What Can You Do If Someone Files A False Cps Report

How Long Do You Have to File a Police Report?

Unfortunately, false CPS reports are filed every day. In fact, the majority of reports taken by the Department of Human Services are not supported. False reports are filed by friends, family members, educators, and even acquaintances who might make snap judgments or misinterpret a situation. In some cases, individuals do it out of anger or spite. This is most commonly the case with in-laws and ex-spouses. If you are facing a false CPS report, you have options.

Department of Human Services Investigation

Depending on the complaint, the Department of Human Services may choose to investigate whether it has any truth or not. Generally, caseworkers do their best to ensure that the allegations are unfounded if there appears to be no basis for them. Unfortunately, there is always the chance that false claims may gain traction with caseworkers as well.

If a caseworker does arrive at your home, it is important to remain calm and polite when you ask why you are being investigated. It is also important to call your attorney right away, especially before you answer any questions. You can even have your attorney on speaker phone during the conversation with the caseworker. Your caseworker may have the right to inspect the home and speak with the child or children in question.

Making A False Police Report

Someone who files a police report that contains information that isn’t true hasn’t necessarily filed a false police report. She may identify the hit-and-run car as blue when it was black, or say the driver was a young woman when in fact it was a mature woman. Everybody makes errors in eye-witness testimony, and nobody can or should fault them for it.

Making a false police report is a different thing altogether. It involves intentionally feeding the police incorrect information, usually for one of two purposes: to shield themselves from police scrutiny for a crime they committed, or to implicate an innocent person for a crime as personal revenge. The types of false information given may include:

File A Restraining Order

5 Police Report Templates

If you’re in an emergency situation, call 911.

If you’ve been a victim of domestic abuse and want to take legal action, you may be able to file for a protective order. Protective orders are also known as restraining orders or injunctions.

The process for obtaining a protective order differs from state to state. Your local police and court can help you get the process started. Contact your state, county, or municipal court for more information.

Generally, you have to fill out paperwork and submit it to the county courthouse. If you need protection right away, a judge may issue a temporary restraining order. To get a longer-term order, your judge may want either or both a full court hearing and your abuser’s presence.

The police can enforce a protective order. If necessary, the order can include special provisions like:

  • Custody of children

  • Forcing the abuser to leave a home

In some states, a protective order requires the abuser to surrender all firearms.

Can A Private Person Arrest Any Person

Any private person may arrest or cause to be arrested any person who in his presence commits a non-bailable and cognizable offence, or any proclaimed offender, and, without unnecessary delay, shall make over or cause to be made over any person so arrested to a police officer, or, in the absence of a police officer.

What Happens If You Lie On A Police Report

As mentioned above, if you lie on a police report then you may be charged with obstruction of justice or for filing a false police report. Again, the consequences of lying on a police report depend on the specific circumstances surrounding the lie, and the nature of the lie. Minor lies, such as lying about the details of a minor incident to build evidence in a civil case will likely result in misdemeanor penalties.

However, making a material lie such as filing a false report of a bomb threat resulting in the shut down of a location and the use of public resources to search the location would likely result in a felony charge.

In addition to criminal fines and prison time, there may also be civil penalties for filing a false report, especially if the report was filed against another individual or corporation and caused them harm. Civil penalties may include reimbursement of attorney fees for the defendant in defending their claim, damages for lost wages, emotional distress, and other related civil damages.

Note: Filing A Police Report Is Not The Same As Filing An Insurance Claim

First things first its important to understand that police reports and insurance claims involve two totally different processes.

It is true that your car insurance contract probably requires you to call your insurer and notify them that youve been in an accident. But notifying the insurer isnt the same as reporting the accident to law enforcement. You have to do both.

Even if you have zero intention of filing an insurance claim, pursuing a lawsuit, or making a claim for compensation, you still need to cross both these items off your to-do list ASAP:

    • Notify your car insurance company.
    • File a police report.

We also strongly recommend that you see a doctor as soon as possible for a post-accident medical exam and contact an experienced Kingston personal injury lawyer .

    Are Police Reports Public Records

Many types of police records are exempt from public disclosure. There are two main reasons why they arent publicly available. First, disclosing the information could undermine an ongoing investigation. Second, it could jeopardize someones privacy and safety. In some cases, departments will release certain information related to the report, such as to a reporter doing a story. However, they rarely release a full copy.

What Is The Issue With Not Filing A Police Report

There are a few common reasons why people dont file a police report. Even if you contact the police, you can still choose not to file one. Maybe the damages are not that bad or you feel fine. Here are some reasons why you SHOULD file the police report despite these.

  • Car accident injuries can take time to show up. It is better to have a police report if you plan on filing for compensation for medical bills.
  • You may have a different recollection of the accident later on. The police report will provide a standard in a claim or lawsuit.
  • The other driver may decide to file a claim against you, even if the wreck wasnt your fault. Without a police report that offers the facts, you may have little defense.
  • YOU may decide to file a claim or lawsuit for delayed injuries and negative results of the car accident. If this is the case, you will need a police report.
  • Your insurance company will need a police report to verify that you were as responsible as possible while driving. Your rates could go up without the report.
  • What Happens When A Police Report Is Filed Against You

Dealing with the criminal justice system can be a frightening and overwhelming experience, even when an individual isn’t facing the threat of an arrest. Being investigated can be even more stressful because police aren’t obligated to explain themselves until their investigation is completed and an arrest is made. Understanding the legal rights of the accused can be critical in these situations, combined with competent legal help.

There Are Two Types Of Auto Accident Reports In New York

In New York, the terms accident report and police report can get confusing. In general, when we talk about the filing of a formal report after an auto accident, we are talking about one of two forms:

    • MV-104A This is the official police report the responding officer files after your accident. While it is generally the officers responsibility to complete this report, there may be situations where that responsibility falls to you instead .
    • MV-104 Some collisions require that each driver file a Report of a Motor Vehicle Accident, also referred to as a Civilian Accident Report . This report should be completed using the information contained in the MV-104A, as well as the Exchange of Information form the responding law enforcement officer should have provided you at the scene of the crash.
