What Type Of Breathalyzer Should I Choose

Testing at-home breathalyzers with a police officer

Personal breath testers can be found online and in retail stores and vary widely in reliability, accuracy, and price. Many breathalyzers advertised are not to be trusted and should not be considered by people wanting to purchase a unit they can rely on. Personal breathalyzers fall into two classes depending on the alcohol sensing technology employed: Semi conductor and Fuel Cell. Semi-conductor breath testers are the mass-produced, imported and typically sold based on price by mass-market internet, catalogue, and store retailers. Semiconductor devices are inappropriate for those interested in an accurate breath alcohol reading.

Q: Are Home Breathalyzers Accurate

A: The accuracy of the results obtained from using a home breathalyzer can rely heavily upon the quality and correct use of the device in question. While there are many reliable, accurate, and cost-effective devices that draw close estimates a persons blood alcohol concentration level, we suggest that you always do your research before purchasing a home use design.

Get A Compelling Long Read And Must

If youre planning on driving on I-95 or the Schuylkill Expressway this weekend, you might want to take extra care to stay inside the lines.

Earlier this month, a judge in Dauphin County ruled that the Intoxilyzer 5000EN Breathlyzercommonly used by state policeis unreliable. The ruling led to the dismissal of breathalyzer evidence in 20 cases and could undermine prosecutions in thousands of others across the state.

So, for the time being, the Pennsylvania State Police have decided to forego breathalyzers altogether and opt for a good old-fashioned stick in the arm instead. At least for the foreseeable future, if youre pulled over by a state trooper on suspicion of driving intoxicated, theyll be gunning for your blood. Of course that doesnt mean you have to give it to them but dont expect a get-out-of-jail-free card. Cops dont take kindly to motorists who refuse to submit to blood alcohol tests. But more importantly, by refusing to submit to a blood test you are accepting punishment before youve even been convicted of a crime. Thats because under the states implied consent law, you gave the cops permission to test your breath, blood and/or urine for chemical intoxicants the moment you turned the key in your ignition.

Suspects are not entitled to legal representation before or during the test, and appeals courts have even upheld the legality of taking a blood sample from an unconscious motorist without their knowledge and without a warrant.

Flaws In The Breathalyzer Tests

Since breathalyzer tests are not always certified and calibrated, your lawyer may be able to prove that the test was flawed or the equipment was outdated. Your DUI attorney may also demonstrate that the police officer performed the test incorrectly or did not follow proper protocol during the arrest.

How Do You Use A Breathalyzer

Timing matters, a lot. The manufacturers instructions for all the products we tested say to wait about 20 minutes after eating and drinking to use the breathalyzer since it takes time for alcohol to be absorbed into a persons system after consumption. But because peoples bodies metabolize alcohol at different rates, measuring at 20 minutes isnt always going to produce the most accurate results. Depending on your physiology, what else youve had to eat or drink, and timing, among other factors, your BAC could very well keep increasing even after a 20-minute wait.

I cant give you a fixed number , because depending on how much you drank, your alcohol content is going to keep going up, Sovndal said. If I drink 5 beers and 2 tequila shots and then measure it, I could still be on the uprise. It might not flatten out for another hour.

To be safe, measure your levels after 30 minutes and then again after 60. If your BAC is higher at the second reading, wait another 30 minutes before taking another reading.

A Portable Breath Test Is A Type Of Field Sobriety Test

Portable breath machines are not sophisticated instruments, like an infrared spectroscopy device. A simple electrochemical detector, coated on one side of a small plate, will react with alcohol molecules in a persons breath. Using a software algorithm, the fuel cell counts the molecules that stick, and then generates a numeric result that is displayed, but is not supposed to be stated or shown on camera. Essentially, the more alcohol molecules that reach the plate of the fuel cell, the higher the reading.

All the Georgia preliminary breath test machines use a fuel cell to measure positive ions on a small, coated plate which is about the size of a dime. A narrow, hollow, plastic collection tube leads to the sample chamber, and about 5 seconds of forcible blowing is all that is needed to get a reading. The objective is to reach your deep lung air, and thereby get the reading that will be closest to your true blood alcohol content.

What To Look For When Buying A Breathalyzer

BACtrack S80 Breathalyzer Product Video — Official Version

There are only a handful of companies that make breathalyzers for the general public but even so, the products on the market have some significant differences. When buying a personal breathalyzer, consider:

Price: The cheapest product we tried was about $40 and the most expensive $131. Generally, the more expensive breathalyzers do tend to be more accurate and reliable, but you don’t need the same level of detail for recreational use as, say, a police officer would. If your reading is at all borderline or uncertain, you can always just wait a little longer and test yourself again later.

Accuracy and reliability: Virtually all major breathalyzer manufacturers claim “professional” or “police-grade” accuracy, so it can be difficult to determine which devices actually deliver on that claim. Since accuracy is crucial in staying safe behind the wheel, we conducted trials to test the accuracy of each device so that we can tell you which ones live up to their price tag. And we found price does not denote reliability.

Result readability: Some breathalyzers will display your BAC right on the device, while others have an optional or mandatory Bluetooth smartphone connection. The latter can be useful if you want to store your results in a log. But if you don’t have or don’t want to use a smartphone, skip this feature and be sure to get a standalone device.

Buying Guide For Best Breathalysers

A breathalyser can be a fun form of entertainment at a party, or it can keep you and other guests safe. By measuring someones blood alcohol content , you may be able to convince a friend to hand the keys to someone else. Breathalysers come in different types and will vary in their dependability, so you should consider models carefully before making a purchase.

Disposable one-time-use models can only be relied on to tell whether someone has been drinking. Semiconductor designs provide a more dependable BAC reading, though fuel cell sensor units are the best option for long-term reliability and accuracy. Active breathalysers are blown into, while the less accurate passive breathalysers are blown across. More accurate models tend to come at a higher price, and you should consider the additional cost of new mouthpieces and batteries. Recalibration can also become costly.

A personal breathalyser can offer protection and peace-of-mind for yourself and others. Seeing a BAC number on a screen might well convince a friend not to drive after drinking too.

“Although there are plenty of charts that help you calculate your BAC, they arent accurate for every person.”

How Does A Breathalyzer Work

The Intoxilyzer 8000 is designed to analyze breath samples to determine a persons BAC level. If you consent to a breath test in Oregon, the Intoxilyzer 8000 will take two breath samples. Those breath samples are separated by a few minutes. Once you blow and provide a sample for analysis, the machine uses a series of formulas to determine what the BAC of that person would be.

Police Warn: Do Not Trust Home Breathalyser Kits

PERSONAL breathalyser units are proving increasingly popular in Victoria despite police warnings about their accuracy.

The devices, which sell for as little as $8.90, are widely available in chemists and supermarkets and have been listed on the RACV website’s best-seller section. The RACV sells three types of unit, including one for $189 that claims to be ”accurate enough for police law enforcement use”.

Victoria Police and consumer groups dispute the claims. ”Police advise drivers not to rely on the readings from personal breathalysers because there is no guarantee the reading is correct,” police spokesman Glen Atwell said.

”Police equipment is regularly tested and professionally calibrated to ensure accuracy and reliability. Many of the hand-held devices available for purchase cannot be calibrated for accuracy. Police maintain that these devices are useful to give people an indication of their blood-alcohol concentration , but the message remains the same – if you’ve been drinking, don’t drive.”

Cheap testers use nickel metal hot-wire sensors mid-range models use semi-conductor technology with gas airflow sensors top-of-the-range models, which sell for as much as $3000, use fuel cells.

A spokesman for distributor Breathalyser Sales and Service said: ”It’s a growing business which is becoming increasingly popular as more people become aware of the product.”

Use Of Preliminary Breath Test Or Preliminary Alcohol Screening Test In The United States

Police LCD Digital Breath Alcohol Tester Personal ...

In the US, the primary use of preliminary breath test or preliminary alcohol screening devices is for screening and establishing probable cause for arrest, to invoke the implied consent requirements.

In US law, this is necessary to sustain a conviction based on evidential testing . In order to sustain a conviction based on evidential tests, probable cause must be shown . Police are not obliged to advise the suspect that participation in a FST or other pre-arrest procedures is voluntary. In contrast, formal evidentiary tests given under implied consent requirements are considered mandatory.

Refusal to take a preliminary breath test in the State of Michigan subjects a non-commercial driver to a “civil infraction” fine, with no violation “points”, but is not considered to be a refusal under the general “implied consent” law. In some states, the state may present evidence of refusal to take a field sobriety test in court, although this is of questionable probative value in a drunk driving prosecution.

Different requirements apply in many states to drivers under DUI probation, in which case participation in a preliminary breath test may be a condition of probation, and for commercial drivers under “drug screening” requirements. Some US states, notably California, have statutes on the books penalizing preliminary breath test refusal for drivers under 21 however the Constitutionality of those statutes has not been tested.

The connection is easy and intuitive to set up and use, and the device is rechargeable so you don’t have to worry about batteries.

This gadget doesn’t have a display, so you do need the app to use it and see your results. If you don’t have a smartphone or don’t want to rely on one, this device is not the one for you. Note that also means if your phone is dead, you can’t use the breathalyzer.

Based on our tests, this device is also highly accurate and comparable to other BACtrack models. And the Mobile is considerably smaller than most of the other breathalyzers on this list, which can be convenient for slipping into a purse or pocket.
