How The Police Obtain An Arrest Warrant

To obtain a warrant, a police officer typically submits a written affidavit to a judge or magistrate. The affidavit, given under oath, must recite sufficient factual information to establish probable cause that a crime was committed and that the person named in the warrant committed it. A description so broad that it could apply to hundreds of people will not suffice.

What Is an Affidavit?

An affidavit is a written statement of facts that the “affiant” swears to be true. An affidavit typically requires a signature and usually includes language acknowledging that the affiant is open to prosecution for perjury if any assertions aren’t true. Often, for the affidavit to be legally valid, the affiant must swear to the statement in front of an authorized person, like a notary or county clerk.

Affidavits can come into play in criminal cases, as where an officer needs to submit a sworn statement in order to get a search warrant. They’re routine in civil casesfor instance, a lawyer might include one in support of a motion in personal injury lawsuit.

Why You Might Want To Check For An Arrest Warrant

This might seem like a no-brainer. But not all arrest warrants are issued because someone committed a high-caliber crime or because youre just a bad person. You can have a warrant out because you did something as simple as forgetting to pay a parking ticket. Or youre a suspect in a crime even if its a misunderstanding and you werent involved.

You can also have a warrant out for something like bouncing a check. Even if you didnt mean to and never even knew it bounced.

Anything that would amount to a felony or a misdemeanor is grounds for police to get an arrest warrant. As long as they can prove you did it or its a felony charge. Being suspected of a misdemeanor isnt usually enough for an arrest warrant. But it is enough for a felony.

Additionally, if you dont show up for court or pay a ticket, you may have a warrant. Even if you never knew you had court scheduled. I almost had this happen with jury duty because I didnt get the letter. Its not as difficult or unheard of as youd think.

So, again, you dont need to commit murder to find yourself with a warrant.

Police Wellness Checks In The News

If youve never requested a welfare check or experienced one yourself, you may have seen this topic covered on the news in recent years. Last year, one of the most broadcasted police wellness checks was done at actor and comedian Pete Davidsons home. Most people know Davidson for his time on Saturday Night Live, as well as his short engagement to Ariana Grande. Following their split last winter, Davidson shared some disturbing thoughts via Instagram, prompting someone in his life to call the police and ask them to check on him. Davidson posted the following cryptic message:

I really dont want to be on this earth anymore, Im doing my best to stay here for you but I actually dont know how much longer I can last. All Ive ever tried to do was help people. Just remember I told you so. Fortunately, an officer from the New York Police Department did a wellness check and later reported that Davidson was out of harms way.

Another welfare check that made the news recently didnt end as well as Davidsons. According to CNN, a wellness check went deadly when police went to check on 28-year-old Atatiana Jefferson in her home after a neighbor requested a welfare check for her. Upon arriving at her home, an officer shot and killed Jefferson.

How Can I Find Out If I Have An Active Warrant In California

There are three main ways in which a person can search to find out if he/she is subject to a warrant. The first applies when the person knows what California county may have issued the warrant. In this case, the person can visit that county sheriffs office website or the superiorcourts website for that county and run a warrant search.

For example, in Orange County, a person can search the Orange County Sheriffs Department website.

People can also use the California Arrests website, which will indicate if a warrant was issued by a given county.

For example:

  • if a person suspects a warrant is active in Los Angeles County, he/she can search here, and
  • if a person suspects a warrant is active in San Diego County, he/she can search here.

The second way to find out information about a warrant is to search the appropriate Superior Court of Californias website and run a warrant search. Here, a person will most likely have to enter the following information:

  • his/her full name,
  • a drivers license number, and
  • a court case number.

Finally, people can always run a criminal background check on themselves to determine if they are the subject of a warrant. A person can do this online by searching:

  • public records,
  • criminal records, and
  • government agency records.

A person can also pay a local service or a third party to perform a background check.

Can The Police Arrest Someone While They Are In A Drug Rehab

While arresting an individual in rehab is not the right approach, the police can arrest someone in drug rehab. However, there is a specific procedure in how you will be charged while you are in rehab and several factors that may lead to your arrest. For instance, if you commit a crime while you are in rehab, you can be arrested. Rehab is not a sanctuary where you will be immune to law enforcement.

How Warrants Work & How Long It Takes

In order to get an arrest warrant, police officers need to convince a judge that a crime was most likely committed. And the suspected crime was likely committed by the person they want a warrant for. The burden of proof is not super high at this stage, but facts need to be present.

In order to make their case, an officer must submit an affidavit. The affidavit has to be signed under oath and contain enough facts to convince a neutral judge of probable cause. IE: that you are very likely the person who bounced a check when buying diapers because it was signed by you and they have video camera footage of your purchase.

Or that you likely tried to commit insurance fraud because your car that you couldnt afford was conveniently totaled the day before it was supposed to be repoed.

If they can convince a judge of these two things with an affidavit, then the judge will grant them an arrest warrant. But this process is pretty similar with bench or search warrants as well.

The judge, however, may put restrictions on the arrest warrant. Something like you can only be arrested between 6 a.m. and 6 p.m. or you cant be arrested if youre at work. But this all depends on the severity of the crime. Sometimes the bail amount will also be included in the warrant.

Obtaining a warrant doesnt usually take more than a day. However, it can take several days for a warrant to hit the system

As you can probably imagine, it doesnt take too much to rack up a wanted level or two in Cyberpunk 2077. In fact, its even harsher than Grand Theft Auto in the sense that harming just one civilian will typically see you earn a wanted star. Harming multiple will quickly see that number rise by another star, and things ascend very quickly from there if you start returning fire on any officer or NCPD drone that spots you.

Put simply, if you want the NCPDs attention then causing a riot on the streets is your best bet. Just mow down some civilians and then start fighting the NCPD. There are four wanted levels, and if youre trying to reach the max level then youll definitely need to start an all-out war with the NCPD. Killing civilians only doesnt seem to raise the level beyond 3.

As for how to lose wanted stars quickly, well, heres where Cyberpunk 2077 is comparatively more forgiving than GTAV. All you really need to do is run away from their line of sight, which you can see quite clearly on the mini-map .

As soon as you start losing the police youll see the wanted stars begin to flash, which means theyre losing track of your position. And triggering this effect really doesnt take too much effort just keep moving away from their location quickly. You can summon your vehicle to make a quick escape if necessary.

What Should I Do If I Have An Active Warrant

If a person discovers that he/she is named in a warrant, it is critical for the party to immediately contact an experienced criminal defense attorney.
