Are Dui Police Reports Important

A police report details what happened during an arrest. The reports are written from the officers point of view, providing insight into what they experienced. DUI police reports are important because they explain why the officer made the arrest and they present any evidence that supports the DUI charge.

Police reports are not technically considered to be evidence on their own. However, DUI police reports give attorneys an idea of what the arresting officer may bring up in their testimony once the case goes to court. The police report also provides insight into evidence that could potentially be presented at trial.

Having this information available as you plan your DUI defense can allow your lawyers to develop a defense that matches the intent of the prosecution. This means your defense will be designed to combat the strengths of the prosecutions case while also capitalizing on their weaknesses.

Why Police Reports Matter

Police reports are public records and in some states they may be viewable by just about anybody. How Long Does It Take To Get The Report

Timing depends on three factors: the responsible law enforcement agency, the severity of the injuries and whether that is an ongoing criminal investigation such as a DUI. Perhaps the single most important factor is the agency, which is determined by accident location. California Highway Patrol , which handles incidents occurring on a freeway, is usually the quickest. They get the job done within a matter of days, and your lawyer can usually obtain the CHP report in less than one week, sometimes in as little as 3-5 days. Rarely does CHP take longer than 7 days. SDPD, which handles incidents on the streets in the City of San Diego, is a little slower. They can take anywhere from 2-4 weeks, or longer. Other agencies, including other police departments and the San Diego County Sheriff, have varying processing times but most are closer to that of SDPD, which is 2-4 weeks. If there are severe injuries, or a death occurred, the investigation will take much longer and the report will often need to be reviewed by upper management within the agency. This can significantly increase the processing time until the report is available to your traffic accident lawyer. If there is an ongoing criminal investigation, CHP will usually prepare its report quickly but the other agencies may take longer than one month to prepare their report.

Kim and her friend decided to wait until the In-N-Out location closed before leaving, and the pair asked one of the employees to check outside to be sure he wasnt still waiting for them. Kim was grateful the employee watched as they walked to their car to ensure they made it safely.

Kim later posted the video to her social media pages, where it caught the attention of San Ramon Police Chief Denton Carlson. Carlson retweeted her video and asked the pair to reach out. Kim says since then she has been in touch with police to investigate the incident.

Just before 4 p.m. on Sunday, Carlson tweeted a photo of the suspected individual. Carlson says the photo was taken on Christmas morning when the man in the photo exhibited similar behavior. The vehicle in the photo is a silver Mustang with Florida license plates, according to police.

Kim tells KRON4 that it was a scary incident, and shes happy they didnt get hurt. My friend and I were a bit shaken after the incident but Im just grateful were both safe and out of harms way.

On Monday, Carlson tweeted that the San Ramon Police Department was continuing to investigate and had made significant progress in the investigation.

Requesting A Police Report By Mail

Police Cannot Police in Dysfunctional California

The process of requesting a copy of a police report by mail is a bit more involved. In many jurisdictions, you are required to make your Public Access Request via mail. Typically, the agency will provide a form online for you to fill out, but some places are fine with you writing a letter to ask for the police report.

1. Figure out where to send the Public Access Request form or letter.

Your local police department may have a specific address and addressee for police report requests listed on their website. If they dont, simply address it to the Records and Identification Division, and use the general address listed online for the department.

2. Fill out the form or write the letter.

After you have found the location to send your request, you should be able to easily find out if they want you to send a request form or a letter. If the information is not readily available on the site, just call and ask which method they prefer. If it is available, filling out a request form is typically the easiest method because you wont have to worry about leaving out information.

If you write a letter instead of filling out the form, be sure to include the following information:

  • Your Name, Birthdate, and Address
  • The date and location of the incident
  • Your role in the case
  • The officers name who filed the report
  • What exactly you are requesting

3. Gather additional materials and send the form/letter.

4. Pay for the police report.

What To Do If You Forgot To Make A Written Report

Alternatively, you could call the police after your accident, and theyll prepare a written report on behalf of the agency. In this case, you wont need to make your own separate report.

Its strongly advised that you call the police after any road accident. They can help direct traffic if you cant move your vehicle and obtain statements from other drivers, passengers, and witnesses.

Even if you dont think youve been injured or your car hasnt been damaged, you never know what aftereffects will surface later on. A police report is a crucial document youll need in a car investigation and insurance lawsuit.

You Can Also Go Online To File A Supplemental Report

File a supplemental report if you want to add information to your original report or to a report that has previously been filed by an SFPD officer. To file a supplemental police report, click on the File a Police Report link above, select the appropriate incident type, follow the prompted questions, and select supplemental report when prompted.

Use the supplemental report method to report:

  • Additional property losses from the same crime
  • Additional details to describe stolen property, such as a serial number.

When you have finished entering your report, a temporary report will be emailed to you. This report will not be official until it is approved. Once that happens, we will email you an official copy.
