How Do You Prove That The Police Report Was False

Sacramento Police officer arrested, accused of filing false report

The prosecution will need to prove that the person who filed the false police report meets the specific elements of the crime of filing a false police report. These specific elements of the crime can vary from state to state and are subject to the laws of each jurisdiction.

In general, a person can assume that they will be convicted if the prosecution is successful in proving that they knowingly or deliberately made a false police report in response to a legitimate criminal inquiry. Additionally, the prosecution will seek to prove that in making a false police report, those actions deceived the police and/or hindered a criminal investigation.

It is important to note that the most important element of this crime is the intent when making the statement to the law enforcement officer. An example of this would be if the police respond to a call from a person claiming that their spouse hit them, when the spouse did not. The person who made the false claim may be charged with making a false report to the police, and could confirm their intent to lie to the police by filing a false report about the alleged abusive incident.

Dem Candidate Used Fake Name To Stoke Division During 2020 Unrest: Report

Former Las Cruces, New Mexico, City Councilman Gabe Vasquez is running for U.S. Congress in 2022 to uphold and protect a system that Las Cruces Black Lives Matter protester James Hall wanted to tear down in June 2020.

Which is weird, because it turns out, theyre the same person.

Confused? Well, lets go back to an ugly period of unrest which followed the death of George Floyd in the summer of 2020. During a protest in Las Cruces, a local reporter interviewed someone identified as James Hall.

Hall, wearing a bandanna over his face along with sunglasses and a hat, said defunding the police simply wasnt enough.

We need serious police reform in this country, the man said over chants of no justice, no peace.

Its not just about defunding police. Its about defunding a system that privileges white people over everybody else.

Mr. Hall was apparently a Las Cruces resident, just another angry guy expressing some pretty radical opinions. Dont just defund police, defund whiteness.

In 2022, Vasquez is running to unseat Republican Rep. Yvette Herrell in New Mexicos Second Congressional District. According to Ballotpedia, all three major race-trackers view the contest as a toss-up. Hes running as a champion for economic justice, equal pay for equal work, affordable housing and high-quality healthcare for all, according to the Las Cruces Sun-News.

But most of all, he believes the GOP is the party of division.

How Are False Reports Punished

Making a false report can have serious consequences for the individual against whom you made the report. This and the waste of resources to investigate a crime that did not occur is the basis for the penalties associated with this offense. If you are found guilty after a trial, or if you choose to plead guilty, you can face upwards of 6 months of jail time.

The court will take into consideration a number of factors when making a sentencing determination. Of utmost importance is your criminal record, the motive for making the report and the consequences of your report. The judge will hear arguments from the prosecution and it would be prudent that you have an attorney to represent you at a sentencing hearing. In lieu of jail time, it is also at the discretion of the judge to impose probation.

Facing San Diego false report charges can be frightening, especially if it is your first encounter with the law. However, being convicted is even worse, so hiring a lawyer from the beginning is critical to proving your innocence and beating the charges.

What Is A False Police Report

A police report is a document that is created when a crime has been reported to the police. Police reports generally contain the names of the victim and the perpetrator, the nature of the offense, the names of any potential witnesses, and other relevant information. The purpose of a police report is to have a record of each specific event to refer to when referencing the incident, such as during a legal case.

The public regularly file police reports of crimes committed, as they provide information relevant to ongoing police investigations. However, if a person knowingly provides misinformation to the police when filing a report, then they could be found guilty of filing a false police report and other related offenses.

The individual that files a false report could be charged whether they affirmatively make a false statement, or if they deliberately withhold information that is material to a criminal investigation.

Filing a false report to mislead the police could be considered to be obstruction of justice, as they waste police time, money, and resources. The law places the burden of proof on the prosecution to prove beyond a reasonable doubt that the person who made the false police report satisfies the elements of the crime with which they are being charged.
