  • The “no charge” police check DOES NOT apply to volunteers that are requested to obtain a Vulnerable Sector Check.

How Long Is A Certificate Valid For

Victoria Police does not have an expiry date for validity of National Police Certificates. The police certificate is the result of a check of police records only up until the day it is issued. It is up to each organisation to determine how often they require a new certificate to be issued. Some areas do have either direct legislation or licensing requirements which require a police check be conducted at certain intervals. The best source of information in regard to this is the professional or industry governing body which relates to the area.

Police Report Vs Police Record

First, lets clarify something that is bound to cause some confusion: the difference between a police report and a police record. While these two items have similar names, they are in fact very different. A police report is a document filed by a police officer that essentially offers a summary of an arrest, incident, or accident. A police record, on the other hand, is usually the same as a criminal record and it includes a list and summary of an individuals history of interactions with law enforcement, including arrests and convictions.

Another point that deserves clarification is the difference between a police report and an accident report. In fact, theres not really a difference between these two items. An accident report is simply a type of police report that details the circumstances of a traffic accident. A police report, meanwhile, can include accident reports, but they cover a much broader range of incidents that may involve the police, including crimes. Note that some police departments call police reports incident reports. Remember that some accident reports may also be criminal reports, such as if the accident may have been caused by drunk driving.

External Link commenced on 1 December 2021 and replaces the Victoria Police Information Release Policy. The new legislation changes the way a persons criminal history information can be used and disclosed, including what can and cannot be released on a national police record check.

    Changes include :

    • Victorian convictions that are spent will no longer show up on a national police record check
    • Court outcomes without conviction will be spent, subject to the completion of any conditions attached
    • Generally, convictions with a sentencing outcome of 30 months imprisonment or less will be spent automatically after a 10-year crime-free period for adults and five years for young people
    • In certain circumstances a conviction will be spent immediately, including when a person was under the age of 15 when they committed the offence
    • Criminal charges where a court has not yet made a decision , information relating to an ongoing investigation by police, and/or findings of not guilty by reason of mental impairment will in most circumstances not be disclosed.

Please note that these changes only apply to disclosure for standard employment checks and exemptions apply where other Victorian legislation or existing national agreements or national laws are in place. Spent convictions will continue to be disclosed to police, courts and other law enforcement agencies for the administration of the justice system and to protect community safety.
