Convictions That Usually Cant Be Used Against You

How I Outsmarted Police in front of The Queen

In most cases, if you get a record suspension for a crime that youve been convicted of:

  • an employer cant ask about that crime
  • you can honestly say that you dont have a criminal record

And breaking a provincial law is not a crime. In most cases, an employer cant ask if youve been convicted of breaking a provincial law. For example, speeding and careless driving are in the Ontario Highway Traffic Act. Theyre called provincial offences.

If youre convicted of a provincial offence, you dont have a criminal record.

Release From Police Custody

In many situations the police will charge and then release you on a promise to appear or an undertaking, which may have certain conditions for you to follow.

If the police give you papers that say you have to go to court at acertain time, you have to go. If you don’t go to court at that time, you can be charged with a crime called failing to appear, and youcan be arrested and put in jail until your trial.

If the police do not agree to release you, they have to arrange for a court appearance called a show cause hearing as soon as possible. Legal aid will provide a lawyer at no cost to assist you with the show cause hearing. At a show cause hearing, the police and Crown prosecutor will tell the judge why they think releasing you may not be a good idea. For example if you have hurt someone, they may be concerned that it is not safe to release you straight away. If the judge decides you should stay in custody, the police will usually bring you to one of the NWT’s correctional centres.

If the judge agrees to release you, there will be conditions set for you to be allowed out of jail. For example, you may have to agree to stay away from a certain person, you may have to live in a certain place or you may have to pay money or bail to the court.

Why Are Red Notices Important

They are used to simultaneously alert police in all our member countries about internationally wanted fugitives. Police in other countries can then be on the watch for them and use the Red Notice to support extradition proceedings.

Red Notices help bring fugitives to justice, sometimes many years after the original crime was committed.

Exemption : Exigent Circumstances

If the police feel that the time it would take to get a warrant would jeopardize public safety or lead to the loss of evidence, they can perform a search without a warrant. For example, the police can forcibly enter a home if it is probable that evidence is being destroyed, if a suspect is trying to escape, or if someone is being injured. The police officers responsibility to preserve evidence, arrest a suspect, or protect an individual outweighs the search warrant requirement.

Whats The Difference Between A Bench Warrant And A Warrant

Woman flags down police: Am I wanted?

Consider Getting A Sexual Assault Examination

A sexual assault forensic examination, or a rape kit, is a way for specially trained healthcare providers to collect possible evidence.

This process allows them to gather DNA and materials from your clothes, your body, and your belongings. If you decide later to press charges, this could come in handy.

However, its important for the quality of the kit that you dont shower, change clothes, or otherwise alter your appearance from the time of the assault to the time of collection. Doing so may accidentally remove valuable evidence.
