If you want peace of mind and dont want to worry about whether or not there might be a police report filed in your name, then running a search on yourself is the best way to go. There are many ways to do so. A few of them are listed below.

For instance, if the officer wrote that you were speeding before the accident, they must provide proof that that was the case. They cant just say it and make it happen.

There are a whole host of small mistakes that can cause a police report to wrongly accuse you of being at fault for the accident. These are just a few:

  • Misreporting the physical damage to the cars
  • Failing to include one or both drivers symptoms or complaints of injuries
  • Assuming that no one was injured
  • Failing to assess evidence at the scene or forgetting to record certain evidence
  • Recording incomplete or incorrect statements from the drivers or witnesses
  • Leaving out key information about the drivers
  • Leaving one drivers statements out because they are unconscious or injured
  • Misreporting the speed the cars were driving before the crash
  • Making mistakes when constructing the diagram of the accident
  • Mixing up which drivers and passengers were in which vehicle
  • Mixing up the cars or damage to the cars.

Why Are These The Only Crimes Shown

With the Police Reports Map and 9-1-1 Response Map, SPD is making almost all of our reports available online. The Department attempted to be very thoughtful about what information was released and what was not. These decisions were not made to “hide” types of crimes from the public, instead decisions were made about who to protect.

The only reports that are not being released under this system are when the rights of the victim, age of the victim, possibility of revictimization or overall public safety/security issues take clear precedence over the public right to know.

Information on Rape and other sexual offenses, Domestic Violence, Child Abuse, Kidnapping, Suicides, locations that are sensitive , Homeland Security issues and tactical information that might compromise the safety of our officers are not being released in this system.

If the event is one of the many types we do show, but the location code was entered into the system incorrectly, the location of the event cannot then be verified. In this scenario, this particular event will not appear on the map at all, rather than providing possibly misleading information.

Do I Have To Report To Get Rape Kit

By law, you are not required to report to law enforcement in order to receive a sexual assault forensic exam, commonly referred to as a rape kit. The Violence Against Women Reauthorization Act of 2013 has made it easier for someone to have a Jane Doe rape kit, where they are given a code to identify themselves if they choose to report later.

State Police Confirm Reports Of Active Shooters At Schools A Hoax

SANFORD, Maine Police confirmed reports of an active shooter incident at Sanford High School and schools around the state Tuesday morning are a hoax.

A heavy police presence responded to the local high school in Sanford Tuesday morning.

Shannon Moss, public information officer for the Maine Department of Public Safety, said they’re aware of multiple active shooter threats that have been made at schools throughout the state.

“Maine State Police have been assisting local law enforcement agencies with these initial investigations,” Moss said. “At this time these reports are believed to be a hoax. The Maine Information Analysis Center is heavily involved in coordinating these investigations.”

The Sanford School Department sent a message to parents Tuesday morning saying the active shooter threat is not believed to be credible.

School districts around York County, Maine, send students to the regional technical center at Sanford. Officials at those schools, including Kittery, Marshood and others, were communicating Tuesday about the hoax to students as well.

The Report Will Be Sent To A Dedicated Police Team To Assess

After a police report is opened up against another person and the police have taken all the necessary information that they need from you, an investigation will then begin to take the police to discover if any further action needs to be taken from the crime that you have reported to the police from opening up the police report.

Though the policy for how a police department goes about opening up an investigation will vary from state to state, it is very common for the police to send your filed report to the appropriate police force/department so that they can properly deal with the situation/crime that you have taken the time to report.

Once this has been done, a team will typically be established in order to take a closer look at the police report that you have submitted, so that they can continue on with the investigation to decide how the situation should be best handled.

This is usually referred to as an investigative assessment and will consist of the team that has been assembled to take a dedicated look at the investigation to decide if any further action needs to be taken.

All the while this is taking place if you are vulnerable or at risk of being targeted due to making the police report, the police department will provide you with the necessary support to ensure your safety, while also providing you with any information appropriate to share.

What Is The Difference Between Filing A Police Report And A Criminal Complaint Would The Police File A Report Anyway If They

Framingham Police Department: Police Complaint 20110727
    • Posted on Nov 16, 2015

Anyone can file a police report if they believe a crime has occurred. A police report will either lead to an investigation, and possibly an arrest, or could lead to no action if there is not enough evidence, if the complainant doesnt know the perpetrator, or if the police do not believe the reported conduct is sufficient to constitute a crime. A criminal complaint, on the other hand, is the actual charge that gets filed in court. As an example, I came home from a trip I found that someone had tried to break into my house there was damage to a side door, but the deadbolt held. A few screens were sliced, and there were hand marks on the glass where the burglar tried to open windows, but the locks held. The police came and a report was filed, but I was told on the spot that nothing would come of it because the burglar didnt get in. Had the police caught someone in the act, or found him later on and secured an admission, the police report would likely have been used to add a charge, or criminal complaint, against them. I hope this helps.

An Investigation Might Be Opened Up Regarding The Police Report

As we have already touched upon above, each crime situation is approached and handled differently as no two filed police reports are the same!

For this reason, once the police department that you have filed the report with has taken the time to build a team, this team will then go ahead and decide whether or not a further investigation will need to take place.

As we have already mentioned above, the method to do this will likely vary depending on which state you are in and what police department you have gone to, but for the most part, most police departments will make their decision by considering the following factors:

    • How severe the crime is that has been reported
    • How likely it is that the crime will be able to be solved
    • How vulnerable/at risk the victim is

After taking the time to consider these three main factors that we have listed above, as well as any other factors that the police team deems necessary to help form a decision, they may then take the decision to open up an initial investigation to take a closer look at resolving the police report that you have filed against the said person.

During this period of the initial investigation, the police will likely carry out a variety of different things to help them gain a better understanding of the situation and crime, as well as to help decide the best course of action to resolve whatever it is that is going on.

The Police Report In My Criminal Case Is Inaccurate What Can I Do

Pray. You can pray. Unless the error in the inaccurate report is obvious or there is evidence that the events could not have unfolded in the manner described, the report will stand. If you end up at trial the officer will likely swear that the report is accurate. Or perhaps claim no recollection of the event. He or she will then state that it is his/her job to craft honest and fair depictions of the events.

So the trier of fact will have to decide who is telling the truth the officer or the defendant. In this society, the odds weigh against the defendant prevailing on that point.

Once in a blue moon an officer will be caught in a lie, but generally speaking it is an uphill battle. An experienced criminal defense attorney can help.

Limiting the impact of this report is no easy task. A good criminal defense attorney will try to counteract the police report by:

    1) undermining the officers credibility and

    2) trying to find evidence to contradict the police report.

Are there other witnesses not interviewed by the police? Does the physical evidence match up with the report? Can I draw out the inaccuracies in a meaningful manner that is helpful to my client? Does the police report align with the other physical evidence collected?

Analysis like this takes time to develop and discover. It is imperative that you inform your criminal defense attorney of any inaccuracies in the report as soon as you recognize them.
