Getting police records: What are your rights?

South Sound 911 only processes public records requests on behalf of certain law enforcement agencies for Incident Reports, CAD logs, and/or 911 and dispatch audio. Investigative information such as body cam footage and officer notes, are held and released by the individual agency. Please contact the relevant agency for access to such information.

Police Traffic Accident Report

These are reports completed by CSPD officers that detail the events of a traffic accident. Please note, if you filed your traffic accident report online or mailed your form to the State of Colorado Department of Motor Vehicles, the CSPD will not have a copy of your report. You will need to contact the Colorado State Patrol.

How Do I Pick Up My Check

Once payment has been confirmed and the application has been submitted, a Customer Service Representative will begin to complete the request. The applicant will receive an email to attend the police facility when the check has been completed.

    Many types of police records are exempt from public disclosure. There are two main reasons why they arent publicly available.     Every agency is required by law to respond and produce relevant, non-confidential documents that they do not otherwise have the right to withhold. If they have records that they need to disclose and do not, they are in violation of the law. You should first follow-up with the agency in writing and continue to request the documents. If they still do not respond, you can enforce your right to this information by bringing a lawsuit in Superior Court.     When Should I Expect A Response

    The law requires that an agency respond to any Public Record Act request in 10 days, acknowledging the request, giving a timeline for a full response and informing the requestor if they are claiming any exemptions.11 An agency can ask for a 14-day extension to respond to the request. The more extensive the request, or if it may require a lot of redactions to keep certain information confidential, the longer it may take to respond. While agencies are supposed to respond promptly, many agencies often take a long time. If you haven’t heard from them, follow-up reminding them that you are still awaiting a response, and document every contact with the agency.

    Also, if you are seeking information about a relatively-recent serious use of force, an agency has the right but is not required to temporarily withhold the relevant documents if there is an ongoing criminal or administrative investigation that could be harmed by the release of these documents.12 How long the agency can withhold depends on whether investigation is criminal or just administrative, but in most cases it cannot withhold longer than 18 months after the incident occurred. If criminal charges are filed, the material can be withheld until the criminal case has ended.13

    Pay The Application Fee

    There is a mandatory $5 application fee for each FOI request.

    There is no application fee for a request to make a correction to your own personal information.

    Processing fees

    Additional fees may apply to process a request. The processing fee is determined by the:

    • type of information you requested
    • format you wish to receive the information
    • total costs incurred by the institution to produce or prepare the information

    You will receive a fee estimate from the FOI office or institution where you submitted your FOI request, if the processing fees will be more than $25. When processing fees are over $100, a deposit may be required.

    The Records Division maintains copies of departmental reports and is responsible for addressing records requests made by the general public, media and other law enforcement or criminal justice agencies.
