How To Obtain the Police Report After A Car Accident – Spaulding Injury Law

The following are types of data and information that may be included in a police report. Please note that there is no universal police report. Information will vary from department to department.

  • Identifying information for all parties involved in the incident, including full name, address, phone number, date of birth, social security numbers, driver license numbers
  • Date of the occurrence or incident
  • Location of the occurrence or incident
  • The officers name and ID number
  • The names of other officers who were present
  • Diagrams or drawings of the scene
  • The names of witnesses and their statements
  • Reference number

The law enforcement case file may also contain motor vehicle information, as well as specific details of the incident and any evidence associated with the case.

Examples of police reports may include but are not limited to domestic disputes, traffic accidents, thefts, fraud, assault, burglaries, and stalking incidents. Other information that may be available includes crime surveys, crime statistics, calls for service, weather information, and traffic accident surveys.

Complying With Emergency Orders

Under the Emergency Management and Civil Protection Act , there are consequences for businesses and individuals who choose to defy the Act while emergency orders are in force. The OPP encourages everyone to voluntarily comply with all of these short-term restrictions.

If your incident:

  • Requires IMMEDIATE police attendance or a lengthy on-scene investigation
  • Is related to Domestic Violence
  • Involves an Emotionally Disturbed Person
  • Involves the reporting of Theft of E-Bike
  • Is motivated by hate bias

In order for the Toronto Police Service to process your CORE report, the following information is MANDATORY

  • Your EMAIL ADDRESS, PHONE NUMBER and other contact information.
  • The INCIDENT START AND END DATE
  • The LOCATION of the incident, including the place or area your property was believed stolen.
  • Please CREATE A SEPARATE PROPERTY ENTRY for EACH piece of property that you are reporting stolen.

The accuracy of the information you provide in the report greatly assists the Toronto Police Service in investigating your report. Please ensure it is as COMPLETE AND CONCISE as possible.

If you have filed a report online and would like to add/change/update your report, please submit a Supplemental Report.

It is the policy of the Toronto Police Service to not accept reports of non-emergency incidents that occur outside of the City of Toronto.

When To Request A Police Report Or Case Number

Most often, insurance companies, banks, phone companies, and other organizations do not require you to provide a physical copy of a crime report. Instead the case number or the CAD information will meet the requirement for documentation. For Family Court domestic-related issues when the judge is requesting proof of a police call for service, most often, the CAD information will suffice. CAD information can be available in less time than the release of the police report.

You can obtain your case number by calling the Records department, Monday – Friday 8 a.m. to 5 p.m. at 943-5890 or Dispatch after hours at 943-5844.

Requesting A Police Report By Mail

REQUEST TO OBTAIN COPIES OF STATE POLICE REPORTS &  PHOTOGRAPHS

The process of requesting a copy of a police report by mail is a bit more involved. In many jurisdictions, you are required to make your Public Access Request via mail. Typically, the agency will provide a form online for you to fill out, but some places are fine with you writing a letter to ask for the police report.

1. Figure out where to send the Public Access Request form or letter.

Your local police department may have a specific address and addressee for police report requests listed on their website. If they dont, simply address it to the Records and Identification Division, and use the general address listed online for the department.

2. Fill out the form or write the letter.

After you have found the location to send your request, you should be able to easily find out if they want you to send a request form or a letter. If the information is not readily available on the site, just call and ask which method they prefer. If it is available, filling out a request form is typically the easiest method because you wont have to worry about leaving out information.

If you write a letter instead of filling out the form, be sure to include the following information:

  • Case number
  • Your Name, Birthdate, and Address
  • The date and location of the incident
  • Your role in the case
  • The officers name who filed the report
  • What exactly you are requesting

3. Gather additional materials and send the form/letter.

Why Am I Not Able To Obtain A Police Report

The most common reason why people cannot get a copy of a police report is because of an ongoing investigation. Once the case is closed, you should be able to obtain a copy.

If you believe you have been unfairly denied access to a police report, you may wish to have a lawyer speak to the authorities on your behalf. Juvenile records may sometimes be sealed or withheld to protect the privacy of the victim. Generally, though, the process to obtain a police report is relatively simple, depending upon who is trying to obtain the report.

Access Accident Reports You Already Purchased Online

You will have 7 calendar days to access reports you already purchased online. After 7 days, you will need to purchase the reports again.

  • 2. Certified accident report copies include an attestation and signature of the Commissioner of Motor Vehicles.

    Facts Versus Opinions In Police Reports

    The information contained in the police report can be a fact or an opinion. For example, the date, time, and location of the collision are facts. Fault determinations are the opinions of the police officer.

    Regardless of what’s included in the police report, the insurance company, through its own investigation, will come to its own conclusion as to who was at fault for the accident.

    How To Request Records Contained In A Major Collision File

    Major Collision Bureau investigates all Motor Vehicle Collisions resulting in a fatality or serious personal injury that occur in the Region of Peel.

  • Company letter or personal/company email requesting the records, including date, time, location, occurrence number, officer in charge of the collision. How you are involved or your relationship to the involved party.
  • Clients signed consent or two copies of your government issued identification and your contact information.
  • Our office will advise you in writing regarding the status of the case or any known court dates.
  • If you are NOTthe Involved Party to the Collision

    You must provide proof of relationship to the involved party and a signed consent on behalf of the involved individual.

    If the Involved Individual is Deceased

    You are required to provide an authorization from the legal representative or power of attorney with supporting documents.

    Request A Police Incident Report Copy

    Effective Tuesday, July 6, 2021, SFPD Police Headquarters at 1245 Third Street will reopen to the public after a temporary closure due to the COVID pandemic.

    You may request a police incident report in person at SFPD Police Headquarters during our normal business hours of 8 am-5 pm, Monday – Friday .

    The SFPD Crime Information Services Unit is responsible for processing incident report requests from the public, law enforcement agencies and other authorized organizations. The unit also processes local criminal background checks for agencies entitled to that information under the law. For all other requests that are not incident reports or local background checks, please contact the appropriate department within SFPD.

    The online civilian incident system allows you to submit a report to the police immediately and print a draft copy of the police report for free. You will be required to create an online account to file your first report. Keep your login and password for future use. Please note: It is a crime to make a false police report.

    Please confirm the following to find out if the Online Citizen Police Report is right for you:

    • This is not an emergency

    Most accident reports written by the Walnut Creek Police Department can be obtained online. However some may not. Reasons an accident report may not be available online are:

    • The accident did not occur in the jurisdiction of the Walnut Creek Police Department.
    • There were serious injuries and/or a fatality as a result of the accident.
    • There was a crime associated with the accident report.
    • The report is not complete.
    • The report cannot be released by applicable laws.

    Reports are typically available within 5 to 10 days. If the report is not available online after 10 days, please contact the Walnut Creek Police Records Division at 925-943-5890.

    Cost of an online accident report is $5.00, which is paid directly to Lexis Nexis.

    The Walnut Creek Police Department reserves the right to restrict the availability of online accident reports.

    Why Do I Need A Record Check

    A police record check is a tool to help employers or other agencies determine an applicant’s suitability for certain types of opportunities. Record checks are just one tool available and can be used in addition to interviews, reference checks and verification of credentials/licences.

    Agencies can only request one type of record check from an applicant specific to the opportunity. They are not permitted to ask applicants for any additional police records.

    How To Access Your Police
