Delaware has the fewest number of counties of any state in the US, with only three: New Castle, Kent, and Sussex. As provided for by the state legislature, each county may set its own requirements for sheriffs deputies. However, county sheriffs in Delaware, unlike in most other areas, do not have the same law enforcement duties and powers as other law enforcement officials. In 2012, this was codified in law by the passage of House Bill #325, which clarifies that sheriffs and sheriffs deputies in Delaware do not have arrest authority.
