    How Warrants Work & How Long It Takes

    In order to get an arrest warrant, police officers need to convince a judge that a crime was most likely committed. And the suspected crime was likely committed by the person they want a warrant for. The burden of proof is not super high at this stage, but facts need to be present.

    In order to make their case, an officer must submit an affidavit. The affidavit has to be signed under oath and contain enough facts to convince a neutral judge of probable cause. IE: that you are very likely the person who bounced a check when buying diapers because it was signed by you and they have video camera footage of your purchase.

    Or that you likely tried to commit insurance fraud because your car that you couldnt afford was conveniently totaled the day before it was supposed to be repoed.

    If they can convince a judge of these two things with an affidavit, then the judge will grant them an arrest warrant. But this process is pretty similar with bench or search warrants as well.

    The judge, however, may put restrictions on the arrest warrant. Something like you can only be arrested between 6 a.m. and 6 p.m. or you cant be arrested if youre at work. But this all depends on the severity of the crime. Sometimes the bail amount will also be included in the warrant.

    Obtaining a warrant doesnt usually take more than a day. However, it can take several days for a warrant to hit the system

    What Is The Difference Between An Arrest Warrant And A Bench Warrant

    There are two types of warrants in the State of California that give police departments the authority to arrest someone. These are:

    • arrest warrants, and
    • bench warrants.

    A California arrest warrant authorizes law enforcement officers to arrest and detain a person that they suspect committed a crime outside of an officers presence.1

    Judges issue arrest warrants by order of the court based on:

    • evidence presented to them by a peace officer and/or a District Attorney, or
    • following a grand jury indictment.2

    In order to be valid in a California court, an arrest warrant must include:

    • the name of the defendant,
    • the criminal charges which he/she is accused of committing based on probable cause,
    • the time of issuance,
    • the city or county of issuance,
    • the signature and title of the judge, and
    • the name of the court.3

    Unlike an arrest warrant, a bench warrant is not issued based on suspected criminal activity. A bench warrant is most typically issued if a person:

    • failed to appear for court,
    • failed to pay a fine, and/or

    Note that deadly weapons should not be used upon arrestees unless necessary.

    Also note a bench warrant generally does not expire. It will remain in effect until:

    • recalled by the judge, or
    • the person named in the warrant appears in court.

    A search warrant is a third type of warrant in California. It does not give the police authority to arrest a person. Rather, the warrant allows the police to search:

Not surprisingly, only 9% of the police agencies in the Atlantic provinces said that they include a no go clause. This is consistent with the previous finding that the police officers in the Atlantic provinces are less likely to use a PTA with an undertaking than police in other regions in Canada.

    The condition referred to as no weapons restricts youth to not being in possession of a weapon. Only 2% of the agencies in our sample indicated they commonly attach this condition. Many officers indicated this condition is much more frequently used with adults than with youths.

No matter what size town youre in, you can call your local police or sheriffs department to obtain warrant information.
