Requesting a NY State Police & Accident Report

If you have been arrested and have not appeared in court, the Records Bureau will not release the report. The court or prosecution will discuss options for obtaining the report at your arraignment. If the case has been closed with Court, you are entitled to receive a copy however the report may contain redactions .

Request Copies Of Police Reports

Most requests will be filled within 10 working days. To get a Police Report, complete and submit aRequest for Police Report either by mail or in person to:

Reports are to be picked up in person during business hours Monday Friday 8 a.m.- 6 p.m., closed weekends and holidays, at the Hayward Police Department.

The following fees are charged as outlined in the Master Fee Schedule:

  • Vehicle Accident Reports – $16.00
  • All Other Report – $16.00
  • Clearance Letters – $43.00 (given only if the requestor has not been arrested in the City of Hayward, and has lived in Hayward for the past six months or longer
  • Towed Vehicle Release – $235.00

Under the guidelines of Government Code, Section 6254, some reports are not released in their entirety and others may not be released at all.

Who May Request A Copy Of A Police Report

Crime and Incident Reports

  • Insurance carrier against which a claim has been made and/or might be made
  • Person suffering bodily injury, property damage or loss

Not released:

  • If the disclosure would endanger the safety of a witness or other involved party
  • If disclosure could endanger the successful completion of an investigation and/or related investigation
  • Name and address of a victim of certain specified crimes will not be disclosed
  • If the Department is prohibited by law from releasing the report

Traffic Collision Reports

  • Drivers involved in the collision
  • Registered owners of vehicles involved
  • Parents of a minor driver involved
  • Passengers involved listed in the report
  • Insurance companies
  • Those incurring property damage as a result of the accident
  • Those who may incur civil liability as a result of the accident
  • Any attorney who declares under penalty of perjury that he or she represents any of the above persons

Juvenile Reports

Released to:

  • Parents of a juvenile may receive a copy of certain types of reports if their child is the only juvenile identified in the report.

To request a copy of an accident report have your case number available go to Lexis Nexis Accident Report search. Please search using the full case number yyyy-xxxxx .

Most accident reports written by the Walnut Creek Police Department can be obtained online. However some may not. Reasons an accident report may not be available online are:

  • The accident did not occur in the jurisdiction of the Walnut Creek Police Department.
  • There were serious injuries and/or a fatality as a result of the accident.
  • There was a crime associated with the accident report.
  • The report is not complete.
  • The report cannot be released by applicable laws.

Reports are typically available within 5 to 10 days. If the report is not available online after 10 days, please contact the Walnut Creek Police Records Division at 925-943-5890.

Cost of an online accident report is $5.00, which is paid directly to Lexis Nexis.

The Walnut Creek Police Department reserves the right to restrict the availability of online accident reports.

Online By Phone And In Person

Check the police departments website for information on obtaining police reports. The site will typically provide instructions on ordering a report, but may also provide a phone number or email address you can use to confirm whether your report is ready for pick-up. In most jurisdictions, the records unit or a report processing unit typically handles police report requests. This is the counter or office that you must visit in person or call to request status of a police report.

Some jurisdictions allow you to order a copy of the police report through a secure portal accessed through the departments website. To use this service, bear in mind that you will need to have a valid e-mail address and generally, you must be the person who reported the incident not a relative, friend, witness and so on. Make sure you have valid identification.

What Information Is Not Available

The full list of public interest considerations against disclosure can be found within the GIPA Act, PART 2, DIVISION 2, SECTION 14. Some of the most common public interest considerations against disclosure of information are listed below. Where the information would:

  • reveal an individuals personal information,
  • contravene an information protection principle under the Privacy and Personal Information Protection Act 1998 or a Health Privacy Principle under the Health Records and Information Privacy Act 2002,
  • prejudice any court proceedings by revealing matter prepared for the purposes of or in relation to current or future proceedings,
  • prejudice the fair trial of any person, the impartial adjudication of any case or a persons right to procedural fairness,
  • reveal false or unsubstantiated allegations about a person that are defamatory,
  • expose a person to a risk of harm or of serious harassment or serious intimidation,
  • in the case of the disclosure of personal information about a childthe disclosure of information that it would not be in the best interests of the child to have disclosed, prejudice the prevention, detection or investigation of a contravention or possible contravention of the law or prejudice the enforcement of the law.

How To Request A Police Report

  • You must be a party involved in the report, or the legal representative of an involved party .
  • You must have standing to receive the information. The application form lists those authorized. If the application calls for a signed authorization, it must be included.

In most cases, we can accept your application by mail, or in-person.

Fees And Request Submission

All police reports are $16 and typically only available to individuals named in the report. The form and $16 fee can be either hand delivered or mailed to the Fremont Police Department.

If submitting in-person at the Fremont Police Department, cash, check, money order, and credit card payment accepted.

Crash Data Request/bulk Request For Crash Ids

Individuals and organizations looking to submit bulk requests for crash IDs or crash data requests may do so by submitting an online Crash Data Request Form or an Open Records Request. Customers may also search public data by using the CRIS Query Tool. Annual reporting or data extract may also be useful to some customers.

Important Information when filing:

  • The Texas Department of Transportations retention period for records include the previous 10 full calendar years plus the current calendar year.
  • The Texas Transportation Code requires that all crash records be purchased and therefore bulk requests for multiple crash reports cannot be provided. Crash ID numbers corresponding to the request parameters will be provided instead, allowing the requestor to purchase at their leisure. NOTE: TxDOT cannot fulfill bulk requests that require searching any confidential fields as provided in Transportation Code 550.065, unless the requestor is otherwise entitled to such information under section 550.065. For example, TxDOT cannot release the results of a search for all accidents involving a particular person.

How Long Will My Report Take To Process

  • Normally, you will receive a response from the CORP reviewer within five business days.
  • In the meantime you will be given a temporary transaction number to document your submission. This temporary number is NOT your police report number.
  • Once your report has been reviewed and approved, your report number will be issued to you by email.

If you have already filed a report and realize you need the report approved quicker than 5 days you can do that by calling the non-emergency number 206-625-5011 and asking to file the report with the Communications Section.

Be sure to tell them you have already filed the same report through the online reporting system, and give them the temporary transaction number you were provided when you filed the report online so they may include it in the narrative of your report.

    Do You Need Information Relevant To An Insurance Claim

    The NSW Police Force complies with The Information and Privacy Commission NSW Privacy Code of Practice. The Code of Practice states that the NSW Police Force may only supply motor vehicle accident or crime incident reports to an insurance company or insurer, or to the agent of an insurance company or insurer, in circumstances where a claim has been lodged against the insurance company or insurer and the report sought relates to that claim. NSW Police Force may supply motor vehicle accident reports to any person directly involved in the accident to which the report sought relates.
