Police Use Cell Phone Location Information Obtained Without A Warrant As Evidence

Cell phones operate by continually connecting to radio antennas known as cell sites. Each time a phone connects to a new cell site, it creates a time-stamped record known as cell site location information . Wireless companies retain this information for business purposes. In Carpenter v. United States, the FBI and prosecutors sought to use CSLI to establish the whereabouts of criminal defendants around the time of several alleged robberies.

As part of their investigation, the FBI identified the cell phone numbers of the defendants. The government prosecutors then sought and received court orders to obtain the phone records of the defendants. The orders were granted under a federal law which allows police to track data, like cellphone information, with a court order based on facts granting reasonable grounds to believe the records are relevant and material to an ongoing investigation. This is a lower standard than the probable cause necessary to obtain a search warrant, which requires a reasonable belief that the evidence will lead to the confirmation of the commission of a crime.

Is Your Local Law Enforcement Tracking Your Cell Phone’s Location

Carpenter V United States

In the 2018 case Carpenter v. United States, the Supreme Court found that this lower standard did not suffice for a request of a month’s worth of historical CSLI data on a defendant’s phone. The Court held the acquisition of these records constituted a Fourth Amendment search and the police needed to get a probable cause warrant.

This decision was consistent with the trend suggested by recent decisions dealing with the relationship between technology and privacy. The Court had held in 2012 that the police can’t arbitrarily slap a GPS on a car and track the vehicle’s movements , and in 2014, that officers normally need a warrant to search the cellphone of someone they’ve arrested .

The Reasoning Behind The Ruling

Can Police Track Your Cell Phone Without a Warrant?

Digging into the district court’s decision, the concurring opinion held that “cell site information is clearly a business record.”

” cell service provider collects and stores historical cell site data for its own business purposes, perhaps to monitor or optimize service on its network or to accurately bill its customers for the segments of its network that they use.”

Since the government doesn’t require or hasn’t pursued service providers to store this historical data, ipso facto, law enforcement is off the hook when it comes to Fourth Amendment violations.

“In the case of such historical cell site information, the government merely comes in after the fact and asks a provider to turn over records the provider has already created.”

Then there’s the line in the full text of the ruling that customers “use of their phones, moreover, is entirely voluntary,” business records and all.

How A Warrant Is Obtained In Utah

In order to obtain a search warrant to track someones cell phone, an investigating officer must make an application for such a warrant and present it to a judge who will rule on its merits. The application will contain all the information related to the reasons the warrant is sought. It will name the officer seeking the warrant, the individual whose information the officer wishes to track, and the reasons that the officer believes that tracking this individuals movement by way of their cell phone data will assist is solving or preventing a crime.

The judge will consider all the evidence in the application and make a ruling based on whether or not probable cause exists to believe that tracking the phone will turn up evidence of a crime. If the judge decides to issue a warrant, the warrant will often be limited in scope and length. For example, the warrant may only allow for the individuals movements to be tracked for 10 days. If the 10 days pass, the tracking is no longer legal unless the officers make an application to renew the warrant and this application is granted by the judge.

What Can You Do If Your Phone Was Illegally Tracked

Proving you were illegally tracked is no simple feat. Sadly, to do this, youll need a lawyer who can subpoena records to discover whether the police went through the proper channels. A regular citizen cant demand these records unless they represent themselves in court, and that is rarely wise.

That said, if you believe the trace was illegal, its probably worth looking into. Especially if youve been arrested, charged or imprisoned based on a case where you were tracked by your phone. It happens more than you might believe. Hundreds of people have been put in jail using illegal methods. Thousands more may be able to have their cases evaluated just from the 2016 Baltimore arrests alone.

Can Police Obtain Your Cell Phone Location Information Without A Warrant

Many people may not know this, but your cell phone can be used as a tracking device allowing law enforcement to trace your historical location over days, weeks and even months. Tracking A Cell Phone Without A Warrant Justified By Exigencies

Ontarios highest court has upheld the warrantless pinging of a cell phone to track the whereabouts of a domestic assault suspect who left the scene with a handgun in his waistband. In R. v. Bakal, 2021 ONCA 584 a woman called 911 at about 3 a.m. to report that she had just been assaulted by the accused . The woman told police that Bakal had banged her head against the bedroom wall several times, pushed her onto the bed, and choked her with both hands. She said Bakal had left the apartment with a handgun in the waistband of his pants. The gun, which Bakal always carried with him, had been on the bedside table during the assault. While he had not specifically threatened her with the gun on this occasion, he had had done so in the past and the woman didnt want to get shot. Bakal had taken a suitcase containing the womans belongings with him when he left. She did not know where he went but provided his cell phone number.

How Can Police Or Hackers Track Your Phone?

Another way to protect against certain forms of mobile phone spying is to lock your SIM card by setting a four- to eight-digit passcode known as a SIM PIN. Each time your phone reboots, youll need to enter this PIN if you want SMS, voice calls, and mobile data to work.

An iPhones SIM unlocking screen

If you type the wrong PIN three times, your SIM card will get blocked, and youll need to call your phone carrier to receive a Personal Unblocking Key to unblock it. If you enter the wrong PUK eight times, the SIM card will permanently disable itself.

With a locked SIM, youll still be able to use apps and Wi-Fi but not mobile data or cellphone service. So make sure that you securely record your SIM PIN somewhere safe, such as a password manager like Bitwarden, 1Password, or LastPass, and never try to guess it if you cant remember it.

If you want to lock your SIM card, first youll need to know the default SIM PIN for your cellphone company. For AT& T, Verizon, and Google Fi, its 1111 for T-Mobile, Sprint, and Metro, its 1234. If you use a different phone carrier, you should be able to search the internet to find it.

Once you know your default PIN, heres how to you set a new one:

Unlawful Police Searches: Privacy In Greenville

Most people know that citizens are protected from unreasonable police searches and seizures. In general, the police must have probable cause or obtain a warrant from a judge. But what constitutes a search and what is a seizure are complicated legal questions. These questions have become even more complicated over the last 30 to 40 years with the amazing advances in electronics and communication technologies.

Many years ago, the Supreme Court held that putting a wiretap on your phone was a search that necessitated a warrant. The court held that we citizens have an expectation of privacy when we talk on the phone. But the court also held later that the police did not need a warrant to get a list of the phone numbers that you called and that called you there was no expectation of privacy with respect to the phone numbers. A useful analogy is a letter that you place in the mail. The content of the letter like the phone conversation is private, but what is on the outside of the envelope is not you expect the postal carrier to read the envelope to ensure it is delivered correctly. There is no expectation that the address on the envelope is private. Likewise, said the Supreme Court, with phone numbers. You know the phone company or service provider needs the number to make the connection. Thus, generally speaking, since there is no expectation of privacy, the police can obtain phone number information without a warrant.

Tracking A Suspects Cell Phone In Utah

US police can track almost every cell phone

As you move around from area to area, your cell phone pings each local cell tower and gives the cell phone service provider an indication of where you are located. This information is used by the cell phone companies to track which areas have high volume usage and improve service. However, the same information can also be harnessed by the police in order to track the movements of someone they believe to be involved in criminal activity.

Police can access this information in one of two ways. The first is simply requesting the information regarding your device from the cell phone company. The second involves what is known as a stingray device. The stingray device fools phones into thinking it is one of the cell towers that they ping their location to. Instead, this information is going straight to the police.

Whether they use the stingray device or obtain the information from the cell phone service providers, the police typically need a warrant to access your cell phone tracking information. In 2018, the U.S. Supreme Court ruled that a persons location data is protected under the Fourth Amendment, which prohibits unreasonable searches and seizures. Obtaining someones location information through the cell phone carrier or through the officers own means is, in fact, engaging in a search, the court held. Thus, a search warrant is required.
