The scope of the investigation will be determined by the seriousness of the allegation and by the number of persons involved. Investigations may take several weeks depending on the complexity of the case. Investigators make every attempt to conduct personal interviews with complainants, witnesses, or employees while conducting the investigation. A criminal investigation may require the cooperation of federal or state prosecutors. The Illinois State Police will not arbitrarily delay an investigation.

When Should A Complaint Be Filed

Its possible for a citizen to complain about a police officer for a variety of reasons. Perhaps they failed to adequately identify themselves or used demeaning language. Police officers also are not allowed to discriminate against citizens for any reason whatsoever.

What If I Am Unhappy With How The Police Handled My Complaint

You may be able to appeal. You can appeal if:

  • you disagree with how your complaint was investigated,
  • the police force failed to record your complaint,
  • you disagree with outcome of the local resolution process,
  • you disagree with outcome of a local investigation process,
  • the police force decided not to investigate your complaint,
  • the police force stopped their investigation into your complaint,
  • you didnt get enough information to understand how the decision was reached, or
  • you disagree with the action that the police are taking.

The police should tell you who you can appeal to when they contact you with the outcome of your complaint. This will be the Independent Office for Police Conduct or the chief officer of the police force. Make sure you contact who you are told to. This will avoid any delay.

You need to send your completed appeal form and a copy of the decision letter from the police within 29 days. For example, if your decision letter is dated 1st April, you have to make sure that the IOPC receive your appeal by 29th April.

If you are not happy with how your complaint was processes or the outcome of your complaint you can contact your Member of Parliament for help.

How will the IOPC deal with my appeal?

It can take up to 10 weeks for your appeal to be dealt with.

The IOPC will not investigate your complaint. They will look at how the police handled your complaint.

The Department attempted to be very thoughtful about what information was released and what was not. These decisions were not made to âhideâ types of crimes from the public, instead decisions were made about who to protect.

The only reports that are not being released under this system are when the rights of the victim, age of the victim, possibility of revictimization or overall public safety/security issues take clear precedence over the public right to know.

Information on Rape and other sexual offenses, Domestic Violence, Child Abuse, Kidnapping, Suicides, locations that are sensitive , Homeland Security issues and tactical information that might compromise the safety of our officers are not being released in this system.

If the event is one of the many types we do show, but the location code was entered into the system incorrectly, the location of the event cannot then be verified. In this scenario, this particular event will not appear on the map at all, rather than providing possibly misleading information.

What To Include In Your Tip

Any information you can provide to the authorities that will prevent further drug activity is absolutely helpful. The following are a few details that will ensure your anonymous tip is as effective as possible. If you have the information, try to include:

  • The address where you suspect drug activity.
  • Full names of the people you suspect.
  • Related vehiclesmake, model, license plate.
  • When people come and go, how long they stay, how often they appear.

Asking For A Criminal Investigation

The Procurator Fiscal is independent of the police. You can report a police officer to your local Procurator Fiscal.

The Fiscal might decide:

  • not to prosecute – the Fiscal will refer the case back to the police to decide if the officer should be disciplined
  • to report the case to the Crown Office – this is the headquarters of the Fiscal service, which decides whether to prosecute the police officer. The Fiscal’s office will tell you what the Crown Office decides.

Filing A Report In Person

  • There may be dual jurisdiction in some areas, such as if you live in a metro area where city and county governments have been consolidated. In that case, just find the precinct office the shortest distance from you. If you’re in the wrong place, they’ll tell you where to go.

    If you have a complaint against a police officer or sheriff’s deputy, you should first direct your complaint to the local law enforcement agency regardless of whether you are alleging criminal or non-criminal misconduct. Each law enforcement agency in California is required by Penal Code section 832.5 to establish a procedure to investigate complaints. You can obtain a written description of the procedures from the law enforcement agency.

    If you are alleging that a law enforcement officer committed a crime and your complaint is not resolved by your complaint to the agency, you should next contact the county district attorney in the county where the law enforcement agency is located. Most complaints against local law enforcement can be resolved by contacting the aforementioned agencies.

    If these agencies do not act on your complaint within a reasonable period of time, you may file a complaint with the Attorney General’s Office. The Attorney General will review citizen complaints against a law enforcement agency or its employees for possible investigation when substantive allegations of unlawful conduct are made and all appropriate local resources for redress have been exhausted.

    Last year, I attended a weeklong regional technical training course tailored for first-line supervisors. The course covered best practices in managing large-scale chaotic scenes and conducting after-action reviews. After the training, I spoke to one of the instructors, a retired LEO, for more information on after-action reports. I was quickly met with an interesting and borderline discouraging comment: âOfficerâs donât care about reports they care about tactics. Focus on tactics, and someone else will do the after-action report.â

    My colleagues were in the same boat: lots of tactics training with little to no police report writing training.

    Tactics keep you alive, but a well-written police report keeps you out of trouble however, report writing is something most agencies dismiss as an important officer survival skill.

    The vast majority of the law enforcement officers in this country perform their very difficult jobs with respect for their communities and in compliance with the law. Relevant information includes: the time and date of the incident what offense occurred the number of the police report the name of the victim the victims date of birth the place at which the incident occurred the name and badge number of the police officer called to the address the name of the suspect the suspects date of birth and the date and location of the suspects arrest.

    A party should also provide the insurance policy number or claim number whether or not the requesting party is an insurance company a release from the victim if the request is from an attorney and proof of relationship if the requesting party is a parent of a minor victim or the spouse or relative of a deceased victim.     Who Deals With Police Misconduct In New South Wales

    There are three organisations that deal with complaints of police misconduct in New South Wales. Less serious allegations, such as the use of unreasonable force, traffic offences, failing to provide a satisfactory level of service, and breaches of police rules and procedures are dealt with by the NSWPF Customer Assistance Unit or the NSW Ombudsmans Office.

    The Police Integrity Commission investigates allegations of serious misconduct by police officers, civilian employees of the NSWPF, and officers of the NSW Crime Commission.     How Do I Report Police Misconduct

    If you feel that police have violated your rights, or youve witnessed police misconduct against someone else, do not panic. Its normal to feel intimidated. But responding to misconduct is an essential step towards protecting yourself and your community from future police abuse.

    There are several steps to the process of combating police misconduct. You must approach them in a calm and organized manner.

    Step 1: Write everything down

    This step is extremely important and must be done as soon as possible after the incident. Its easy to forget small details over time, and theres no way to know which facts will make a difference later on.

    In your own words describe everything that happened from the very start of the police encounter to the end. When quoting yourself or the officer try to use exact words. Be specific about the location, time of day, etc. Replay the events slowly in your head to help remember as many details as possible.

    Also include witness names and contact information and the officers names, physical descriptions, car number, and badge numbers. If necessary, return to the scene of the incident to talk to possible witnesses. This might also help jog your memory about other important details.

    Only include facts that youre sure about. Be very careful to avoid inaccuracies. These can easily damage your credibility and undermine your important work.

    Step 2: Consult with an attorney

    This step is essential if you were arrested following the incident.
