Requesting A Police Report By Mail

DUI Arrest: How to get a copy of the police report?

The process of requesting a copy of a police report by mail is a bit more involved. In many jurisdictions, you are required to make your Public Access Request via mail. Typically, the agency will provide a form online for you to fill out, but some places are fine with you writing a letter to ask for the police report.

1. Figure out where to send the Public Access Request form or letter.

Your local police department may have a specific address and addressee for police report requests listed on their website. If they dont, simply address it to the Records and Identification Division, and use the general address listed online for the department.

2. Fill out the form or write the letter.

After you have found the location to send your request, you should be able to easily find out if they want you to send a request form or a letter. If the information is not readily available on the site, just call and ask which method they prefer. If it is available, filling out a request form is typically the easiest method because you wont have to worry about leaving out information.

If you write a letter instead of filling out the form, be sure to include the following information:

  • Case number
  • Your Name, Birthdate, and Address
  • The date and location of the incident
  • Your role in the case
  • The officers name who filed the report
  • What exactly you are requesting

3. Gather additional materials and send the form/letter.

4. Pay for the police report.

Getting A Copy Of The Dui Arrest Report

The report prepared during a DUI arrest is usually available as of the initial court date, which is typically listed on the ticket issued during the arrest. If the state offers a DMV hearing and the individual elects this, the report may be requested from the DMV. It should arrive at least a week before the DMV hearing date.

Obtaining the DUI arrest report prior to the court date can be difficult but a DUI attorney can help. If the situation included an automobile accident and state police were involved, a copy of the report may be available from the local station. To reduce the runaround involved in this process, hire a DUI lawyer and let this expert deal with the police or DMV to get the report.

How Do I Make The Request

The state of Nevada allows you to obtain your police crime report either in person or through the mail. When making a written inquiry, you will have to include a notarized authorization, a current copy of your government-issued photo identification and a self-addressed, stamped envelope. You must also include a check or money order to cover any applicable fee. It may take as long as a month to receive a reply by mail. When time is of the essence, you can speed the process by requesting your report in person at police headquarters. Doing so will also give you the opportunity to ask questions and seek further direction. You will need to show an up-to-date form of photo ID, and you can expect that someone there will likely copy it for recording purposes.

Preliminary Alcohol Screen Device

Usually after you have done some field sobriety tests after you got pulled over, the officer will bring out a handheld breath device that he will get you to blow into. This handheld breath machine is called a preliminary alcohol screening device . Under the law it is described as a field sobriety test which the officer can use to detect the presence of alcohol in you.

Under the law, blowing into this device is supposed to be optional the officer must tell you that you can refuse this test, unfortunately officers usually never tell you it is optional to blow into this device and they will make you blow into it. After you blow into it they almost always will not tell you your results.

How To Get The Police Report In Your Dui Case Directly From The Police Agency

How to get the police report in your DUI case

As you can see from the above, if you try to get a copy of your police report from the police agency, often they will state they cannot release that to you, citing the above laws. They may say that, as a pending court case, that you need to get any report through your attorney as part of the court case.

However, police records departments are often used to giving out police reports for insurance or investigative purposes, especially in traffic collision cases. Licensing agencies and background investigation services also commonly order police reports. However, access to these records varies greatly from one police agency to another and depends mainly on their procedures and policies for records.

As an Orange County DUI Attorney, I have had my clients tell me that they have had success in going directly to the police records department and obtaining their reports there. Most police agencies charge per page for copying police reports, so there is a charge.

In Orange County, some of the police agencies that have policies releasing police reports are as follows:

How Reliable Are These Tests

How do I get the police report in my Nevada DUI case?
Evidence of reliability

The National Highway Traffic Safety Administration sponsored research beginning in 1979 that lead to the development of the Standardized Field Sobriety Test . The tests were designed to help officers make arrest decisions at and above the 0.10 percent blood alcohol concentration .

Since then, many states, including California, have lowered their BAC limits to .08 percent and further studies have been conducted to validate the tests. See footnote for some detail. As a result, police and court officials have confidence in these tests.

Evidence of unreliability and invalidity

While police like using the tests, some critics say the tests are unreliable. Dr Sturgeon Cole, a retired professor from Clemson University, says the tests are designed to fail. He is concerned that There are no norms and there is no average score. We have no idea what an average person can do on one leg doing heel to toe. He also says that even when conducted correctly, the tests give officers an indication of intoxication which is only 26% better than chance . After studying these tests for decades, he is convinced they are neither valid nor reliable.

Whatever your opinion on the reliability of the tests, bear in mind that the 3 tests comprising the Standardized Field Sobriety Test are considered reliable by judges and are admissible as evidence in court in California.

What If You Are Representing Yourself

It is never wise to represent yourself. In a DUI case, which involves testing science and legal issues, an Orange County DUI Attorney can help you defend your case. But if you do choose to appear as your own attorney, the law accounts for that special situation, as follows:

If the defendant is acting as his or her own attorney, the court shall endeavor to protect the address and telephone number of a victim or witness by providing for contact only through a private investigator licensed by the Department of Consumer Affairs and appointed by the court or by imposing other reasonable restrictions, absent a showing of good cause as determined by the court.

With Orange County DUI cases, where a person is representing themselves in a DUI, the current procedure is to have a public defender redact all witness information, including the police officers, copy the reports, and provide the copied report to the defendant acting as their own attorney. That is one of the ways how to get the police report in your DUI case. But there are others.
