentencing program, such as Penal Code 1000 deferred entry of judgment.

Do I Have Access To The Full Report

This depends on what is being requested and whether or not anyone else is involved in the incident. The personal information of other individuals will be redacted unless consent from those individuals is provided. Requests are processed in accordance with the Municipal Freedom of Information and Protection of Privacy Act.

How to access arrest record information for free

Most law enforcement agencies process mail-in requests for police reports. Law enforcement in moderate to larger jurisdictions typically also give citizens the option of ordering and obtaining police reports online. Both methods may require you to pay a nominal fee, which may be waived if you are the party involved in the report. To find out whether the old report you seek is available online or by mail, confirm with the police department that processed the report by calling in advance.

Does It Cost Money To Make A Request

An agency is only allowed to charge for the “direct costs” of duplicating the records, or the cost to create certain documents if you are asking it to create a document like a list that it does not already have.8 You should always ask the agency to waive costs in your initial request, but they are not required to do so. You also have the option to inspect the records by looking at them at the agency during its regular business hours, which you can do for free. You can always inspect documents for free, and then request copying only of those that you want.

Are Police Reports Admissible In Court

    Is There A Process To Seal And Destroy Records Of An Arrest

    Yes. An arrestee must file a petition to seal an arrest as soon as it is no longer possible for the prosecutor to file or refile charges.

    This petition must be filed with either:

  • the court in which charges based on the arrest were filed, or
  • if charges were not filed, in the city or county in which the arrest occurred.
  • A person is not eligible to have an arrest record sealed if any of the following apply:

    • he or she may still be charged with any of the offenses upon which the arrest was based,
    • the arrest was for murder or another crime for which there is no statute of limitations ,
    • the person was not charged because he or she intentionally evaded law enforcement efforts to prosecute the arrest, such as by absconding from the jurisdiction, or
    • the person evaded efforts to prosecute the arrest by engaging in identity fraud and was subsequently charged with a crime for that act of identity fraud.

    Request A Police Incident Report Copy

    Effective Tuesday, July 6, 2021, SFPD Police Headquarters at 1245 Third Street will reopen to the public after a temporary closure due to the COVID pandemic.

    You may request a police incident report in person at SFPD Police Headquarters during our normal business hours of 8 am-5 pm, Monday – Friday .

    The SFPD Crime Information Services Unit is responsible for processing incident report requests from the public, law enforcement agencies and other authorized organizations. The unit also processes local criminal background checks for agencies entitled to that information under the law. For all other requests that are not incident reports or local background checks, please contact the appropriate department within SFPD.

    • Identifying records: To help us provide records promptly, please provide specific information about the records you seek including the record name, subject matter, and location within the office if known.
    • Time Deadlines: The DOJ has 10 days to determine if it will disclose the requested records. A limited 14-day extension may apply. If records cannot be provided within these deadlines, we will provide an estimated delivery date, and the records will be disclosed in a reasonable period of time.
    • Copying Fees: The DOJ charges 10 cents per page as the direct cost for duplicating records. When the DOJ must compile or extract electronic data or perform computer programming, it may charge its full costs.
    • Exemptions: The DOJ will provide access to all public records upon request, unless the law provides an exemption from mandatory disclosure. Examples of exempt records may include: personnel records, investigative records, drafts, confidential legal advice, records prepared in connection with litigation, and information that may be kept confidential under other state or federal laws. Usually, when the DOJ removes or redacts exempt information, it will disclose the remainder of the record.
    • Online Form: The best way to request a copy of DOJ records is to complete an online request form. This form goes directly to the Public Records Coordinator who is charged with facilitating the DOJs response to record requests.

    The only records of police misconduct that you can access are those that fall under the three categories listed above: serious uses of force, sexual assault, and dishonesty related to investigations. Records of other types of police misconduct are still secret. Also, while you can access the records of investigation for serious uses of force regardless of whether the agency found that the use of force was wrong, for allegations of sexual assault and job-related dishonesty, you can only access those records if the agency determined that the officer was guilty of misconduct in violation of policy, and the time to appeal that determination has passed.4

    In addition, the agency has the right to redact or withhold certain confidential information, like the names of witnesses, or the home address of the officer involved.5

    If you elect NOT to use the portal, requests may still be submitted using U.S. Mail and email using the Incident Report Request Form. However, those requests will be manually entered and tracked in the Incident Report Request Portal by a member of CISU.     Request and receive all types of San Francisco Police Incident Reports through an online portal. Report types include traffic collisions, domestic violence and all other incidents of general crime. Using the portal is the most secure and convenient way to request and receive incident reports from the San Francisco Police Department. An account can be created within the Incident Report Request Portal to track the request and receive reports and correspondences securely online.

    Traffic Collision Reports: Before attempting to obtain a copy of a collision report, please allow a minimum of five days from the date of the collision to allow the report to be reviewed and approved for release.

    The availability of an old police report depends largely on the jurisdiction’s minimum time for retaining records. For example, you may be able to obtain a report from North Carolina sheriff’s offices for up to 20 years for solved cases and longer for unsolved cases, according to state record retention laws. The San Diego County Sheriff’s Department keeps crime, arrest and accident reports for up to 10 years however, reports involving homicides, missing persons and sex crimes are kept longer. According to PRI Management Group, a law enforcement consulting company, law enforcement agencies tend to retain records longer than required by law, and if a record still exists, it can be requested by the public.

    How To Get A Copy Of A Police Report

    A police report is generated by the investigating officer who responds to a request for assistance at the scene of a car accident. The police report is a summary of information regarding the crashusually containing facts related to the accident and opinions of the investigating officer.

    There are two ways to obtain a police report. One way will cost you money, the other probably will not. To obtain a paid copy of the police report, you need to request a copy from the local law enforcement office that drafted the report. Before leaving the scene of the crash, the investigating officer typically will hand you a receipt with the identification number for the police report. Call the traffic division of the local law enforcement agency that responded to the scene of the car accident, pay the administrative fee , and you should have no problem obtaining a copy.

    If you do not have or do not know the identification number for the police report, you can provide the date, time, and location of the car accident, along with your name, to assist in locating the report.

    To obtain a free copy of the police report, you can ask the insurance adjuster who is handling your claim if they requested the report, and ask for a copy.
