In a recent training video, we sang the praises of the 9th Circuit when the appellate court approved officers seizing a cell phone during an inventory search. Today, however, we review a 9th Circuit case where the court was not so kind. For those of you who may remember the 2000 Supreme Court case Florida v J.L. todays case, United States vs Brown, may come as no surprise. In Florida v J.L. an anonymous caller provided a clothing description of a young black male and claimed the party had a gun. Arriving officers detained J.L. and found him in possession of a handgun. SCOTUS upheld the trial courts suppression of the handgun, finding that an anonymous tip, without more, cannot form the basis for a Terry stop. So, without further ado lets see what the 9th Circuit had to say about todays case.

FACTS

Seattle Police received a call that a YWCA resident recounted that he had seen someone with a gun. Officers responded to the YWCA and spoke with an employee who claimed a resident walked in and told her he had seen a man carrying a handgun. The employee provided a general clothing description and did not provide any further information describing what the suspect was doing with the gun. The officers did not speak with the resident who had actually seen the man with the gun.

    Why The New Bern Police Department Submitted The Grant For A Tip Line

    New Bern police made a Facebook announcement on Dec. 8, 2021 about their submission to the Edward Byrne Memorial Justice Grant Program for $12,108 in funding.

    The program supports several areas of law enforcement which include crime prevention and education, McInnis said.

    He said NBPD will use the funds to implement Tip411, a software technology that enables anyone with a cell phone to text anonymous tips to law enforcement agencies.

    The tips will be received in real time and provide the ability to communicate back to the tipster on a secure network.

    McInnis added Tip411 has been used in more than 2,000 communities across the U.S. and the department believes it will enhance and improve community policing efforts.

    Dixon said anonymous tips are tough based on concerns of citizens rights and arrest made just by tips alone.

    If were instituting an anonymous tips program than we have to both train our officers on how to appropriately respond to anonymous tips, Dixon said. It provides an outlet for the community to sort of alert police anonymously to things they think are going on. But its not a free pass for the police to go get a search warrant.

    Police must have probable cause or reasonable suspicion of criminal activity to stop a motor vehicle. Sometimes an anonymous tip can be sufficient.

    The justification for the stop or detention by police must include:

    • specific and articulable facts which support the intrusion,
    • based upon the totality of the circumstances.

    Courts will look at the of the information that police are relying on:

    • is it confirmed or verified by the police?
    • is it reliable?

    For example:

    An anonymous 911 caller told police that a truck had run her off the road. The caller provided the vehicle description and license plate number. Officers quickly located and stopped the truck. The officers smelled marijuana, searched the vehicle and found 30 pounds of the drug. The court ruled that based upon the totality of the circumstances, the officers had reasonable suspicion to think the driver might be intoxicated and could stop the vehicle to confirm. See Navarette v. California 572 U.S. 393.

    An investigative detention is illegal if it is based on only one insufficient factor, such as:

    • curiosity, rumor, or a hunch
    • race or sex of the suspect
    • suspects presence in a high-crime area or
    • a persons nervous behavior.
