Cell phones operate by continually connecting to radio antennas known as cell sites. Each time a phone connects to a new cell site, it creates a time-stamped record known as cell site location information . Wireless companies retain this information for business purposes. In Carpenter v. United States, the FBI and prosecutors sought to use CSLI to establish the whereabouts of criminal defendants around the time of several alleged robberies.

As part of their investigation, the FBI identified the cell phone numbers of the defendants. The government prosecutors then sought and received court orders to obtain the phone records of the defendants. The orders were granted under a federal law which allows police to track data, like cellphone information, with a court order based on facts granting reasonable grounds to believe the records are relevant and material to an ongoing investigation. This is a lower standard than the probable cause necessary to obtain a search warrant, which requires a reasonable belief that the evidence will lead to the confirmation of the commission of a crime.

Carpenter V United States

In the 2018 case Carpenter v. United States, the Supreme Court found that this lower standard did not suffice for a request of a month’s worth of historical CSLI data on a defendant’s phone. The Court held the acquisition of these records constituted a Fourth Amendment search and the police needed to get a probable cause warrant.

This decision was consistent with the trend suggested by recent decisions dealing with the relationship between technology and privacy. The Court had held in 2012 that the police can’t arbitrarily slap a GPS on a car and track the vehicle’s movements , and in 2014, that officers normally need a warrant to search the cellphone of someone they’ve arrested .

The Reasoning Behind The Ruling

Digging into the district court’s decision, the concurring opinion held that “cell site information is clearly a business record.”

” cell service provider collects and stores historical cell site data for its own business purposes, perhaps to monitor or optimize service on its network or to accurately bill its customers for the segments of its network that they use.”

Since the government doesn’t require or hasn’t pursued service providers to store this historical data, ipso facto, law enforcement is off the hook when it comes to Fourth Amendment violations.

“In the case of such historical cell site information, the government merely comes in after the fact and asks a provider to turn over records the provider has already created.”

Then there’s the line in the full text of the ruling that customers “use of their phones, moreover, is entirely voluntary,” business records and all.

How A Warrant Is Obtained In Utah

In order to obtain a search warrant to track someones cell phone, an investigating officer must make an application for such a warrant and present it to a judge who will rule on its merits. The application will contain all the information related to the reasons the warrant is sought. It will name the officer seeking the warrant, the individual whose information the officer wishes to track, and the reasons that the officer believes that tracking this individuals movement by way of their cell phone data will assist is solving or preventing a crime.

The judge will consider all the evidence in the application and make a ruling based on whether or not probable cause exists to believe that tracking the phone will turn up evidence of a crime. If the judge decides to issue a warrant, the warrant will often be limited in scope and length. For example, the warrant may only allow for the individuals movements to be tracked for 10 days. If the 10 days pass, the tracking is no longer legal unless the officers make an application to renew the warrant and this application is granted by the judge.
