A New Lawsuit Could Shake Loose San Diego Info

Last month, the First Amendment Coalition a California nonprofit devoted to free speech and open government sued the San Diego Police Department and demanded more information about its use of cell phone surveillance technology.

The suit claims that SDPD has denied journalists requests for information about how it uses StingRay devices, and asks the court to compel the city and the police to disclose documents containing information about their possession and use of International Mobile Subscriber Identity Catchers.

Potentially, the lawsuit could turn up details about how the technology is assisting cops. According to Inewsource, the First Amendment Coalition learned that the Los Angeles Police Department used these devices 21 times in a four-month period in 2012 to aid in homicide, kidnapping, suicide, rape, human trafficking, robbery, fugitive and narcotic cases.

Court records indicate that no date has been set for legal proceedings in the lawsuit, which was filed on Dec. 15. The city of San Diego challenged the judge assigned to the case, Richard E. L. Strauss, and the Superior Court transferred the case to Judge Judith Hayes.

How Does The Stingray Work

Phones periodically and automatically broadcast their presence to the cell tower that is nearest to them, so that the phone carriers network can provide them with service in that location. They do this even when the phone is not being used to make or receive a call. When a phone communicates with a cell tower, it reveals the unique ID or IMSI number associated with the SIM card in the phone. The IMSI number identifies that phone and its owner as a paying customer of a cell carrier, and that number can be matched by the carrier to the owners name, address, and phone number.

Because a stingray is not really a tower on the carriers network, calls and messages to and from a phone cant go through while the phone is communicating with the stingray. So after the stingray captures the devices IMSI number and location, the stingray releases the phone so that it can connect to a real cell tower. It can do this by broadcasting a message to that phone that effectively tells the phone to find a different tower.

    BALTIMORE The crime itself was ordinary: Someone smashed the back window of a parked car one evening and ran off with a cellphone. What was unusual was how the police hunted the thief.

    Detectives did it by secretly using one of the governments most powerful phone surveillance tools capable of intercepting data from hundreds of peoples cellphones at a time to track the phone, and with it their suspect, to the doorway of a public housing complex. They used it to search for a car thief, too. And a woman who made a string of harassing phone calls.

    In one case after another, USA TODAY found police in Baltimore and other cities used the phone tracker, commonly known as a stingray, to locate the perpetrators of routine street crimes and frequently concealed that fact from the suspects, their lawyers and even judges. In the process, they quietly transformed a form of surveillance billed as a tool to hunt terrorists and kidnappers into a staple of everyday policing.

    The suitcase-size tracking systems, which can cost as much as $400,000, allow the police to pinpoint a phones location within a few yards by posing as a cell tower. In the process, they can intercept information from the phones of nearly everyone else who happens to be nearby, including innocent bystanders. They do not intercept the content of any communications.
