Physical Strength And Size Requirements

In many instances such as in Dothard v. Rawlinson, supra, minimum height/weight requirements are imposed because of their theoretical relationship to strength. Impliedly, taller, heavier people are also physically strongerthan their shorter, lighter counterparts. However, such comparisons are simply unfounded. And, the Court in Dothard accordingly suggested that “f the job-related quality that the identify is bona fide, their purposecould be achieved by adopting and validating a test for applicants that measures strength directly.”

Example – Prison Correctional Counselors – In Dothard v. Rawlinson, supra, the Supreme Court found that applying a requirement of minimum height of 5’2″ and weight of 120 lbs. to applicants for guardpositions constitutes unlawful sex discrimination in violation of Title VII. Relying on national statistics, the Court reasoned that over forty percent of the female population, as compared with only one percent of the male population,would be excluded by the application of those minimum requirements. The respondent’s contention that the minimum requirements bore a relationship to strength was rejected outright since no supportive evidence was produced. The Courtsuggested that, even if the quality was found to be job related, a validated test which directly measures strength could be devised and adopted.

Different Maximum Weight Same Height And Standard Charts

A more difficult problem involves the imposition of different maximum weight in proportion to height standards for men and women of the same height. Unlike minimum height requirements where setting different standards has been found toresult in discrimination , some courts have found that setting different maximum weight standards for men and women of the same height does not result in prohibited discrimination. Indeed, thevery charts which are standard, and which are relied on to establish height/weight in proportion to body size contain different permissible limits for men and women in recognition of the physiological differences between the two groups. A 5’7″man of medium stature would therefore be permitted to weigh proportionally more than a 5’7″ woman of medium stature on the same height/weight chart. The difference in weight in proportion to height of a 5’7″ woman of large stature would ofcourse be less.

This issue must remain non-CDP. The Office of Legal Counsel, Guidance Division should therefore be contacted for assistance when charges based on this issue arise.

Police Commissioner Donald F. Cawley indicated yesterday that height requirements might he eliminated for police officers so that men no taller than jockeys could be patrolling the city’s streets.

Mr. Cawley said new qualify ing tests were being considered that would do away with re quirements that were not job related and might eliminate traditional height and athletic prowess requirements. Police men now must be at least 5 feet 7 inches tall: policewomen must be at least 5 foot 2.

You may see a different type of police officer in the future, Mr. Cawley said. Even men 5 feet tall or less may have a chance to qualify.

He said that candidates for the Police Department would he evaluated with new testing methods during their sixmonth training period.

Obviously, if a recruit is too small to sit behind the wheel of a police car or lacks some other necessary requirement, he or she could not become a po lice officer, he added.

Mr. Cawley defended the re cent proposal he had made that officers should wear name plates while on duty, declar ing that policemen in nine of 10 major cities in the nation wore nameplates. He said he would meet with the line or ganizations tomorrow to dis cuss the proposal.

Mr. Cawley made his remarks on the WABC Eyewitness News Conference television program.

    Police Officer Physical Requirements For Strength Agility And Endurance

    The strength testing often relies on the candidates ability to perform vertical chin-ups, meaning lifting their body while suspended from a vertical bar until the chin reaches the bars level.

    Performing a successful ascension grants the candidate 55 percent of the overall strength score and for each additional one, he is granted another 5 percent.

    The most common approach is passing candidates that manage a 75 percent score or 5 chin-ups.

    Judges in North Rhine-Westphalia have made it official: Short people can join the police too. The move highlights how contentious the height rules are that some German state police forces apply when hiring new officers.

    It’s not easy being short. Aside from not reaching the highest shelf or having to hem your pants, being vertically challenged can also prevent you from getting your dream job. It looked like this was going to happen to Johanna Dillmann, a 22-year-old who had applied to become a police officer in the western German state of . Police rejected her because she wasn’t tall enough. The required height for female police officers in the state is 1.63 meters . Dillmann is 1.615 meters tall – 1.5 centimeters too short.

    But on Tuesday, a court in Dusseldorf decided that the young woman’s application couldn’t be thrown out merely because she was lacking a centimeter-and-a-half in height.

    In explaining their decision, the judges pointed to the German constitution, which states that the best applicants for a job may only be determined by looking at their abilities and qualifications in their field. Exceptions can only be made if parliament passes a law with additional criteria, explaining why said criteria are not an arbitrary form of .
