Q: What is the difference between a warrant and a capias?
A: A warrant is an order which authorizes a law enforcement officer to arrest and bring a person before the judge. A warrant may be issued when a person is charged with a crime, convicted of a crime but failed to appear for sentencing, owes a fine or is in contempt of court. A capias is also an order for arrest of a person, typically issued by the judge or magistrate in a case. It is commonly issued after a defendant fails to attend a scheduled court hearing.
Q: How do I know if I have an outstanding warrant or capias?
A: Respond to any Police District or ask an officer on the street to run a query on your social security number. You should provide some type of identification, if possible. To protect your privacy, police will NOT run a query if you simply call a district on the telephone.
Q: If there is an outstanding warrant or capias, will I be arrested on the spot?
A: Most capiases allow an officer to re-cite, meaning you will be given a new court date. However, if you have been re-cited numerous times and have continued to ignore the court date, the officer may choose to physically arrest you. Most warrants require an officer to physically arrest the person. Once you are re-cited or processed through the Hamilton County Justice Center, the warrant/capias is cancelled by the Hamilton County Central Warrants Department .

Domestic violence victims can receive a free copy of their domestic violence report either from the district where the incident occurred, or from police headquarters.

Police Department Request Form
If you cannot submit a police report request online or through the mail, then you will have to visit the police department in person and file a request there. Call beforehand since some departments only allow in-person requests on certain days. You can find your local police department here. Then you can find out about filling out a Police Department Request Form in person and how to get the information you need. Typically these police department request forms can be fulfilled that day.
A request will typically require you to provide your personal and contact information as well as details about the incident, including the type of incident, date, and who else was involved. Be aware that if the report pertains to an ongoing investigation then your request could be denied. If you are unclear about why your request was denied you should talk to an attorney.

Collisions Investigated By Other Agencies
Police Accident Reports submitted to DMV by police departments other than the New York State Police may or may not be submitted electronically, therefore, these guidelines may not be applicable.
Motorists requesting a copy of an MV-104A submitted by a police department other than the New York State Police should follow the instructions contained in paragraph above entitled, For Collisions on all Other Roads or contact the investigating police agency directly.

How Long Does It Take To Obtain A Police Report
It typically only takes a few days to a week to get a copy of a police report if you were directly involved in the case. However, if you were not directly involved, or if you are an insurance agent, it will take longer because you have to send in a request and have it processed. This process can take up to a month or longer.

Police Report Vs Police Record
First, lets clarify something that is bound to cause some confusion: the difference between a police report and a police record. While these two items have similar names, they are in fact very different. A police report is a document filed by a police officer that essentially offers a summary of an arrest, incident, or accident. Effective Tuesday, July 6, 2021, SFPD Police Headquarters at 1245 Third Street will reopen to the public after a temporary closure due to the COVID pandemic.
You may request a police incident report in person at SFPD Police Headquarters during our normal business hours of 8 am-5 pm, Monday – Friday .
The SFPD Crime Information Services Unit is responsible for processing incident report requests from the public, law enforcement agencies and other authorized organizations. The unit also processes local criminal background checks for agencies entitled to that information under the law. For all other requests that are not incident reports or local background checks, please contact the appropriate department within SFPD.

Why Are These The Only Crimes Shown
With the Police Reports Map and 9-1-1 Response Map, SPD is making almost all of our reports available online. The Department attempted to be very thoughtful about what information was released and what was not. These decisions were not made to “hide” types of crimes from the public, instead decisions were made about who to protect.
The only reports that are not being released under this system are when the rights of the victim, age of the victim, possibility of revictimization or overall public safety/security issues take clear precedence over the public right to know.
Information on Rape and other sexual offenses, Domestic Violence, Child Abuse, Kidnapping, Suicides, locations that are sensitive , Homeland Security issues and tactical information that might compromise the safety of our officers are not being released in this system.
If the event is one of the many types we do show, but the location code was entered into the system incorrectly, the location of the event cannot then be verified. In this scenario, this particular event will not appear on the map at all, rather than providing possibly misleading information.

Requests for copies of an MV-104A for collisions investigated by the New York State Police that occurred on the New York State Thruway and its subsidiary arterials must be made to New York State Thruway Authority.

Filing An Incident Report
Upon receiving the report from the victim, the police department adds information to the incident report, including:
- Report number used by police to easily look up and keep track of the report.
- Name of the officer who approved the report, if any, and the badge number.
- Exact classification and incident code for the type of crime.
- Name and badge number of the law enforcement official who reviewed the report.
- Case numbers for any associated cases.
- Case status, such as open, suspended or unfounded.
- Any known bias of the victim.
- Time and date the report was submitted to the police department’s database.
Commonly, victims of a crime also have the option to file their incident reports online with the appropriate police department. Sometimes, though, this option does not allow for the attachment of supporting documents.
Once submitted, the incident report may or may not be reviewed by an officer, let alone investigated, as fraud investigator Mark Fullbright notes in his 2014 presentation, “Police Report vs. Incident Report: A Resource for Identity Theft Victims.” Incident reports usually live in a records management system maintained by law enforcement agencies.

Using the portal is the most secure and convenient way to request and receive incident reports from the San Francisco Police Department. An account can be created within the Incident Report Request Portal to track the request and receive reports and correspondences securely online.
Traffic Collision Reports: Before attempting to obtain a copy of a collision report, please allow a minimum of five days from the date of the collision to allow the report to be reviewed and approved for release.
Copy Of A Police Report
The VPD Correspondence Unit can provide a copy of a police report to you if you have reported or been involved in a property offence incident, such as:
- theft
- break-and-enter
- motor vehicle collisions where a police officer has completed an MV6020 report
With your consent, your insurance company can make this request on your behalf. In most cases, your police report number is sufficient for the VPD to find your file.

Police Incident Report Copy Request Forms
If you elect NOT to use the portal, requests may still be submitted using U.S. Mail and email using the Incident Report Request Form. However, those requests will be manually entered and tracked in the Incident Report Request Portal by a member of CISU. You do NOT need to complete the Incident Report Request form if you submit your request via the portal.
