How To Report A Crime

How Should You Deal With Verbal Threats

You can report a crime in person, over the telephone and, in some communities, over the Internet . Depending on the urgency, choose the method that best suits your situation and makes you feel most comfortable. In case of emergency, please call 911 immediately. If your community does not have 911 services, the emergency number for your local police can be found on the inside front cover of your phone book under emergency numbers.

Threat And Risk Assessments

The safety of the complainant is of paramount concern at all times and takes priority over “evidence-gathering” or “making a case.” Each case must be treated seriously until evidence indicates otherwise. It is crucial to keep in mind that threat and risk assessments are contextualFootnote 108 and only relevant for a specific period. Factors should be updated and re-evaluated as needed for subsequent decision-making. Furthermore, although this process can help the parties make decisions, the absence of “identified risk markers” does not mean that violence will not occur.Footnote 109

The appropriate level or type of intervention in a given case cannot be determined until a threat assessment or risk assessment has been made. While the terms are often used interchangeably, “threat assessment” refers to the process of assessing the risk of violence that the suspect poses to the complainant and assessing the potential impact of contemplated type of intervention on the complainant’s safety. The term “risk assessment” refers more specifically to a developing body of research and tools aimed at improving the ability of various professionals in the criminal and civil justice systems to evaluate “individuals to characterize the risk that they will commit acts of violence and develop interventions to manage or reduce that risk ⦔.Footnote 110

  • 2Visit the police station during normal business hours. While police stations are typically staffed 24/7, you’ll have better luck filing a police report if you go during the day. Try to go first thing in the morning when there’s usually a shorter wait. Bring a valid photo ID so the police can verify your identity.XResearch source
  • In many cities, you also have the option of having an officer dispatched to your location to take the report. If you use this option, you might be waiting for a while before the officer arrives, particularly on busy days.XResearch source

The Advantages Of Filing A Police Report For A Threat

If you have been the target of express or implied threats, you may be feeling intimidated, frightened, angry and confused. Many individuals are reluctant to file official reports of threats to the authorities for various reasons. They may feel intimidated by law enforcement or they may believe that threats by themselves aren’t serious enough to report to the police.

However, reporting threats to local law enforcement officials is a good idea for a number of reasons. Whether the threat is verbal, written or implied through physical intimidation or the brandishing of weapons, it is potentially a criminal act. Reporting threats to the appropriate authorities produces a number of benefits for the person threatened, law enforcement and the public at large.

    Federal Penalties For Criminal Threats

Depending on the circumstances of the threats or the intended recipient, other federal penalties may apply.

How Can A Criminal Charge Affect Family Law Proceedings Will Intimate Partner Violence In A Family Be Considered When Determining Parenting Arrangements And Custody

Criminal law is intended to stop crimes or offences from being committed and punish offenders. Usually, the police lay charges and a Crown attorney will prosecute the case in court. Assault is a crime and should be addressed through the criminal court system.

Under criminal law, once someone is arrested and charged with abusing their spouse or partner, the court can impose conditions on the alleged abuser, until the charge is dealt with in court. The conditions may include no contact or communication with the victim or forbidding the alleged abuser from using alcohol or drugs, etc.

These conditions may impact a family law matter. If your partner has been charged with a crime for assaulting you or your children, please contact Manitoba Justice Victim Services at 204-945-6851 or 1-866-484-2846 to speak with your assigned victim services worker.

One of the criteria that a court must consider is the presence of any family violence and its impact on the ability and willingness of any person engaged in the family violence to care for and meet the needs of the child.

What Happens After The Police Are Called

    Domestic Abuse

The police can help the victim leave the home and get medical attention. If an abuse victim and their children need a place to stay, a shelter may be available in their community. For a list of shelters and community resources for victims of family violence, visit the Resources section of this website.

Once an abusing spouse or partner has been charged, the case will proceed in criminal court. If the alleged abuser pleads not guilty, the victim will ordinarily be required to be a witness for the Crown. In criminal prosecutions by the Crown, only the Crown can stop the proceedings once charges have been laid.

In Winnipeg, a special family violence court handles spousal or partner abuse prosecutions, physical and sexual abuse of children and elder abuse. This court is designed to deal sensitively with abuse prosecutions. The judges and Crown attorneys who appear in this court are particularly aware of the community resources available for both victims and offenders.

    Specificity And Credibility Of Threats

The threat must be capable of placing someone in fear of harm and lead them to conclude that the threat is credible, real, and imminent. If you threaten to blow up the world if you don’t get the last chocolate babka, no reasonable person hearing it would believe the threat was real. On the other hand, if you walk into a store with a gun and threaten to shoot everyone, such a threat is credible and specific.

Collecting Evidence: Information To Investigate And Document

Ask the complainant about, and query all relevant databases for, information on the suspect. Search under known aliases as well. Databases queried should include Canadian Police Information Centre , Canadian Firearms Registration Online ,Footnote 99 Special Interest Police , Firearms Interest Police , local and provincial information systems, and available probation information sources /Level II). Where applicable, immigration and refugee authorities may have relevant information. In some cases, consider contacting prison institutions for further information on the conduct of the suspect, or relevant information relating to the complainant. These queries should include searches for criminal records, prior contact with police and contact with police in communities where the suspect may have previously lived. If the criminal record indicates similar charges, determine the identity of the victims in those cases and the nature of their relationship with the accused.Footnote 100 These queries should cover the following:

In cases of former intimates involving children, include any history of involvement with child protection authorities.

Determine possession of or interest in weapons or access to weapons . Determine the following, for example:

Guidelines For Police: Investigating Criminal Harassment

Home surveillance camera shows officer lied on report when charging man with major crimes

The investigation of criminal harassment cases involves basic case development as well as the use of crime detection strategies. It may differ somewhat from investigation of other violent offences in that criminal harassment often involves conduct that, in isolation, appears innocent and harmless. As criminal harassment is often a progressive crime that wears down its victims over time, early, effective intervention can go a long way toward preventing more serious psychological harm and escalation of the harassment into violence or homicide. The objective of a police investigation in these cases is two-fold: to stop the harassment, as well as any other acts of violence, at an early stage and to collect evidence to present a compelling case for prosecution. Since criminal harassment is a crime that may include a pattern of behaviour carried out against the victim over an extended period, an investigation can be time consuming and may involve numerous police reports.

Police practices and policies may vary from one jurisdiction to another. These guidelines should be considered in conjunction with other applicable policies and forms, as well as other remedial legislation . Keeping the victim informed and involved in the investigation is important in any offence, particularly in cases involving partner or spousal abuse.
