- Have a complaint that a police service has not provided proper service.
- Have a complaint about a policy of a police service.

Reporting Police Misconduct In Western Australia
Police in Western Australia are obliged to follow the Police Code of Conduct and the Police Force Regulations 1979 . Complaints of misconduct by police, including allegations of unreasonable use of force and corrupt behaviour, are dealt with in three increasing levels of seriousness:

The Civilian Complaint Review Board
If you want to see an individual officer disciplined, your best bet may be the CCRB, particularly since a court ruling from last week freed up the oversight board to take reports from anyone not just direct victims of misconduct. That can include reports spurred by videos posted online.
The agency, with approximately 200 staffers, is the most common place people have leveled allegations against NYPD officers. In 2019, the review board got 4,959 complaints the highest number since 2013.
The board investigates four categories of police misconduct: force, abuse of authority, discourtesy and offensive language collectively known as FADO.
Grievances about police corruption or neglect are sent to the NYPDs Internal Affairs Bureau.
CCRB probers gather evidence and question witnesses before filing a report to the 13-member board, which makes a decision on how to move forward.
In CCRB parlance, a complaint can contain several allegations. In 2019, 24% of complaints were substantiated but only 12% of allegations, according to the board. Those cases are sent to the NYPD with a disciplinary recommendation.
Meanwhile, 35% of allegations were exonerated, meaning the conduct described happened but the preponderance of the evidence determined no rules were broken. Another 33% were unsubstantiated and 9% were unfounded, while 11% of cases fell apart because the officers in question were unidentified.
How Do I Report Police Misconduct
If you feel that police have violated your rights, or youve witnessed police misconduct against someone else, do not panic. Its normal to feel intimidated. But responding to misconduct is an essential step towards protecting yourself and your community from future police abuse.
There are several steps to the process of combating police misconduct. You must approach them in a calm and organized manner.
Step 1: Write everything down
This step is extremely important and must be done as soon as possible after the incident. Its easy to forget small details over time, and theres no way to know which facts will make a difference later on.
In your own words describe everything that happened from the very start of the police encounter to the end. When quoting yourself or the officer try to use exact words. Be specific about the location, time of day, etc. Replay the events slowly in your head to help remember as many details as possible.
Also include witness names and contact information and the officers names, physical descriptions, car number, and badge numbers. If necessary, return to the scene of the incident to talk to possible witnesses. This might also help jog your memory about other important details.
Only include facts that youre sure about. Be very careful to avoid inaccuracies. These can easily damage your credibility and undermine your important work.
Step 2: Consult with an attorney
This step is essential if you were arrested following the incident.
When Does The Independent Office For Police Conduct Investigate A Complaint
The Independent Office for Police Conduct investigates the most serious complaints against the police. Such as:
- serious injury, or
- claims that officers have done something wrong.
Your police force must pass your complaint to the IOPC if you have made a serious complaint about the police. Your police force must also pass information to the IOPC about serious concerns, even if you havent made a complaint.
The IOPC has different levels of investigation. How they investigate will depend on how complicated or serious your complaint is.

There are three crucial steps you must take to properly report police misconduct:
- Document Everything This is a very important step, and you should start writing everything down as soon as possible after the alleged misconduct. You can never tell which minor details will make a big difference in the allegations at a later date, and you want to make sure you keep your side of the story straight.
Write everything down in your own words, from what you were doing right before your interaction with police to the very end of your encounter. Remember the exact phrases you used, and remember the exact words the officer used. What time of day did it happen? Where did it happen? Do you have an exact address? How about the officers name, physical description, license plate number and badge number?
Did you talk to witnesses at the scene? If so, did you get their contact information? These are all things youll want to include in your documentation if at all possible. If you didnt talk to any witnesses, depending on the situation it could be helpful to go back to the scene and try to find one.
Also, if youre not sure of a particular fact, dont write it down as fact. You dont want to do anything to hurt your credibility.

Together, these laws prohibit discrimination on the basis of race, color, national origin, sex, and religion by State and local law enforcement agencies that receive financial assistance from DOJ. . These laws prohibit both individual instances and patterns or practices of discriminatory misconduct, i.e., treating a person differently because of race, color, national origin, sex, or religion. The misconduct covered by Title VI and the OJP Program Statute includes, for example, harassment or use of racial slurs, discriminatory arrests, discriminatory traffic stops, coercive sexual conduct, retaliation for filing a complaint with DOJ or participating in the investigation, discriminatory use of force, or refusal by the agency to respond to complaints alleging discriminatory treatment by its officers. What remedies are available under these laws? DOJ may seek changes in the policies and procedures of the agency to remedy violations of these laws and, if appropriate, also seek individual remedial relief for the victim. Individuals also have a private right of action in certain circumstances under Title VI and under the OJP Program Statute in other words, you may file a lawsuit yourself under these laws. How To Access Your Police
Members of the public have the right to request records containing their personal information from the Ontario Provincial Police or a municipal police service. Individuals who make these requests may have, for example, played a role in a suspected offence, been involved in a call for service or some other police-attended incident or had a relative who died in circumstances that led to the involvement of a police service.
Someone else, such as a lawyer or other person acting on your behalf, may make the request for you, or you may do so yourself. You may file a request by submitting a form and paying a fee, either by mail or in person.
Commonly requested records include:
- officers notes and
- police-related 911 calls.
Many people think that they cannot request a police officers notes, but a police notebook is generally in the custody or control of the police service and is subject to freedom of information requests.
Requesting information from a police service follows the same process as asking for records from other types of government institutions. However, the nature of police-held information means that frequently some of these records or some passages within these records are exempt from disclosure under Ontarios access to information legislation.

Berkeley Police Union President On Leave Amid Misconduct Allegations Over Discriminatory Texts
A Berkeley police union president is off the job after allegedly sending discriminatory text messages to other officers.
BERKELEY, Calif. — A Berkeley police union president is off the job after allegedly sending discriminatory text messages to other officers.
The Berkeley Police Department released a statement on Wednesday confirming it accepted Sergeant Darren Kacalek’s request to be put on leave of absence in light of the allegations.
The department also released a series of statements which say, in part:
“We are disturbed by the alleged texts by B.P.A. president Darren Kacalek.”
“We want the public to know that messages of this type are not reflective of the entire body of officers who work night and day to protect the citizens of Berkeley.”
Interim police chief Jennifer Louis, who took the job back in March, claims in a statement, she found out about the allegations last week.
It reads in part: “If at any point during my tenure, from officer to Interim Chief, I had become aware of these allegations, I would have immediately done my part to initiate an investigation.”
Louis will remain in her role until the investigation concludes.
On Tuesday night, what was meant to be a relatively straightforward meeting of the Berkeley City Council was turned upside.
The cause was allegations sent to city officials – claiming a pattern of misconduct at the department.
Who Deals With Police Misconduct In New South Wales
There are three organisations that deal with complaints of police misconduct in New South Wales. Less serious allegations, such as the use of unreasonable force, traffic offences, failing to provide a satisfactory level of service, and breaches of police rules and procedures are dealt with by the NSWPF Customer Assistance Unit or the NSW Ombudsmans Office.
The Police Integrity Commission investigates allegations of serious misconduct by police officers, civilian employees of the NSWPF, and officers of the NSW Crime Commission.
