N.J.A.C. 13:59-1 et seq. provides background checks for non-criminal justice volunteers to the following:

  • Any person who volunteers with a qualified entity, as that term is defined by the National Child Protection Act of 1993, 42 U.S.C. §§ 5119, 5119c
  • Any person who volunteers his or her services to an entity that has been qualified by the Internal Revenue System as exempt from Federal income tax pursuant to 26 U.S.C. § 501 or
  • Any volunteer of a nonprofit youth serving organization.

There are two options available to a requester under the VCP.

Fingerprint-Based VCP Check :

A requester may elect to conduct a more thorough check, based on a fingerprint comparison by using the service code provided below. The fee for electronic fingerprinting is $32.13. These responses will be mailed directly to the employers address that is provided by the applicant. The following forms of payment are accepted: VISA, Master Card, American Express, Discover prepaid debit cards, or electronic debit from a checking account. Accounts will be debited immediately.

YOUR EMPLOYER / VOLUNTEER ORGANIZATION ADDRESS MUST BE COMPLETE AND ACCURATE, AS RESULTS ARE SENT OUT VIA US MAIL.

Name-Based Volunteer Check :

If only a name-based criminal history record check is desired, please refer to the SBI 212B Form information listed below. The fee for name-based volunteer submissions is reduced to $12.No personal checks will be accepted.

Providing A Copy Of Your Id

We use the copy of your ID to check that the right person has filled in the form. Your ID must:

  • be a clear and readable copy
  • exactly match the details in your form write your name on the form exactly as it is on your ID
  • not be defaced.

You must use one of the following:

  • Your New Zealand driver licence. This can be current or expired within the last 2 years, but must not be cancelled or a temporary licence.
  • Your New Zealand passport. This must be signed and can be current or expired within the last 2 years, but must not be cancelled.
  • Your overseas passport. This must be signed and current.
  • Your New Zealand firearms licence. This must be current.

If you don’t have any of these, you’ll need to ask someone to confirm your identity or you will need to complete a statutory declaration.

How Can I Get My Records If I Cannot Afford The Fee

If you cannot afford the fee, you may request a waiver. You may do this by filling out an Application for Fee Waiver form or attaching a separate letter that requests a waiver of the fee. In the letter or application, you must state that you cannot afford the fee because you are poor, and you must include some proof that you are poor. To prove that you are poor, you may be able to simply explain how much you make a month and what your expenses are in the letter. If possible, you should include a copy of your pay stubs or bank accounts. Do NOT send original documents.

How To Make Your Request

In most cases, you should make your request to your local police force which would hold records on local systems. However, if you would like access to information held on national police systems, such as the Police National Computer , you would need to contact ACRO.

If you no longer live in the UK, contact the police force for the area where you last lived.

If you have been in contact with the police because you were a witness or victim, or because of a traffic accident, then this information may not be available to other police forces. In these cases you should contact the police force you dealt with at the time.

Although you dont have to use them, police application forms will help you understand what details you need to provide so they can find the information you have requested. It will also outline what proof of ID they will need to see. For example, they may ask you when you have been in contact with the police and why, and whether you have lived in another part of the UK. You can make a request verbally or in writing. If you make your request verbally, we recommend you follow it up in writing to provide a clear trail of correspondence. Asking For Your Full Record

If youre eligible for a clean slate, your record will automatically be concealed under the Clean Slate scheme. However, sometimes you need to give your full record, including convictions that have been concealed. For example, you might need a full record when youre:

  • applying for some jobs
  • involved in court cases or tribunal hearings
  • travelling to certain countries check with the embassy or consulate of the country you want to travel to.

In most cases it is against the law for anyone to ask or make you reveal your full record.

People who are the subject of the record follow a procedure outlined by Ind. Code 10-13-33-1, which provides that such a person can receive a copy of their personal criminal history data by submitting a request, showing identification documentation and submitting a reasonable fee. Additionally, if a records subject is denied employment, housing or etc. after another individual, employer or agency has received and reviewed his or her report, the person must be told that he or she was denied based on the report. The individual then has a right to obtain a copy of the prepared report from the Central Records Division and challenge any inaccurate information.

How Do I Request Information About Myself

You may ask Police for personal information you think Police holds about yourself. This type of information request is covered by the Privacy Act, not the Official Information Act.

You may complete and submit your request online. Visit the “Request information about yourself “section to learn more.

Alternatively, you may , or write a letter or email and deliver your completed request by hand or post or email to your nearest Police station or District Headquarters or Police National Headquarters.

Can An Organisation Release Information About Me To The Police

Data Protection legislation allows organisations to share personal information if it is needed to prevent or detect a crime, or to catch and prosecute a suspect.

Requesting A Police Report By Mail

The process of requesting a copy of a police report by mail is a bit more involved. In many jurisdictions, you are required to make your Public Access Request via mail. Typically, the agency will provide a form online for you to fill out, but some places are fine with you writing a letter to ask for the police report.

1. Figure out where to send the Public Access Request form or letter.

Your local police department may have a specific address and addressee for police report requests listed on their website. If they dont, simply address it to the Records and Identification Division, and use the general address listed online for the department.

2. Fill out the form or write the letter.

After you have found the location to send your request, you should be able to easily find out if they want you to send a request form or a letter. If the information is not readily available on the site, just call and ask which method they prefer. If it is available, filling out a request form is typically the easiest method because you wont have to worry about leaving out information.

If you write a letter instead of filling out the form, be sure to include the following information:

  • Case number
  • Your Name, Birthdate, and Address
  • The date and location of the incident
  • Your role in the case
  • The officers name who filed the report
  • What exactly you are requesting

3. Gather additional materials and send the form/letter.

4. Pay for the police report.

Get Your Criminal Record

Get your fingerprints taken. Visit an accredited fingerprinting company or a police service that can submit your fingerprints electronically.

Ask your local police service if they offer this service or visit “Where do I get a criminal record check?” for more information.

Your electronic fingerprint submission must clearly state you are applying for a record suspension.

Wait to receive your criminal record or a Certification of No Criminal Record from the Royal Canadian Mounted Police. Any documents provided by the RCMP must be included with your application.

If you have convictions outside of Canada, you MUST also submit information to the Parole Board of Canada on these convictions, along with your criminal Record.

When you receive your criminal record, check it to ensure all of your convictions are included. It is your responsibility to report all of your convictions to the Parole Board of Canada.

If ALL your convictions are included, go to STEP 2.

If any of your convictions are missing from your criminal record, you must get a Proof of Conviction for each one. To get this, contact the court that heard your case and/or the police service that arrested you to get this information.

The Proof of Conviction must include the:

  • Date and court where you were sentenced
  • Offence that resulted in your conviction
  • Sentence you received
  • Arresting police force.

Get A Copy Of Your Police Records

You have the right to ask for a copy of records the police have about you. This is called a subject access request.

You might need a subject access request if you move to another country.

A subject access request has records from:

  • police forces in England, Wales, Northern Ireland, Jersey and the Isle of Man
  • the British Transport Police
