So, youve been arrested covering an event. Youre taken to the police station, youre booked, and your phone is confiscated. When youre let out, after a few hours or even a few days, your phone is handed back to you in a plastic baggie the SIM card and SD card taped to the back. Someone has definitely gone through your digital belongings.
What Does It Mean
Your digital belongings – phone, SIM, SD card data could have been copied and gone through.
Your phone may have been turned on, apps and browsers opened. The cops might have access to any accounts your phone was logged into, this means they may have read personal communication, noted your personal accounts including email addresses, social media account names to follow, sent messages or made posts using your log in.
The SIM card contains a lot of personally identifying information that ties the phone to its user. It can also contain contact lists as a series of pairs of name and phone number. This means that if your SIM card is searched, it’s possible that the police will now identify and target the people you have in your address book. Police track the location of individuals through the location of their mobile phone and SIM card, your unique phone and SIM combination may now be used to locate you.
The SD card contains photos and other media could contain chat logs, and other user-generated content. Not only can this data be used to build a profile on you, but can be used to map social connections between people you frequently communicate with, and they can unjustly become “persons of interest” to investigators. Such tactics can also be used, sometimes under the flimsiest of pretexts, to justify warrants for escalated surveillance on you in the near future.

Usually, when a phone is missing or stolen, it gets turned off or runs out of battery. You can track its last known location, but you must be fast. The trick is to track the last known location before it is too late. The iPhones last known location will be available for just one day. Is that an indication that smartphones are not really off even after the phone shuts down?

This new ruling creates a procedure to help keep police accountable to the search regulations. They must keep a careful record of what is searched, which will generally include the applications searched, the extent of the search, the time of the search, its purpose and its duration.

Police Use Cell Phone Location Information Obtained Without A Warrant As Evidence
Cell phones operate by continually connecting to radio antennas known as cell sites. Each time a phone connects to a new cell site, it creates a time-stamped record known as cell site location information . Wireless companies retain this information for business purposes. In Carpenter v. United States, the FBI and prosecutors sought to use CSLI to establish the whereabouts of criminal defendants around the time of several alleged robberies.
As part of their investigation, the FBI identified the cell phone numbers of the defendants. The government prosecutors then sought and received court orders to obtain the phone records of the defendants. The orders were granted under a federal law which allows police to track data, like cellphone information, with a court order based on facts granting reasonable grounds to believe the records are relevant and material to an ongoing investigation. This is a lower standard than the probable cause necessary to obtain a search warrant, which requires a reasonable belief that the evidence will lead to the confirmation of the commission of a crime.

What Do The Conditions Mean For Police
It means the police can and likely will search your cellphone if they believe searching its contents may be relevant to why you were arrested. It means they can search your cellphone, but they have to follow certain rules. If you were arrested, and your phone is unlocked or is not protected with a password, it would not be unreasonable for police to flip through the pictures or text messages inside if they believe doing so forms part of their investigation.

3. Call your insurance within 48 hours to make a claim and tell them your details plus the crime reference number.
What happens now?
Lock Your Iphone And Delete Its Data
The first thing you need to do is protect your personal information. If you have a passcode set on your iPhone, you’re pretty safe. But if you don’t, or want extra security, use Find My iPhone to lock your phone and add a passcode. That step will at least prevent the thief from using your phone.
If you can’t get the iPhone back or it has sensitive information on it, delete the phone’s data remotely. Deleting data may not prevent the thief from using your iPhone, but at least he won’t have access to your personal data after that.
