You will receive a criminal records register extract from us by post. This extract may only be sent to your address registered in the central population registry, a special address you have registered with the Swedish Tax Agency, or to a Poste Restante address. Poste Restante means that an envelope must be collected at a post office.

The processing time is up to two weeks from the time we have received the application until the time we send the extract. The processing time may vary depending on how many people request extracts at a given time.

If you are a citizen of another country in the European Union or the United Kingdom, the police retrieve information from that country. This means the processing time may be slightly longer.

We cannot prioritize a certain application.

What Is The Difference Between A Dui Owi And Oui

DUI, OWI, and OUI are serious traffic violations that generally refer to the same offense. DUI means Driving Under Influence, OWI means Operating While Intoxicated, and OUI means Operating While Under The Influence. A common characteristic of these traffic violations is that the driver is in physical control of the motor vehicle and shows signs of impairment, as established by sobriety tests. Generally, states enact drunk driving laws that criminalize driving a motor vehicle under the influence of alcohol or any substance that can impair a drivers physical or mental status.

States set measurable physical and chemical criteria for identifying an impaired driver. Generally, drunk driving laws empower law enforcement to conduct field sobriety tests or chemical tests that measure blood alcohol content if an officer deems the driver impaired after a traffic stop. Usually, a BAC above 0.08 is the legal limit. Nevertheless, several states have zero tolerance for drunk driving. Thus, even with a BAC lower than 0.08, law enforcement can still charge a driver with drunk driving if an open alcohol container or a minor is in the motor vehicle.

It is not difficult to search for police records. However, obtaining them can be a little tricky. The fastest way to search police records is to do a quick search on the SpyFly websites search console. It only takes a few minutes to input basic information, then you can get access to tons of public records. You can also try to search police records by:

  • Requesting access from your local police
  • Requesting records from the county recorders office
  • Seeking your county court website

Depending on which agency you request records from, it could take a long time to get any results, and you will most likely have to pay a hefty fee for the records you get.

Did You Receive An Attend Letter

If you receive an “attend” letter after submitting your application, follow instructions.

Individuals are requested to “follow-up” and attend the Customer Service Unit for a variety of reasons. Follow-up requests may be related to:

  • submission of fingerprints to confirm or eliminate a criminal record associated to an applicants information
  • Failure to submit a self-declaration form if you have existing criminal conviction
  • submission of fingerprints for the Vulnerable Sector search to confirm or eliminate a pardon associated to applicants information.
  • A vulnerable sector check is conducted as part of a criminal record check. It is a search of records suspended sexual offences. The vulnerable sector check is national RCMP policy and requires applicants who have a combination of name and/or gender and/or date of birth as a pardoned/suspended sex offender to undergo fingerprinting to verify their identity. The vast majority of those fingerprinted will not have a pardoned/suspended sexual offence however fingerprinting remains a necessity as it eliminates the possibility of an offender changing their name to circumvent a criminal record. This is not an accusation of criminal activity or guilt fingerprints are used to confirm your identity only. Please see the RCMP website for more information.

Criminal conviction records are documents that detail events leading from complaint or arrest to the formal conviction of an individual in a trial court. These records are commonly known as “arrest and conviction records” by most state criminal justice institutions. Court clerks generally maintain physical copies of the criminal conviction records. How To Apply For A Criminal Record Check Online

Before you apply online, make sure the organization requesting the record check will accept an electronic copy of the results. Some organizations may not accept online criminal record checks.

The online criminal record check process is convenient and easy:

  • Set up an account with BackCheck.
  • Choose the type of check you need, either a criminal record check or a vulnerable sector check. Youll have to provide personal information and answer questions relating to your credit history to verify your identity.
  • After a few days, view the results in your account. If you have requested a vulnerable sector check, Halifax Regional Police will email the results directly to you and you can share them with the organization requesting the check.
  • If the organization has a Memorandum of Understanding with BackCheck, you can share the results electronically with the organization requesting the check. Results will not be shared without your consent.
  • Your criminal record check will be completed by Halifax Regional Police.

    Print out the Application to Obtain copy of State Summary Criminal History Record and follow the instructions on the form. A Spanish version of this form is also available .     Once you have received your Record Review response, if you want to challenge the contents of your criminal record, you must complete the “Claim of Alleged Inaccuracy or Incompleteness” , which will be included with your Record Review response if there is criminal information on your record. Your challenge must specifically state the basis for the claim of inaccuracy or incompleteness and include any available proof or corroboration to substantiate your claim.

    Why Do I Need A Record Check

    Acceptable Forms Of Identification

The applicant must produce two pieces of appropriate identification that confirms their name, date of birth and address. One piece of identification presented must include a photo.

    What Happens During A Criminal Case

    Every state adopts a rule of criminal procedure that the criminal justice system follows to establish guilt and punish an offender for a crime. Although the events in criminal cases vary with the case and jurisdiction, a typical case goes thus:

    Initial Appearance: Following an arrest, law enforcement shall bring the suspect before a judge within 24 – 48 hours. The judge shall inform the individual of the charges and assign a court-appointed attorney if the individual does not have a personal attorney.

    • Bond or Bail Hearing: The court conducts a bail or bond hearing for the accused’s conditional and temporary release in exchange for collateral. Generally, most courts will release an accused on bail or bond unless the person committed a serious felony, deemed a flight risk, or threat to society.

    Arraignment: Here, the prosecutor, or the district attorney, files formal charges against the suspect, and the court requires the individual to enter a plea of guilty or not guilty. In some cases, an offender pleads nolo contendere. From here on, the case ends in a plea deal or goes to trial.

    • Plea Deals: The burden of proof is on the prosecution to prove a person is guilty of the criminal charges. However, suppose the evidence or other factors suggest a lengthy case or uncertainty for either party. Then, the prosecution and the defendant may negotiate a plea deal for the accused to plead guilty in exchange for a lighter sentence or some other benefit.

    Customer Service Unit Services By Appointment Only

    In order to minimize wait times at the Customer Service Unit, record check applicants are encouraged to apply online. When applicants select Express Pick-up at the Community Resource Centre, located at 10720 Yonge St., Richmond Hill, police record checks will be available the next business day, excluding weekends and holidays. At all other locations, record checks will be available for pick up in seven to 10 business days.
