Do Police Need A Warrant For Location Data

How do the police track a mobile phone? (AKIO TV)

For a typical search warrant, police need to convince a judge that they have probable cause to believe that evidence of a crime will be found in the place or item to be searched. To establish probable cause, an officer must typically submit an affidavit based on reliable sources that identify objectively suspicious activities.

In recent investigations, however, law enforcement has relied on a few different statutory authorities that generally require a lower standard of proof than probable cause. For instance, one statute allows law enforcement to obtain a court order directing access to a company’s stored communications when the officer shows a “reasonable basis” to believe the information is “relevant and material to an ongoing criminal investigation.” .)

How Police Track Your Phone

Wherever you roam, you don’t roam alone. Cell phones are easily and frequently tracked to perform services for their owners. But outside parties may also take an interest in where phonesor, more specifically, their ownersgo. Among them are law enforcement personnel of all levels who, in many cases, don’t need so much as the permission of a governing authority to do the tracking.

Last week, Senator Al Franken asked Attorney General Eric Holder in an open letter to make public how frequently the Department of Justice requests the locations of individuals from wireless carriers without a warrant, how often the carriers comply, what specific information is requested, and the cost of the information.

If that seems like intelligence that would be readily and freely accessible to Congress because of a rule of law, it’s not. And the Department of Justice isn’t alone in operating outside strictures when it comes to cell phone tracking. Even the smallest of municipalities are, by and large, fashioning their own rules in states that don’t specifically prohibit warrantless cell phone tracking.

The problem stems from communications laws that go back to the days of the telegraph and the diversity of court rulings that result from their interpretation.

Probable cause is the standard for obtaining a warrant for a search. It’s enshrined in the Fourth Amendment:

How A Warrant Is Obtained In Utah

Can Police Track My Cell Phone Using Records?

In order to obtain a search warrant to track someones cell phone, an investigating officer must make an application for such a warrant and present it to a judge who will rule on its merits. The application will contain all the information related to the reasons the warrant is sought. It will name the officer seeking the warrant, the individual whose information the officer wishes to track, and the reasons that the officer believes that tracking this individuals movement by way of their cell phone data will assist is solving or preventing a crime.

The judge will consider all the evidence in the application and make a ruling based on whether or not probable cause exists to believe that tracking the phone will turn up evidence of a crime. If the judge decides to issue a warrant, the warrant will often be limited in scope and length. For example, the warrant may only allow for the individuals movements to be tracked for 10 days. If the 10 days pass, the tracking is no longer legal unless the officers make an application to renew the warrant and this application is granted by the judge.

Lock Your Sim Card With A Pin

Another way to protect against certain forms of mobile phone spying is to lock your SIM card by setting a four- to eight-digit passcode known as a SIM PIN. Each time your phone reboots, youll need to enter this PIN if you want SMS, voice calls, and mobile data to work.

An iPhones SIM unlocking screen

If you type the wrong PIN three times, your SIM card will get blocked, and youll need to call your phone carrier to receive a Personal Unblocking Key to unblock it. If you enter the wrong PUK eight times, the SIM card will permanently disable itself.

With a locked SIM, youll still be able to use apps and Wi-Fi but not mobile data or cellphone service. So make sure that you securely record your SIM PIN somewhere safe, such as a password manager like Bitwarden, 1Password, or LastPass, and never try to guess it if you cant remember it.

If you want to lock your SIM card, first youll need to know the default SIM PIN for your cellphone company. For AT& T, Verizon, and Google Fi, its 1111 for T-Mobile, Sprint, and Metro, its 1234. If you use a different phone carrier, you should be able to search the internet to find it.

Once you know your default PIN, heres how to you set a new one:

Using Google Maps To Track Your Iphone

If you forgot to turn on the location feature in Find my iPhone app, dont be desperate, because there are still chances you will be able to get the trace of your mobile device. Usefully, Google Maps can reveal the last known location of your iPhone.

Log in to the account that has been associated with the lost iPhone, and go to the part of the menu where it says Your timeline. Here you can select the date when your iPhone was stolen and you can see the locations that were saved on that date. The last one is where the phone was lastly been turned on.

Just like with the previous app mentioned, there is a catch. This feature in Google Maps will work only if you havent disabled it. Unlike the Find my iPhone app, here it is preset that the location is being monitored, and logged.

Some people dont like being tracked, so they disable this feature, and then there is no backlog information about the phones whereabouts. In this case, the app is useless for finding a lost iPhone.

Cellphone And Smart Device Location Data: Where Does It Come From

Cellphone and wireless service providers and tech companies store certain historical and real-time location data gleaned from cellphone connections with cell towers, GPS satellite tracking, and smart device applications and operating systems. Law enforcement can request this data using a court order or warrant. Some examples of this data include:

Historical CSLI. A typical cellphone produces a time-stamped record every time it connects to a cell site. This record is referred to as “cell-site location information” . With CSLI, police can get a really good idea of where someone’s phone has been, allowing them to piece together past eventsfor instance, connecting the dots as to a suspect’s location at the scene of a crime.

Real-time CSLI. To obtain real-time data, a service provider can either contemporaneously monitor a phone’s CSLI connections or “ping” a user’s cellphone and force it to reveal its location. This real-time data can provides police with information on a suspect’s current whereabouts.

GPS movements. A phone or car’s GPS system tracks its movements using satellite signals. This information might be stored on the phone or vehicle itself or transmitted to a repository. It can also be relayed to police in real time.

Police Use Cell Phone Location Information Obtained Without A Warrant As Evidence

Cell phones operate by continually connecting to radio antennas known as cell sites. Each time a phone connects to a new cell site, it creates a time-stamped record known as cell site location information . Wireless companies retain this information for business purposes. In Carpenter v. United States, the FBI and prosecutors sought to use CSLI to establish the whereabouts of criminal defendants around the time of several alleged robberies.

As part of their investigation, the FBI identified the cell phone numbers of the defendants. The government prosecutors then sought and received court orders to obtain the phone records of the defendants. The orders were granted under a federal law which allows police to track data, like cellphone information, with a court order based on facts granting reasonable grounds to believe the records are relevant and material to an ongoing investigation. This is a lower standard than the probable cause necessary to obtain a search warrant, which requires a reasonable belief that the evidence will lead to the confirmation of the commission of a crime.

What’s Next For Privacy Rights In The Digital Tracking Age

Some commentators are confident that lower courts will rely on Carpenter to extend the probable cause warrant requirement to newer data searches that arguably infringe on greater privacy rights. Whereas historical and real-time CSLI searches are often particularized to an identified individual, reverse location searches may look at the whereabouts of hundreds or thousands of individualsmost of whom are not suspected of any wrongdoing. And some question the effectiveness of reverse location searches in generalarguing that such searches are highly prone to errors and shouldn’t be used at all.

This area of law is evolving. As courts and legislatures try to catch up to the technology, more cases and statutes will likely emerge. If you have questions regarding your privacy rights, contact a lawyer who specializes in civil rights or criminal defense.

Can The Police Search My Phone If It Is Password Protected Am I Obligated To Give Them The Password

Can Police Track Your Cell Phone Without a Warrant?

No, you do not have to give police your password due to your right to remain silent. However, police are permitted to use other means to unlock your phone, for example through forensic methods or by trying various passwords. They may also be able to seize your phone, but in that case, the Supreme Courts decision is unclear as to whether a warrant would have to be obtained at that point in order to conduct a search of your phone.

Option : Block The Signal

To track a phone, it must be able to send or receive signals. These signals could be wireless signals, Wi-Fi signals, or GPS signals. Electromagnetic waves can travel through a lot of things but not through everything. Concrete, metals, and other high-density material will block signals from coming through.

That means the best places to use your phone are large buildings, underground, basements, and parking structures. If you have a metal box, always keep your phone there. This will make your phone untraceable until you take it out of the metal box at least. Turn OFF your location and stay OFF the internet as much as possible.

Stingray Technology

Most people have never heard of stingray technology, but that does not stop government and police agencies from using it to spy on citizens. Essentially what Stingray refers to is a secretive technology that mimics cellular towers to confuse mobile phones in proximity to the device. What happens is that the mobile phone is tricked to think the stingray device is a legitimate cell tower and therefore connects to the spy device. Once connected to the stingray, police can then track call history, identify who is calling into the mobile device, monitor conversation, pinpoint the location of an individual, and more. Stingray technology essentially takes domestic wiretapping to a whole new advanced and terrifying level of privacy invasion, and that is why everyone should hold some concern.

Two organizations, the ACLU and EFF, have moved forward with legal paperwork stating investigations using stingray technology were essentially illegal. The reason is that authorities using the stingray technology did so without first explaining in detail to the courts how they would use stingray devices. Both organizations feel that the government and police intentionally misled the oversight authority knowing that if the truth was revealed the courts may be apprehensive to greenlight any such activity.
