Reporting An Accident To Your Insurance Company

Your insurance policy will have a specified length of time to report the accident. The typical time limit to report the accident to your insurance company is 30 days, although some carriers and policies may have different time limits.

The time that you have to report a claim to your insurance company is different from the statute of limitations to file a lawsuit against the other driver.

If you were the only driver involved in the accident, you should submit a claim to your own insurance company to cover repairing or replacing the vehicle, plus your medical bills.

If you were involved in an accident with another driver, you still need to report it to your insurance company, but make sure to include a copy of the police report. Your insurance company may not cover a claim if its clear that another party was responsible.

If youre involved in an accident with an uninsured motorist, you will also need to submit a claim with your insurance company. However, for insurance to pay for the damage to your car and your medical bills, youll need to have an uninsured/underinsured motorist policy in addition to your regular one.

Are There Exceptions To Filing A Police Report After An Accident

Tennessee does require the police to be contacted and a report filed for accidents totaling over $50.00 in damages. However, there are a few exceptions to this requirement. If there is extreme or hazardous weather, drivers are not required to contact the police or file a report at the scene. The Tennessee inclement weather policy gives drivers five days to contact the police to submit a Non-Investigated Crash Report.

Furthermore, if an accident occurs on private property, most of the time, even if police are contacted, they may decline to appear. Even if they do appear, they will likely refrain from filing a police report after the accident.

Additionally, if the accident does not cause any injury and only minor property damage that neither party intends to submit to the insurance company, then the police do not need to be called, and a police report does not need to be filed.

When Should I Ask For A Police Report

Tennessee law requires that drivers report an accident involving $50 or more of property damage, injury, or death. You are also required by law to file an Owner/Driver Report within 20 days if the property damage exceeded $400, there was injury, or a person was killed in an accident. Thus, you should request copies of these reports as well.

If you were injured in the accident, your health and well-being are a priority. However, as soon as you are well enough, you should begin the process of requesting a police report or talk to an attorney about launching an investigation. Regardless of whether you are the victim, or you think you may be at fault, it is important to request a police report immediately.

Having this documentation will go a long way toward strengthening your insurance claims and future legal arguments. Police reports are often quite impactful, especially with Insurance companies and the courts. Because of this, your attorney will want to include this as evidence in your claim.

What If I Fail To Report An Accident In A Timely Manner

Fines, license suspension, and possible jail time are all typical consequences for not reporting an accident within the time frame stipulated by your state.

In addition to consequences from the police, youll also face consequences from your insurance company if you fail to report an accident. Many companies will deny a claim filed outside their time frame for reporting. In addition, if you were at fault for the accident and didnt report it, the insurance company may cancel your policy.

However, each policy is different, so check yours and call your insurance agent if you arent sure what you need to report and when.

Finally, if you arent at fault for the accident and you plan to file a claim for damages against the other party, youll need to file your suit within your states statute of limitations. The time frames for filing a lawsuit often differ by state and between claims for property loss and damage and claims for personal injuries.
