Victims of Domestic Violence, Sexual Assault, Stalking, Human Trafficking, or Abuse of an Elder or Dependent Adult

California Family Code § 6228 provides that victims of the alleged crimes, listed above, may receive a copy of their incident report within five days of their request, free of charge. Due to the sensitive information included in the reports, SFPD protocol requires in-person identification verification. Victims or their designated representatives must either submit their request in-person or pick-up their incident report in person at CISU Records Management. For a list of acceptable forms of identification, please refer to Section 2 of the Request for Police Report: Family Code § 6228 form.

Where To Find Police Records

First off, if you are or were a criminal and have a criminal record, you are entitled to a copy of that record thanks to the Freedom of Information Act. As stated earlier, police records are a matter of public record, therefore they are available for free access to the public. The Freedom of Information Act states that any person has the right to request access to federal agency records or information, except for exemptions that are listed. This means that anyone in the U.S. can request basic information that is considered public record, such as voter’s registration, property deeds, or criminal records.

The U.S. system of recording and storing these police records isn’t always the easiest to navigate. Records can have issues crossing state lines, which is why it’s important to find a database that checks all states and compiles the findings. A lot of people say the U.S. should make it easier and have all records in one pool, but that’s just not how things are done.

Police records are recorded in the states where such crimes occur, then are voluntarily submitted to federal databases for access. Not all crimes are recorded and submitted in this manner though, which is what leads to contrary records. With the CheckPeople search we are able to look through all sources of information quickly so you will be able to save a bunch of time on your search.

Requesting A Police Report In Person

1. Gather the required materials.

Bring with you a form of identification like a drivers license or passport. If you are making the request on behalf of someone else, you will need to have a notarized letter with you. Most agencies require a small request fee. If you were directly involved in the incident whether as a victim, witness, or defendant you may receive a verification slip from the authorities to let you know that a police report has been filed. Bring this slip with you to exchange for the police report.

2. Visit the Records and Identification Division of the police department.

The Records and Identification Division may have exclusive hours throughout the day that are not your typical business hours, so be sure to verify online. They will ask you for your information, as well as basic information about the case. Then, they will take your payment to cover the request fee.

3. Retrieve the copy of your police report.

In some areas, you may have to pick up a copy of the police report in person, but some agencies may mail it directly to you. Either way, expect to pay a per-page fee for the copy of the report. Reports typically cost a total of $50 to $150.

What Is A Police Report

People file a police report with law enforcement for a wide variety of reasons such as domestic disputes, traffic accidents, burglaries, and home invasions, fraud, theft, stalking, violence, and many other reasons. To file a report, citizens usually begin by calling 911, or their local police departments non-emergency line, to report the incident.

Once a citizen reports an incident, dispatchers assign it to local officers in the area. The police officers travel to the appropriate location via car, motorcycle, or other police vehicles. Then, the officers evaluate the situation, make observations, interview witnesses, record data, and complete forms and reports required by their local police department.

Police officers also initiate the filing of a report to record the data and gather the details associated with criminal and civil incidents such as car accidents, burglaries, assaults, and robberies, just to name a few.

Officers gather and record a great deal of information and data on a police report. This is to help ensure thorough and accurate investigations and to support criminal proceedings if they become necessary. Also, background verification services may use them in background checks. The information contained in the typical police report may vary from county to county, but most capture very similar information.

    What’s In A Criminal Record

Let’s break it down and get into the nitty gritty of it.

Since criminal records are public, the information is often used to help potential employers. It’s basically a background check to poke around in. Plenty of businesses are required to do a quick background check, and many that aren’t do it anyways. In today’s society, it’s natural to want to know everything we can about a person before we entrust important assets to them.

Criminal records contain a personal criminal history. Generally, this is a list of criminal offenses that have not been expunged such as traffic tickets, DUIs, or convicted crimes like misdemeanors or felonies. Our search will provide you with this information and more.

Sometimes warrants for the persons arrest will also show up on a police record, depending on where the warrant is from.

Are Police Reports Admissible In Court

How to access local police reports relating to myself

While police reports are commonly used in car insurance settlement negotiations, admitting a police report as evidence when you file a car accident lawsuit is not quite as clear cut.

In small claims courts, litigants are usually permitted to use police reports as evidence in their car accident case. You will not be expected to know all the rules of evidence, so judges typically will allow plaintiffs and defendants to use the police report in explaining what happened.

If your car accident case goes to trial in your state’s court of general jurisdiction , you should know that parties in these cases are held to the rules of evidence and must contend with whether the police report falls within the rule against “hearsay” evidence, which keeps out many out-of-court statementsby definition, any assertion made in a police report is a statement that was made out of court.

In some jurisdictions, the police report may fall within the “public records” or “business records” exception for admissibility. In other jurisdictions, different exceptions to the hearsay rule may apply and allow you to admit some or all of the police report as evidence.

How To Get A Police Report

By law, certain police records and violation reports prepared and maintained by the Police Department are accessible to the general public.

If you need to get a copy of a police report, do this. First, begin by researching the requirements of the police department responsible for the jurisdiction in which the incident occurred. Then, follow the departments exact protocol for requesting and receiving those records. Start by checking the police departments website. Expand your search to the city website if you dont find anything on the police departments website.

Obtain and Fill Out Request Forms

Some departments may require that you complete a request form, sometimes called a request for public records. This may also be known as a request for open records. When you check the department website, look to see if you can download the request form from their site. If so, fill out the request form and submit it according to the directions.

Most request forms will require you to provide the first and last name of at least one of the involved parties. In addition, youll need the location, date, and time of the incident, and in some cases, the incident or case number.

    • Only crimes that have no suspects, are not in progress and do not involve injury can be reported online.

    • Among others, online reporting is NOT appropriate for the following crimes or incidents:
    • Incidents occurring within past 30 minutes
    • Violent crimes, completed or attempted
    • Sex crimes

Looking up a police report thats months or even decades old typically requires the same protocol as looking up recent reports. If you didn’t get a police report or incident number at the site of your incident, it can make it difficult to check status, specially if you are trying to do this online. A station clerk or officer may be able to locate the status of your report with the date/time and location of the incident. Not having your report or incident number can also delay receipt of your report when requesting a copy. Sometimes police reports are delayed because the officer has yet to process the paperwork, or there is a mistake with the paperwork that must be corrected before generating a report.
