Taking The Case To Court

The case will go to court if the Crown Prosecution Service decides that there is enough evidence and that it is in the public interest to prosecute the person accused. The police do not decide the outcome of a case they collect evidence and pass it to the CPS.

The CPS has to consider the impact the crime has had on you, the victim, in making a decision about whether or not they should prosecute. It should also take into account the views of your family. You can find out more information on the CPS website.

The Details Of The Victim

The details of the victim have to be included such as the name, race, physical appearance, date of birth, home address, marital status, social security number and the relationship of the person to the perpetrator of the one reporting the crime. If there has been any damage done to their property or if any property belonging to the victim has been used to commit the crime, it has to be placed as a separate note or in a separate section.

Going Through The Side Entrance

For something like Google Search history, police can also go straight to a company to gain access to your records. According to its most recent Transparency Report, Google received 12,523 criminal legal requests for user data in the U.S. in the last six months of 2015. Of those, 7,250 were subpoenas, 1,056 were court orders, and 3,716 were search warrants. Google says it honored the search warrant requests 85 percent of the time.

Google doesnt go into detail about what it handed over to investigators, but it is theoretically possible that police gained access to these targets search histories, emails, documents, and more. Furthermore, Google of course isnt the only company law enforcement can serve with a search warrant your internet service provider or email provider are also a wealth of information about your online life.

What Are Other Factors To Consider About A Police Officer’s Hours

Here is some other helpful information that pertains to police officers and the hours that they work:

  • Departments often give at least one day off between a drastic shift change to let officers acclimate to the new schedule.

  • Some departments or agencies allow you to take the patrol car home so that you can be in service when needed.

  • Overtime is very common for making off-duty court appearances, filling in to cover absences on the roster or assisting with crowd control.

  • Police offers often work weekends, holidays and night shifts, so it’s important to be prepared for this expectation.

  • Administrative positions within police agencies follow more standard workweek hours, and some detectives and school resource officers work that schedule as well after working for several years on the job.

What Are Traditional Police Officer Hours

Police officers normally work full-time hours, and schedules often include long daily shifts. Some departments and agencies have traditional 40-hour workweeks for patrol officers, with five consecutive eight-hour shifts followed by two days off. Others deploy a variation of shortened workweeks with longer shifts, like four 10-hour days or three 12-hour days, for example.

Because law enforcement agencies operate and protect communities 24 hours per day, seven days a week, a police officer’s hours can vary depending on their department, agency, union and location. You may encounter a variety of shift scheduling throughout your career, including:

  • 10-hour or 12-hour shifts: Longer shift hours mean fewer actual workdays in a workweek.

  • Monthly deployment plans: Based on seniority selections, the officers working with a department longest get more control over their schedule.

  • Three-month or six-month shift rotations: You may have a set schedule for several months in a row, then switch to another shift schedule.

  • Rotating days off: Rather than having set days off, like many jobs, you might have weekly rotating days off as a police officer. For example, you may have Monday and Tuesday off one week and Tuesday and Wednesday off the following week.

  • Shift-start bidding: You can put in for your preferred start time for a shift, though awards often go in seniority order within a department.

Using The Crash Report To Support Your Claim

After you file a claim with the at-fault drivers insurance company, a claims adjuster will begin collecting statements from you, their insured, the passengers, and any witnesses. Even if the police report clearly shows their insured was at fault, the adjuster will still investigate the claim.

Police officers arent perfect. Occasionally, a thorough investigation by the claims adjuster may uncover something the officer missed. But in most cases, the adjuster relies on the police accident report for determining fault.

Police reports are very persuasive in personal injury claims. Unlike the adjuster, the police officer was physically at the scene of the accident. The officers special training provides a reliable evaluation of the accident and its causes, especially each drivers fault.

Claims adjusters can disagree with police officers, but its uncommon. If the adjuster disagrees with the officers assessment, and the case ends up in court, most juries will take the officers opinion over the adjusters opinion. A police officers testimony has automatic credibility with a jury.

If youve recovered from minor injuries and didnt miss much work, you can probably settle your claim on your own, without the help of an attorney.

Are Police Reports Admissible In Court

While police reports are commonly used in car insurance settlement negotiations, admitting a police report as evidence when you file a car accident lawsuit is not quite as clear cut.

In small claims courts, litigants are usually permitted to use police reports as evidence in their car accident case. You will not be expected to know all the rules of evidence, so judges typically will allow plaintiffs and defendants to use the police report in explaining what happened.

If your car accident case goes to trial in your state’s court of general jurisdiction , you should know that parties in these cases are held to the rules of evidence and must contend with whether the police report falls within the rule against “hearsay” evidence, which keeps out many out-of-court statementsby definition, any assertion made in a police report is a statement that was made out of court.

In some jurisdictions, the police report may fall within the “public records” or “business records” exception for admissibility. In other jurisdictions, different exceptions to the hearsay rule may apply and allow you to admit some or all of the police report as evidence.

Obtaining Police Reports Is A Tedious Process

Another unpleasant surprise for a researcher is the convoluted process related to acquiring these police reports. The first step is to find the responsible police department where the crime happened, and which police department has jurisdiction and is responsible for reporting. Depending on the police department, a researcher may need to contact several people or sub-departments even to find out who deals with releasing reports. Not everyone who works for the police department may know their policies on releasing reports. Sometimes email communication is not enough or there may not be an option for email communication. The researcher might have to fill out an online form, or might need to make a phone inquiry first, or might have to send in a request letter by regular mail. For some departments, the researcher might have to pay certain costs related to processing such a request by sending a money order first. Sometimes it is unclear what the costs are because they depend on the number of copies. Then, one has to liaise with the police department to learn about the costs, and make the payment, before the request can be made. In brief, the whole process is more complicated than one might think.

What Happens When I Report A Crime

Sample Police Report Template

Investigating crimes, catching criminals and protecting the community is the polices main job, but they also help victims and witnesses of crime.

Even if you dont report a crime as the victim, someone who saw what happened might do, so its likely that you will have to talk to police after a crime.

If you do report a crime the police will explain what will happen next. They should also give you the contact details of the police officer dealing with your case and a crime reference number. Make a note of this number somewhere safe you will need it if you want to contact the police again about the incident, or if you want to make an insurance or compensation claim.

Requesting A Police Report In Person

1. Gather the required materials.

Bring with you a form of identification like a drivers license or passport. If you are making the request on behalf of someone else, you will need to have a notarized letter with you. Most agencies require a small request fee. If you were directly involved in the incident whether as a victim, witness, or defendant you may receive a verification slip from the authorities to let you know that a police report has been filed. Bring this slip with you to exchange for the police report.

2. Visit the Records and Identification Division of the police department.

The Records and Identification Division may have exclusive hours throughout the day that are not your typical business hours, so be sure to verify online. They will ask you for your information, as well as basic information about the case. Then, they will take your payment to cover the request fee.

3. Retrieve the copy of your police report.

In some areas, you may have to pick up a copy of the police report in person, but some agencies may mail it directly to you. Either way, expect to pay a per-page fee for the copy of the report. Reports typically cost a total of $50 to $150.

Police Reports Are Not Comparable

As was mentioned above, the length of police reports we received ranged from 3 to 182 pages. Needless to say, information contained in these reports was not comparable. The reports differed between different jurisdictions, and within the same jurisdiction, according to individual writer differences. Individual writer differences may be due to one’s experience in conducting police reports, time and resources available, and work stress and the number of cases handled, in addition to their varied writing styles. One will not find all the information one is looking for in all of the reportsalthough most reports mention demographic characteristics. Consequently, research data are not comprehensive and the data set has a lot of missing values, and thereby limits researchers’ ability to acquire the same variables, to aggregate data and compare them with each other.

Traffic Accidents Without Police Reports

Day In The Life: Military Police Officer | U.S. Army

The police arent always available to come to every car accident scene. In busy jurisdictions, an officer might not be available to respond to minor fender-benders with no reported injuries.

If the police dont investigate your accident, its up to you to create your own accident report. Youll need the report to help convince the other drivers insurance company that their insured, and not you, caused the accident.

Weve made it easy with a free Car Accident Information Form. Keep copies of the form in your car. Youll always be ready to gather the information youll need for a successful insurance claim.

Fill out the accident information form. Describe what caused the crash and draw the vehicles locations before and after the collision.

Include the names and contact information of the other driver, passengers, and any witnesses. Be sure to get the other drivers insurance information. In most states, the other driver must provide their drivers license number, if asked. Use your phone to take pictures and videos, if you safely can.

Send a copy of your completed form, witness statements, and photographs to the insurance adjuster handling your claim. If the other driver doesnt admit to causing the accident, your detailed report and pictures may convince the adjuster to accept your claim.

If the insurance company refuses to cooperate or denies your claim, you have nothing to lose by contacting a personal injury attorney.
