What Will Happen To The Abuser
If the abuser is arrested, he/she will be held in jail until the “first appearance” before a judge. After first appearance, the person can be released until the next hearing. At that next hearing, a temporary injunction can be filed before the abuser is released. This temporary injunction will be active until the final hearing. If the abuser is found to be guilty of domestic violence, he/she will be held on at least one year’s probation and, unless deemed inappropriate by the court, will take part in a batterer’s intervention program that will be a part of probation .
In addition to probation and batterer’s intervention programming, the abuser can be sentenced to a minimum of five days in a county jail if found guilty of intentionally causing bodily harm to another person. If your abuser has a history of domestic abuse, he/she may face a felony charge with up to five years in prison . If this is the case, the abuser will no longer be able to own a firearm and will have any concealed weapon license revoked. If the abuser is convicted of a more severe charge, such as Aggravated Domestic Battery, he/she could face up to 15 years in a state prison .
When Friends Or Family Members Are Being Abused:
- Ask if theyre safe or need someone to talk to.
- Explain that free, confidential help is available help for victims and their children at local domestic violence programs
- Offer a ride to a local shelter, a place to make a phone call or to baby-sit while they attend appointments.

Every report of abuse received is reviewed by a complaints officer who decides if an investigation is necessary. They will confirm that:
- the client involved in the report of abuse is an adult,
- the client was receiving care or support services from a service provider at the time of the alleged incident
- the allegation of abuse involved an act or omission that caused serious emotional harm, serious bodily harm, involved sexual abuse, or financial abuse
- the complainant has reasonable grounds that abuse occurred
- the complainant has provided their name and contact information
The complaints officer determines if an investigation is necessary or may decide to conduct an inquiry, discontinue the review of a report of abuse or refer to another body. If the report of abuse is discontinued or referred, the complaints officer must let the person who made the complaint know of the reasons for the decision in writing.
If the person who made the complaint does not agree with the complaints officers decision to discontinue the review of the report of abuse, they can apply to have the PPC director review the complaints officer decision.

Domestic violence has been found to constitute the single largest category of police calls in some cities. When police officers respond, they know the situation can be volatile for both them and the abusers victim. Thats because the killer in almost one third of female homicides is an intimate partner, and 22 percent of officer line of duty deaths in recent years occurred while responding to domestic violence calls.
What the stats dont really capture is all the law enforcement officers that are killed in the line of duty on traffic stops, serving protection orders or serving warrants , says Michael P. LaRiviere, a police officer who does domestic violence training for national organizations, including the National Sheriffs Association.
Ive seen a connection between offenders who murder police officers and a record of domestic violence, LaRiviere says. Theyre dangerous people. Theyre about power and control, and law enforcement officers represent the authority to take away their freedoms.
This explosive combination has led 95 percent of law enforcement agencies to develop policies that officers are asked to follow when responding to domestic violence calls, and 85 percent also require officers to participate in specialized domestic violence training. Nearly half of the departments now have separate units devoted to domestic violence cases.

If your report is not sent to a local APS field office for investigation, then the information you provided did not meet the criteria for an APS investigation according to Arizona Revised Statutes however, your concern will be documented in the APS database system.

- APS works closely with law enforcement and if a determination is made that the mistreatment rises to the level of a crime, the alleged perpetrator could be arrested. Those decisions are not made by APS, but law enforcement.

How Do I File
Be prepared with as much factual information as possible and include as much of the following as possible.
- Name, date of birth , race, and gender, for all adults and children involved.
- Addresses or another means to locate the subjects of the report, including current location.
- Information regarding disabilities and/or limitations of the victims .
- Relationship of the alleged perpetrator to the child or adult victim.
- Other relevant information that would expedite an investigation, such as directions to the victim and potential risks to the investigator, should be given to the Abuse Hotline Counselor.
- Stick to only what is factually known and what you personally have observed.
- Avoid telling the person taking the report what you think should be done or offering opinions regarding the people involved in the report.
