Domestic violence conviction consequences depend on the type of case that it is. There are misdemeanor domestic violence cases and felony domestic violence cases. Within each of these, there is a wide range of how serious the case can be. Obviously, if physical violence is involved it becomes very serious and can result in a felony conviction. The goal with cases involving first time offenders is to get a diversion result that does not go on the persons long term record. In our law office, we try to get diversion on first time domestic violence cases where the State can prove a case. If the State cannot prove a case, we will fight that case very aggressively all the way to the end.

In Arizona, there is three strikes rule for misdemeanor domestic violence cases. If you have two prior domestic violence convictions that are both misdemeanors, the third offense can be charged as a felony. If you continue to get arrested for disorderly conduct because you argue with your wife, know that the third arrest could turn into a felony because of the multiple prior misdemeanor convictions.

Domestic violence has been found to constitute the single largest category of police calls in some cities. When police officers respond, they know the situation can be volatile for both them and the abusers victim. Thats because the killer in almost one third of female homicides is an intimate partner, and 22 percent of officer “line of duty” deaths in recent years occurred while responding to domestic violence calls.

What the stats dont really capture is all the law enforcement officers that are killed in the line of duty on traffic stops, serving protection orders or serving warrants , says Michael P. LaRiviere, a police officer who does domestic violence training for national organizations, including the National Sheriffs Association.

Ive seen a connection between offenders who murder police officers and a record of domestic violence, LaRiviere says. Theyre dangerous people. Theyre about power and control, and law enforcement officers represent the authority to take away their freedoms.

This explosive combination has led 95 percent of law enforcement agencies to develop policies that officers are asked to follow when responding to domestic violence calls, and 85 percent also require officers to participate in specialized domestic violence training. Nearly half of the departments now have separate units devoted to domestic violence cases.

What Police Are Trained to Do

What Happens When Police Answer A Domestic Violence Call

If the police are called for a domestic violence situation, they will have an obligation to investigate the situation. If you are the subject of a domestic violence situation and the police begin questioning you, it is highly suggested that you exercise your Constitutional rights and not talk them. Tell the police you would like to first speak with your attorney. If you are subsequently arrested, find an attorney that can review the case and aggressively fight for you so it does not become a conviction on your record.

When the police come to your house on a domestic violence call it is typical that someone involved in the situation will be taken out of the house. Even if you are the one being taken, do not admit anything or explain or answer anything. Before doing so, you should always speak with an attorney as there are several ways of defending these situations.

If police are called to handle a situation between a couple with children, it is possible that both adults could be arrested. If all caretaking adults are arrested and there are minors in the house, the police will likely call Child Protective Services to take custody of the children. This is usually a temporary arrangement until CPS and/or the police can find other family for them to stay with. These arrangements are usually determined by the police officers involved in the case that day.

What To Do If Youre Arrested For Domestic Violence

If arrested, it is essential that you take the arrest seriously from moment one. Call a lawyer.

Frequently, those arrested for domestic violence view the charge as overblown and think of what occurred as a simple dispute that wont draw criminal charges. They may also assume the alleged victim will drop charges or refuse to testify. The law does not view a domestic violence allegation that way, and neither should you. Make sure to contact an attorney with experience working on cases like yours immediately upon arrest.

Legal Remedies Protecting You From Further Violence

Protection orders are granted on an urgent basis without notice to the respondent. They include conditions that the respondent not contact or communicate with the applicant. They can remain in effect generally for a period of 3 years and are designed to provide added protection for victims of domestic violence and/or stalking. They are granted by a judicial justice of the peace. Protection Orders are free of charge.

Release orders or undertakings are issued by a police supervisor, hearing officer, magistrate or justice after the accused has been arrested and when released prior to the court appearance. These remain in effect during the period the charge is before the court and can contain conditions forbidding the accused from having contact with victim.

Probation orders may be issued by the court at the time of sentencing and may include conditions to assist in protecting the victim and the public at large. These orders are monitored by probation officers and/or police for a specified period of time.

Other Options For Making A Report

If you are in an emergency situation and call 9-1-1, you may have the opportunity to file a report with the responding officers. However, there are other options for making a report that may feel safer for you. If possible, you may want to consider:

• Directly contacting the Victim Services Unit* or Special Crimes Unit for your local police department, if available
• Going to a hospital or police station to make the report

Consider bringing a supportive friend or family member with you if you go to make a report, especially if that person has witnessed the violence or abuse and/or can corroborate your experience. Check Whether Someone Has An Abusive Past

If you are concerned that a new, former or existing partner has an abusive past you can ask the police to check under the Domestic Violence Disclosure Scheme . This is your right to ask. If records show that you may be at risk of domestic abuse, the police will consider disclosing the information. A disclosure can be made if it is legal, proportionate and necessary to do so.

If you are concerned about a friend or family member, you can apply for a disclosure on behalf of someone you know.

You can make a request to the police for information about a persons previous violent offending in person at the police station or elsewhere, by telephone, by email, online or as part of a police investigation. Support agencies and services can also help you ask the police about this.
