Can The System Make Mistakes

Definitely, no system is flawless. Sometimes the optical character recognition will guess wrong. If it cant decide which letter is on a plate, it will search the database for hits on both options. So it is entirely possible to be pulled over mistakenly based on a hit from the license plate scanner.

Should Michigan Police Randomly Scan License Plates For Auto Insurance Verification

News that police throughout Michigan can now run license plates to determine if vehicles are insured has garnered some strong reactions from MLive readers.

Since the fall of 2014, police have been able to run a license plate through their Law Enforcement Information Network system and determine if the driver has purchased insurance. However, a search through LEIN does not provide real-time information, as insurance companies are only submitting reports to the Secretary of State on the 1st and 15th of each month.

“It’s kind of a first step,” Michigan State Police spokeswoman Shanon Banner has said. “It helps in the investigative process. If someone says they have insurance, they could have applied for it in the last 15 days. It’s very likely to return a ‘no’ and in fact they have insurance.”

Thus, the state police is not using the information as the primary impetus for a traffic stop, Banner said.

“We’re not making that a primary stop,” added Bay County Undersheriff Troy Cunningham on his agency’s approach to the issue. “You can, but that’s not what the deputies are doing. They’re looking for a more serious violation. At this point, we’re not making this a reason for a primary stop.”

Reactions from readers ran the gamut from approval to disdain.

Why Is It Illegal To Drive Without Car Insurance

Federal law requires drivers to have car insurance to ensure that the interests of pedestrians and other motorists are protected if an accident occurs. The cost of a car crash can be quite devastating, and if you dont have car insurance, you and the other parties involved can be ruined financially. If you are at fault in an accident and have insurance, your insurance provider will cover the claims of the person you hit. Now, if you dont have valid car insurance, youll have to pay for the other persons hospital bills, car repairs, and other losses from your pocket. What happens if you fail to do that? Simple, you run the risk of getting sued. This is on top of the payments for injuries you have sustained and the repairs on your car. To avoid all these issues, make sure you have valid car insurance.

Can Police Randomly Run Your License Plate

by Rachelle | Nov 18, 2022 | Law Enforcement

Can police randomly run your license plate? This has been a question that has been asked by many people. The simple answer is no, but there are a few exceptions. Lets take a look at what the police can and cannot do when it comes to your license plate. The police cannot randomly run your license plate for no reason. They need to have a reasonable suspicion that you have committed a crime or are about to commit a crime. For example, if they see you speeding, they may pull you over and run your plate to see if your car is stolen. However, there are a few exceptions to this rule. The police can run your plate if they are investigating a crime that has already been committed. They can also run your plate if they have been given permission by a judge. So, in summary, the police cannot randomly run your license plate. There are a few exceptions to this rule, but for the most part, the police need to have a good reason to run your plate.

When can you pull over for a traffic stop? Despite the fact that your plates may not be on the list, the police have the authority to run them whenever they see fit. As a result, if the police find something suspicious, they can pull you over.

Should you conduct a routine criminal background check by your police officer without any reasonable suspicion? Officers do not need probable cause or reasonable suspicion to dispatch a license check or conduct a computerized check.

Though police can tell if you have insurance by running your plates, the Michigan Vehicle Code does not address this issue. The Michigan State Police has stated the information will not be used as a primary basis for a vehicle stop, but each police department may have its own policy. The Michigan Court of Appeals has upheld a stop for no insurance based on a LEIN check.

In its published opinion in People v. Mazzie , the Michigan Court of Appeals ruled that the police could make a traffic stop based on LEIN information showing that a vehicle in question was not insured as required by Michigan law. The judges stated:

The LEIN information gave the police at least a reasonable suspicion that defendant was operating his vehicle without insurance and, therefore, the stop and detention to check for valid insurance was reasonable under the Fourth Amendment.

However, most police now have electronic access to insurance records that make fake cards a thing of the past. With electronic verification systems, police can see your insurance status as soon as they scan your license plate. That means theyll know if your proof of insurance is fake.

In addition to learning whether a driver has provided them with false information, police can also use this technology to identify drivers whove purchased policies from fake insurance providers.

In the UK police can tell if a car does not have valid car insurance by using automatic number plate recognition technology.

A network of closed circuit television cameras and cameras mounted in police vehicles captures images of number plates and use optical character recognition to determine the registration of cars using UK roads. If a vehicle is spotted which DVLA and insurance industry records indicate is unregistered, or does not have a valid MOT or valid insurance cover, police can, under UK motoring law, stop the vehicle to investigate.

A series of algorithms is used by the technology to help number plate identification.

  • Plate localisation finds and isolates the number plate in order to capture an image
  • Plate orientation and sizing compensates for any skewing of the plate in the image and adjusts relative dimensions
  • Character segmentation locates each character on the number plate
  • Optical character recognition identifies each character
  • Syntactical/Geometrical analysis character checking and positioning in sequence in relation to country-specific rules and norms.

Once the number plate image has been captured, and analysed against various databases including police records, a readout is sent to the police officers so that any necessary action can be taken.

Penalties For Driving Without Insurance

Driving without insurance is illegal in all states. Some states do not technically require auto insurance , although these states still require proof of some type of insurance like a surety bond.

If you are caught driving without insurance, then you may pay a fine for your first conviction. Most states charge a fine of $500 to $1,000 for the first offense, although some states charge as much as $5,000 even for the first offense. You might also have to pay the DMV hundreds of dollars in reinstatement fees.

You might also face higher insurance premiums in the future. If you are caught driving without insurance, then your insurer will consider you a high-risk driver. If you try to buy a policy, then you might pay significantly higher rates than a low-risk driver. You have a history of driving without insurance, and that means youre considered a higher risk.

Obviously, theres another cost of driving without insurance: you might have to pay accident costs out of pocket. If you cause an accident as an uninsured driver, then you still have to pay for any medical bills and vehicle damage. Typically, car insurance would cover these costs. As an uninsured driver, you must cover these costs yourself. That could mean paying thousands or hundreds of thousands of dollars to the other driver after an at-fault accident.

For all of these reasons, driving without insurance is rarely worth it.

Automatic License Plate Recognition Scanning Systems

Automatic License Plate Recognition scanning systems are one of the newest technologies in the hands of law enforcement. The system consists of several cameras mounted on a police cruiser, hooked up to a computer inside the vehicle. The number and letter images on license plates are scanned and matched with an on-board, real-time database. This database can be set with flags for vehicles that have been identified or tagged for any reason, including:

  • Stolen Vehicles
  • Expired Insurance
  • Wanted as Persons of Interest for any investigation

Any time one of these alerts is triggered, the officer in the vehicle is immediately alerted to your presence, and for what reason your car has been flagged.

The system can also be matched with the owner of the vehicle via a DMV database. So if you are the owner of a car and have a

  • Outstanding Municipal Taxes or other Fines and Fees
  • Are Wanted for any other police or government purpose

you can find yourself stopped by the police in a heartbeat, just for driving down the street, and not committing any traffic violation.
