Is A Las Vegas Police Report Admissible In Court

No, a Las Vegas police report is not admissible in court. Neither party can admit the contents of the police report as evidence in a case. The rule barring admission of the police report as evidence applies in both criminal and civil cases. The only exception is that you can submit proof of whether or not the police report was filed. But the content of the report itself is inadmissible. Thats because the police report contains hearsay. It includes statements that are made outside of court. When you file your police report, you can rest assured that it cant be used as evidence against you in a criminal or civil proceeding.

When Do You Have To Report An Auto Accident In Las Vegas Nevada

Nevada has two laws that relate to when you must report an accident:NRS 484E.050 requires that a driver involved in a crash with any other vehicle give immediate notice to the nearest police officer or highway patrol. This means you should pick up the phone and call the police. If you are too badly injured but someone else in your car can call, then they should call.NRS 484E.070 requires that drivers file a Traffic Crash Report if an officer did not come out to the scene and the accident resulted in bodily injury/death or at least $750 in damage. You have 10 days from the date of the accident to file this report.

Sometimes, the police do not come out and investigate, especially if they believe that the accident is minor or if it happened in a parking lot and no one was badly injured. Some fender benders and minor bumps or scrapes are not investigated. Nevertheless, the law puts the burden on drivers to report the accident anyway if there has been more than minimal damage.

Not sure what the point is in comparing this to shooting massacres?

    Edited: 3 years ago

No offense, the police don’t care. They have bigger things to worry about.

Even if they do find this person, which they probably won’t, what are they going to do? He has probably no money and most likely has been in and out of jail so he doesn’t care.

The US, specifically big cities are a infested with crime and especially bums. It isn’t like Auckland. Police here are more jaded frankly.

I would report it to the bus authority rather than the police – what was the driver doing whilst this was going on.

I wouldn’t bother, as the guy won’t get any jail time *if* he’s even prosecuted at all. It will eat a lot of your vacation time to make the report, and nothing is likely to come of it.

The video surveillance wouldn’t show much that the police can act on, it sounds like. Even though the black market sale of narcotics IS illegal , there’s nothing other than your word to substantiate that…

Sorry that happened to you, but don’t burn up valuable vacation time for what is going to end up being an exercise in frustration.

    All imho, of course.

“Not sure what the point is in comparing this to shooting massacres?”

    Cheers

Using The Police Report In Settlement Negotiations And At Trial

Las Vegas police report increase in ‘skimming’ of credit, debit card information

If you are seeking compensation from an insurance company or the other driver to cover medical expenses and damage to your vehicle following a car accident in Las Vegas, the police report will give you leverage to negotiate with. Police reports will include a description of how the accident occurred based on witness statements and accident reconstruction by the investigating officer. That information will be particularly useful if you are attempting to prove that the accident was the fault of the other driver. The report may also include a description of injuries, medical attention received right after the accident as well as the property damage sustained.

Under the hearsay rule in Nevada, police reports are generally inadmissible at trial or arbitration unless the parties agree to admit it into evidence. Similarly, a police officers conclusions regarding fault or citations issued are not allowed in court because it is the function of the jury to decide who and what caused an accident. See Frias v. Valle, 698 P.2d 875, 876, 101 Nev. 219, 221 .

However, the facts surrounding the accident, such as witness statements, measurements, damages and road conditions may all be admitted into evidence so long as independently testified to at trial by someone with personal knowledge of those facts or by a qualified custodian as an exception to the hearsay rule. See NRS 51.135 Miranda v. State, 707 P.2d 1121, 101 Nev. 562 .
