A New Lawsuit Could Shake Loose San Diego Info
Last month, the First Amendment Coalition a California nonprofit devoted to free speech and open government sued the San Diego Police Department and demanded more information about its use of cell phone surveillance technology.
The suit claims that SDPD has denied journalists requests for information about how it uses StingRay devices, and asks the court to compel the city and the police to disclose documents containing information about their possession and use of International Mobile Subscriber Identity Catchers.
Potentially, the lawsuit could turn up details about how the technology is assisting cops. According to Inewsource, the First Amendment Coalition learned that the Los Angeles Police Department used these devices 21 times in a four-month period in 2012 to aid in homicide, kidnapping, suicide, rape, human trafficking, robbery, fugitive and narcotic cases.
Court records indicate that no date has been set for legal proceedings in the lawsuit, which was filed on Dec. 15. The city of San Diego challenged the judge assigned to the case, Richard E. L. Strauss, and the Superior Court transferred the case to Judge Judith Hayes.
How Does The Stingray Work
Phones periodically and automatically broadcast their presence to the cell tower that is nearest to them, so that the phone carriers network can provide them with service in that location. They do this even when the phone is not being used to make or receive a call. When a phone communicates with a cell tower, it reveals the unique ID or IMSI number associated with the SIM card in the phone. The IMSI number identifies that phone and its owner as a paying customer of a cell carrier, and that number can be matched by the carrier to the owners name, address, and phone number.
Because a stingray is not really a tower on the carriers network, calls and messages to and from a phone cant go through while the phone is communicating with the stingray. So after the stingray captures the devices IMSI number and location, the stingray releases the phone so that it can connect to a real cell tower. It can do this by broadcasting a message to that phone that effectively tells the phone to find a different tower.

Do Police Need A Warrant For Location Data
For a typical search warrant, police need to convince a judge that they have probable cause to believe that evidence of a crime will be found in the place or item to be searched. To establish probable cause, an officer must typically submit an affidavit based on reliable sources that identify objectively suspicious activities.
In recent investigations, however, law enforcement has relied on a few different statutory authorities that generally require a lower standard of proof than probable cause. For instance, one statute allows law enforcement to obtain a court order directing access to a company’s stored communications when the officer shows a “reasonable basis” to believe the information is “relevant and material to an ongoing criminal investigation.” .)
How To Fight Against Illegal Tracking Of Your Cell Phone In Utah
Many times the police will not go through the proper warrant process before accessing your location information and tracking your phone. They will often try to justify these warrantless searches by claiming exigent circumstances existed when they did not. Other times they might get a warrant based on false information, not follow the proper procedures for obtaining a warrant, or go beyond the scope or the expiration date of a validly issued warrant.
In any of these cases, a skilled search and seizure defense lawyer in Salt Lake City like those at Overson Law, PLLC can fight to exclude any evidence obtained through an illegal search by filing what is known as a motion to suppress evidence. If this motion is granted by the judge, whatever evidence the police compiled as a result of the illegal tracking of your phone cannot be used against you in any future criminal proceedings.

What Is A Stingray
Stingray is the generic name for an electronic surveillance tool that simulates a cell phone tower in order to force mobile phones and other devices to connect to it instead of to a legitimate cell tower. In doing so, the phone or other device reveals information about itself and its user to the operator of the stingray. Other common names for the tool are cell-site simulator and IMSI catcher.
Can Police Track Phone Calls
Most people have never heard of stingray technology, but that does not stop government and police agencies from using it to spy on citizens. Essentially what Stingray refers to is a secretive technology that mimics cellular towers to confuse mobile phones in proximity to the device. What happens is that the mobile phone is tricked to think the stingray device is a legitimate cell tower and therefore connects to the spy device. Once connected to the stingray, police can then track call history, identify who is calling into the mobile device, monitor conversation, pinpoint the location of an individual, and more. Stingray technology essentially takes domestic wiretapping to a whole new advanced and terrifying level of privacy invasion, and that is why everyone should hold some concern.
Two organizations, the ACLU and EFF, have moved forward with legal paperwork stating investigations using stingray technology were essentially illegal. The reason is that authorities using the stingray technology did so without first explaining in detail to the courts how they would use stingray devices. Both organizations feel that the government and police intentionally misled the oversight authority knowing that if the truth was revealed the courts may be apprehensive to greenlight any such activity.
Steering Clear Of Malware
The good thing about malware is that you have to install a malicious app. You can avoid opening SMS attachments, avoid apps from unknown sources, and cast a suspicious eye over your installed app list.
Its absolutely time for a spring cleaning, suggests Gary, Delete all the apps you dont use.
For the apps you decide to keep, Gary recommends checking four things:
If you dont like what you see with these four items, dump it and find a better, less privacy-invasive alternative, says Gary, You may have to buy an app to get one that doesnt use ad networks and have creepware behaviors, but its worth 99 cents to reclaim your identity, isnt it?
Can Police Ping A Cell Phone Without A Warrant
Are you the type of person who believes in conspiracy theories? That the government knew about the JFK assassination or that fluoride is in our water systems to keep people mellow? Well if you are one of those types then you certainly will not like how police can now track your phone using the GPS tracking system embedded in every mobile phone device and how agencies such as the FBI have been routinely tracking people using GPS and other controversial methods such as stingray technology.
Yes, police have the ability to track your mobile phone, locate your exact position and even reconfigure certain characteristics of the mobile phone you use through remote airtime access. Agencies such as the FBI are engaging in this new-age form of spying on people every single day, but the scary part is that they are doing so without a warrant or establishment of probable cause! This has many people darn right pissed because they feel this form of mobile tracking action can essentially be conducted with judicial oversight. And they are correct!

Mpds $15000 Graykey Iphone Unlocking Tool
The documents obtained by Wisconsin Examiner also show MPD purchased a GrayKey iPhone unlocking tool in Sept. 2018. The actual device came in at $15,000, along with an $18,000 contract for licenses. In Oct. 2019, the city renewed its licenses for GrayKey, purchasing three licenses for $54,000.
GrayKey is produced by the American company Grayshift, and is used to break into passcode-protected iPhones. Unlike a CSS, which traces phones from a distance, GrayKey needs to be physically plugged into the phone. This often occurs when phones are taken by police as part of an ongoing investigation.
The cell tower simulator and the cellphone unlocking tool access different forms of phone information, and in different ways. Theyre not both accessing cell data, noted Katz-Lacabe. One of them, a , is basically tracking down the radio communication between your phone and a cell site tower. So that communication means your voice traveling over that, potentially, and your text messages. But its not intercepting, say, your web traffic. Or your traffic from encrypted communication or web browsing. That stuff is still protected by other layers of encryption.
Cbc News Confirms At Least 6 Police Departments Use Imsi Catchers But Several Of Them Won’t Say For What
At least six police forces across Canada are now using cellphone surveillance technology, but several of them won’t say whether they use the devices to eavesdrop on phone calls and text messages.
Calgary police, Ontario Provincial Police and Winnipeg police all confirmed to CBC News they own the devices known as IMSI catchers, cell site simulators or mobile device identifiers joining the RCMP, which has used the technology for its own investigations and to assist Toronto and Vancouver police.
While Ontario and Winnipeg police refused to say whether they use the technology to intercept private communications, Calgary police and the RCMP insist they only deploy their IMSI catchers to identify and occasionally, in the RCMP’s case, track cellular devices.
Police have described the surveillance devices as a “vital tool” used under warrant to help pinpoint suspects, and as a first step toward applying for wiretaps in serious criminal and national security investigations.
But Micheal Vonn, policy director of the B.C. Civil Liberties Association and a legal expert on privacy, says she’s concerned there isn’t a warrant process specific to IMSI catchers that establishes strict limits on how the technology is used given its potential for mass surveillance.

Police Secretly Track Cellphones To Solve Routine Crimes
BALTIMORE The crime itself was ordinary: Someone smashed the back window of a parked car one evening and ran off with a cellphone. What was unusual was how the police hunted the thief.
Detectives did it by secretly using one of the governments most powerful phone surveillance tools capable of intercepting data from hundreds of peoples cellphones at a time to track the phone, and with it their suspect, to the doorway of a public housing complex. They used it to search for a car thief, too. And a woman who made a string of harassing phone calls.
In one case after another, USA TODAY found police in Baltimore and other cities used the phone tracker, commonly known as a stingray, to locate the perpetrators of routine street crimes and frequently concealed that fact from the suspects, their lawyers and even judges. In the process, they quietly transformed a form of surveillance billed as a tool to hunt terrorists and kidnappers into a staple of everyday policing.
The suitcase-size tracking systems, which can cost as much as $400,000, allow the police to pinpoint a phones location within a few yards by posing as a cell tower. In the process, they can intercept information from the phones of nearly everyone else who happens to be nearby, including innocent bystanders. They do not intercept the content of any communications.
Police charged Freeman with misdemeanor theft. Prosecutors dropped the case a month later.
