In the context of a car accident case, a police report is a written document that is usually generated at the scene of the crash, typically by the responding law enforcement officer. The police report often contains:

  • details of the crash and the people/vehicles/property involved
  • statements from drivers, passengers, and witnesses
  • a drawn diagram of the accident , and
  • in some instances, the officer’s findings or conclusions as to how or why the accident might have happened.

Effective Tuesday, July 6, 2021, SFPD Police Headquarters at 1245 Third Street will reopen to the public after a temporary closure due to the COVID pandemic.

You may request a police incident report in person at SFPD Police Headquarters during our normal business hours of 8 am-5 pm, Monday – Friday .

The SFPD Crime Information Services Unit is responsible for processing incident report requests from the public, law enforcement agencies and other authorized organizations. The unit also processes local criminal background checks for agencies entitled to that information under the law. For all other requests that are not incident reports or local background checks, please contact the appropriate department within SFPD.

Warrant And Capias Information

Q: What is the difference between a warrant and a capias?

A: A warrant is an order which authorizes a law enforcement officer to arrest and bring a person before the judge. A warrant may be issued when a person is charged with a crime, convicted of a crime but failed to appear for sentencing, owes a fine or is in contempt of court. A capias is also an order for arrest of a person, typically issued by the judge or magistrate in a case. It is commonly issued after a defendant fails to attend a scheduled court hearing.

Q: How do I know if I have an outstanding warrant or capias?

A: Respond to any Police District or ask an officer on the street to run a query on your social security number. You should provide some type of identification, if possible. To protect your privacy, police will NOT run a query if you simply call a district on the telephone.

Q: If there is an outstanding warrant or capias, will I be arrested on the spot?

A: Most capiases allow an officer to re-cite, meaning you will be given a new court date. However, if you have been re-cited numerous times and have continued to ignore the court date, the officer may choose to physically arrest you. Most warrants require an officer to physically arrest the person. Once you are re-cited or processed through the Hamilton County Justice Center, the warrant/capias is cancelled by the Hamilton County Central Warrants Department .

The More Facts Known About The Accident The Better

  • Get as much information from the caller as possible. Try to ask the following questions:
  • When is the bomb going to explode?
  • Where is it right now?
  • What does it look like?
  • What kind of bomb is it?
  • What will cause it to explode?
  • Did you place the bomb?
  • Keep the caller on the line and record everything that is said.
  • Notify the police and building management immediately.

    How Do I Get A Copy Of A Police Report

    Police investigations may seem secretive, but did you know you can get your hands on a copy of an official police report? Whether youve been in a car accident, youve witnessed a crime, or you simply want to know about an incident that happened in your jurisdiction, there are steps you can take to request access to police reports.

    The exact process may vary by jurisdiction, but it is generally the same across the country. Agencies have different policies for releasing sensitive information that is in police reports, so be sure to check with your local police department to confirm how they handle requests. As you are researching, you may find the request titled a Freedom of Information Request or a Public Access Request. Different areas use varying language, but they both mean the same thing and are referring to the Freedom of Information Act , which makes it entirely legal for citizens to request certain government information.

    Reports will include details of the incident, where it took place, who was involved, witnesses, and much more essentially, it is anything that is even remotely relevant to the case. But keep in mind, you will not be able to receive a copy of a police report until after the police investigation has been closed.

    California Family Code § 6228 provides that victims of the alleged crimes, listed above, may receive a copy of their incident report within five days of their request, free of charge. Due to the sensitive information included in the reports, SFPD protocol requires in-person identification verification. Victims or their designated representatives must either submit their request in-person or pick-up their incident report in person at CISU Records Management.     How Are Police Reports Obtained And How Much Do They Cost

    Accident Reports, Incidents, and Crime Reports: can be obtained from the Records Bureau as soon as they become available. You may request the report in person, but reports take time to prepare and we strongly recommend that you call ahead for a copy of a report so that we can have it available to you when you come in. If the report you are interested in obtaining is for insurance purposes or for a lawyer, you may prefer to have them request the report for you.

    Accident Reports:

    You may obtain a copy of an official Accident Report that the officer completed if you were an operator of one of the vehicles in the accident, or the owner of a vehicle involved in the accident, or an injured party, or an insurance company requesting on behalf of their clients, or attorneys representing clients in a civil action. Accident Reports are obtained from the NH Department of Safety Division of Motor Vehicles by completing Form DSMV 505. For any assistance, please contact the Division of Motor Vehicles at 227-4040.

    Incidents:

    An incident sheet is a very brief description of calls that officers respond to. An incident sheet is typically one page of information that includes the date and time of an incident, the location, and the name of officer who responded to the scene.     Members of the public have the right to request records containing their personal information from the Ontario Provincial Police or a municipal police service. Individuals who make these requests may have, for example, played a role in a suspected offence, been involved in a call for service or some other police-attended incident or had a relative who died in circumstances that led to the involvement of a police service.

    Someone else, such as a lawyer or other person acting on your behalf, may make the request for you, or you may do so yourself. You may file a request by submitting a form and paying a fee, either by mail or in person.

    Commonly requested records include:

    • officers notes and
    • police-related 911 calls.

    Many people think that they cannot request a police officers notes, but a police notebook is generally in the custody or control of the police service and is subject to freedom of information requests.

    Requesting information from a police service follows the same process as asking for records from other types of government institutions. However, the nature of police-held information means that frequently some of these records or some passages within these records are exempt from disclosure under Ontarios access to information legislation.

    Are Police Reports Admissible In Court

    While police reports are commonly used in car insurance settlement negotiations, admitting a police report as evidence when you file a car accident lawsuit is not quite as clear cut.

    In small claims courts, litigants are usually permitted to use police reports as evidence in their car accident case. You will not be expected to know all the rules of evidence, so judges typically will allow plaintiffs and defendants to use the police report in explaining what happened.

    If your car accident case goes to trial in your state’s court of general jurisdiction , you should know that parties in these cases are held to the rules of evidence and must contend with whether the police report falls within the rule against “hearsay” evidence, which keeps out many out-of-court statementsby definition, any assertion made in a police report is a statement that was made out of court.

    In some jurisdictions, the police report may fall within the “public records” or “business records” exception for admissibility. In other jurisdictions, different exceptions to the hearsay rule may apply and allow you to admit some or all of the police report as evidence.

    How Long Does It Take To Receive The Report

    Police officers understand that this report is vital when making insurance claims or when you are required to go to court related to the accident. This is why they show all due diligence to complete the report as quickly as possible.

    This is usually completed within 3 to 5 business days of the accident. At least, a preliminary report will be written during that time should you need some initial documentation to file with the court or with your insurance company.

    However, you should be aware that this is not always the case. Some police departments operate under different procedures and guidelines, which can mean that the report can take up to four weeks before it is finally concluded.

    In an instance where there is a severe accident that has led to death, this can stand in the way of a person being able to file a death benefit claim with their insurance company since they do not have the official police report.

    This can make it so that it could be months before they receive the insurance settlement, which may put a real hardship on the family. If there is a need to wait on reports, like a toxicology or an autopsy, this can extend the time the police officer has to complete the report to months, maybe even a year or longer. That is clearly unacceptable.

    Reports get completed quicker, tests are processed faster, and documentation is provided in a manner that doesnt seem to be completed as quickly when one is seeking this kind of documentation on their own.

    How Do I Obtain A Police Report

    In most cases the public portion of police reports can be obtained from the APD Incident Report Database. Please read the Incident Report Database instructions on how to obtain the report. Make sure to enter the case number exactly how it is shown in the instructions.

    For information about purchasing a copy of the public portion of a police report contact the Austin Police Department Report Sales Unit at 974-5499. Reports can be purchased at the Main Police Headquarters, located at 715 E 8th Street. Reports are 10 cents a page and only the public portion is available for purchase from the report sales office. This is the same report that can be obtained from visiting the APD Incident Report Database. Report Sales new hours of operation are Monday through Friday, 8:30 a.m. – 4 p.m.

    Police Accident Reports submitted to DMV by police departments other than the New York State Police may or may not be submitted electronically, therefore, these guidelines may not be applicable.

    Motorists requesting a copy of an MV-104A submitted by a police department other than the New York State Police should follow the instructions contained in paragraph above entitled, For Collisions on all Other Roads or contact the investigating police agency directly.
