Accessing Your Own Criminal Record

New Order Gives More Document Access In Alleged Police Misconduct Cases In Chicago

You have the right to access your own criminal record. You can request a copy from the RCMP or your local police under thePrivacy Act of Canada. Criminal record checks are completed by municipal police and local RCMP detachments.

If you find inaccuracies or errors in your criminal record, you can request that corrections be made under the Privacy Act. Make your request to your local police station.

How To Order And Access Motor Vehicle Accident Reports

DMV keeps accident reports for 4 years from the date of an accident, except for rare cases. 1

You can order a certified accident report online. 2

You will need to pay a search fee . 3 To order reports you will need to pay an additional $15 fee .

You can search, purchase, and immediately download certified accident reports online.

You must pay both a

  • $7.00 search fee, and
  • $15.00 report fee for each report 4

Please note: you must complete Step 1 of the online transaction before you will be able to perform a free or paid search.

First: Do a Free limited search to see if the DMV has your report

To see if your report is available in our system use ‘List Reports on File by Date’ to see a list of accidents by the county and date you select . The list of accidents will include the plate numbers of the vehicles involved in the accident.

If there are reports you want, you will need to do a paid search before you can order them.

Second: Do a ‘Paid’ search

To search for your report use ‘Search by Plate Number, License Number, or DMV Accident Case Number’ .

You will be charged a fee even if

  • you enter the incorrect information, or
  • if the report are not found

Each search costs $7.

To order reports, you will need one of the following

  • the plate number of a vehicle involved in the crash/accident, and/or
  • the driver license number of a person who was involved in the accident, and/or
  • the 8-digit DMV case number .

What Happens During A Criminal Case

Every state adopts a rule of criminal procedure that the criminal justice system follows to establish guilt and punish an offender for a crime. Although the events in criminal cases vary with the case and jurisdiction, a typical case goes thus:

Initial Appearance: Following an arrest, law enforcement shall bring the suspect before a judge within 24 – 48 hours. The judge shall inform the individual of the charges and assign a court-appointed attorney if the individual does not have a personal attorney.

  • Bond or Bail Hearing: The court conducts a bail or bond hearing for the accused’s conditional and temporary release in exchange for collateral. Generally, most courts will release an accused on bail or bond unless the person committed a serious felony, deemed a flight risk, or threat to society.

Arraignment: Here, the prosecutor, or the district attorney, files formal charges against the suspect, and the court requires the individual to enter a plea of guilty or not guilty. In some cases, an offender pleads nolo contendere. From here on, the case ends in a plea deal or goes to trial.

  • Plea Deals: The burden of proof is on the prosecution to prove a person is guilty of the criminal charges. However, suppose the evidence or other factors suggest a lengthy case or uncertainty for either party. Then, the prosecution and the defendant may negotiate a plea deal for the accused to plead guilty in exchange for a lighter sentence or some other benefit.

Facts Versus Opinions In Police Reports

The information contained in the police report can be a fact or an opinion. For example, the date, time, and location of the collision are facts. Fault determinations are the opinions of the police officer.

Regardless of whats included in the police report, the insurance company, through its own investigation, will come to its own conclusion as to who was at fault for the accident.

Vi Retention Maintenance And Disclosure Of Records

Standard 25-6.1. Retention and maintenance

Protected records lawfully obtained from an institutional third party in the course of law enforcement investigation should be:

reasonably secure from unauthorized access and

other than as authorized under Standard 25-6.2, accessed only by personnel who are involved in the investigation for which they were obtained and only to the extent necessary to carry out that investigation.

Moderately and highly protected records should in addition be:

subject to audit logs recording all attempted and successful access and

destroyed according to an established schedule.

All de-identified records in the possession of law enforcement for which the linkage described in Standard 5.5 is not obtained should be destroyed upon conclusion of the investigation and any prosecution and appeals.

If a law enforcement agency disseminates internal regulations pursuant to this Standard, those regulations should be publicly distributed.

Standard 25-6.2. Disclosure and dissemination

Law enforcement should not disclose protected records to individuals and entities not involved in the investigation for which they were obtained except in the following circumstances:

Disclosure in the case or cases investigated, pursuant to rules governing investigation, discovery and trial

Disclosure of identification records of wanted or dangerous persons and stolen items upon the request of a law enforcement officer or prosecutor and

No cameras or video recording devices may be used in the courtroom without the approval of the presiding judicial official . Photographing of any person in attendance at the courthouse is also prohibited.

How Is Use Of The Pnc Regulated

Strict rules and regulations are imposed on the use of the PNC due to the confidential and often sensitive nature of its contents.

If an organisation wants to apply for access, it must submit a detailed proposal outlining its requirements to the PNC Information Access Panel . Users must complete a series of e-learning modules and take at least a five-day training course on how to view data and conduct basic queries. Further training is required in order to gain greater levels of access and carry out more sophisticated queries.

There are rules on how information obtained through the PNC can be shared. For example, it cannot be distributed by email.

Requesting A Police Report By Mail

The process of requesting a copy of a police report by mail is a bit more involved. In many jurisdictions, you are required to make your Public Access Request via mail. Typically, the agency will provide a form online for you to fill out, but some places are fine with you writing a letter to ask for the police report.

1. Figure out where to send the Public Access Request form or letter.

Your local police department may have a specific address and addressee for police report requests listed on their website. If they dont, simply address it to the Records and Identification Division, and use the general address listed online for the department.

2. Fill out the form or write the letter.

After you have found the location to send your request, you should be able to easily find out if they want you to send a request form or a letter. If the information is not readily available on the site, just call and ask which method they prefer. If it is available, filling out a request form is typically the easiest method because you wont have to worry about leaving out information.

If you write a letter instead of filling out the form, be sure to include the following information:

  • Your Name, Birthdate, and Address
  • The date and location of the incident
  • Your role in the case
  • The officers name who filed the report
  • What exactly you are requesting

3. Gather additional materials and send the form/letter.

How Do I Obtain Police Records Online

Obtaining police records online is much easier than it used to be. However, it can still be a bit of a challenge if you dont know where to look. The fastest way to find police records online is to do a search on SpyFly using their secure search platform. Other than that, you can try to find police records by:

  • Visiting the local police website
  • Searching the county Sheriff website
  • Searching the County Court website

Some websites will have you fill out a registration and pay a fee in order to have access to their records.

How Long Does It Take To Get A Police Report

You have to wait 45 days from the date of the collision before you can make a request for a traffic collision report. This is so that LAPD can review and approve the report for release.2

Per the LAPDs website, once you make a request, there is currently a minimum of two months for LAPD to process the report request.3

Are Police Reports Public Records

Many types of police records are exempt from public disclosure and are not public records. There are two main reasons why they arent publicly available. First, disclosing the information could undermine an ongoing investigation. Second, it could jeopardize someones privacy and safety. In some cases, departments will release specific information related to the report, such as to a reporter doing a story. However, they rarely release a full copy.

  • The incident may not involve one of the four crime types Burglaries, Robberies, Aggravated Assaults, and Homicides being posted online.

  • Not all incidents will result in a Seattle Police Report being filed. For example, the incident may involve a location that cannot be found or verified.

    Do I Have To Give A Reason Why I Want These Records

    You arent required to explain why you are making a request. However, if you are asking for the address of someone who has been arrested, or the current address of the crime victim, you must state whether the request is made for a journalistic, scholarly, political, or governmental purpose, and declare that the information will not be used to sell a product or service. You probably wont get that information anyway because of privacy rights.

    How Do I Obtain Criminal Records

    Interested persons who wish to look up criminal records have two options. The first is submitting an official request to the record custodian. Most record custodians have record request protocols that allow public requesters to make in-person visits, send mail requests, or conduct an online search for the criminal records of interest. Of these three means, online search is the fastest. However, in-person and mail requests for criminal records are characteristically slow. The other alternative is to use independent, third-party search services for on-demand access to criminal records. Free public criminal record checks are possible too. Records of other types of police misconduct are still secret. Also, while you can access the records of investigation for serious uses of force regardless of whether the agency found that the use of force was wrong, for allegations of sexual assault and job-related dishonesty, you can only access those records if the agency determined that the officer was guilty of misconduct in violation of policy, and the time to appeal that determination has passed.4

    In addition, the agency has the right to redact or withhold certain confidential information, like the names of witnesses, or the home address of the officer involved.5

    The Records Unit is staffed by a clerk and supervised by a police administrator.     How To Access Your Police
