    Finding The Descriptions Of Crimes For Different Penal Code Sections

    Police records usually refer to penal code sections in describing crimes police are investigating.

    For example, section 187 of the penal code is for homicides.

    How can you find out which crimes the various sections of the state penal code stand for?

    What Is A Police Report

    People file a police report with law enforcement for a wide variety of reasons such as domestic disputes, traffic accidents, burglaries, and home invasions, fraud, theft, stalking, violence, and many other reasons. To file a report, citizens usually begin by calling 911, or their local police departments non-emergency line, to report the incident.

    Once a citizen reports an incident, dispatchers assign it to local officers in the area. The police officers travel to the appropriate location via car, motorcycle, or other police vehicles. Then, the officers evaluate the situation, make observations, interview witnesses, record data, and complete forms and reports required by their local police department.

    Police officers also initiate the filing of a report to record the data and gather the details associated with criminal and civil incidents such as car accidents, burglaries, assaults, and robberies, just to name a few.

    Officers gather and record a great deal of information and data on a police report. This is to help ensure thorough and accurate investigations and to support criminal proceedings if they become necessary. Also, background verification services may use them in background checks. The information contained in the typical police report may vary from county to county, but most capture very similar information.

    How To Get A Police Report

    By law, certain police records and violation reports prepared and maintained by the Police Department are accessible to the general public.

    If you need to get a copy of a police report, do this. First, begin by researching the requirements of the police department responsible for the jurisdiction in which the incident occurred. Then, follow the departments exact protocol for requesting and receiving those records. Start by checking the police departments website. Expand your search to the city website if you dont find anything on the police departments website.

    Obtain and Fill Out Request Forms

    Some departments may require that you complete a request form, sometimes called a request for public records. This may also be known as a request for open records. When you check the department website, look to see if you can download the request form from their site. If so, fill out the request form and submit it according to the directions.

    Most request forms will require you to provide the first and last name of at least one of the involved parties. In addition, youll need the location, date, and time of the incident, and in some cases, the incident or case number.

    After submitting the report, a temporary number will be automatically sent to you by email. All communication will be done by email. Your report will be reviewed and if any changes are required, you will be sent a request for changes. Once the report is corrected and approved, you will receive an official event number by email, as well as a PDF copy of the report.

    Make sure you have a valid email address as well as the date and location of the crime and information on the vehicle involved, if applicable.

    If you meet these criteria and the type of incident that occurred appears on the list above, you may file your report.

    What Happens After I File A Report

  • REPORT your crime online. After you complete your report you will see “Your Online Report Has Been Submitted.”
  • RECEIVE a temporary report. You will immediately be given a temporary transaction number. This is your confirmation number but not your official police report number.
  • APPROVAL of your report. If your report is approved, you will receive an email with the official police report number. This is the number you need to file with your insurance company.

    First: Do a Free limited search to see if the DMV has your report

    To see if your report is available in our system use ‘List Reports on File by Date’ to see a list of accidents by the county and date you select . The list of accidents will include the plate numbers of the vehicles involved in the accident.

    If there are reports you want, you will need to do a paid search before you can order them.

    Second: Do a ‘Paid’ search

    To search for your report use ‘Search by Plate Number, License Number, or DMV Accident Case Number’ .

    You will be charged a fee even if

    • you enter the incorrect information, or
    • if the report are not found

    Each search costs $7.

    Why Can’t I Report All Crimes Online

    • Only crimes that have no suspects, are not in progress and do not involve injury can be reported online.
    • Some crimes and incidents may require evidence collection or other investigative procedures requiring an officer’s involvement.
    • Among others, online reporting is NOT appropriate for the following crimes or incidents:
    • Incidents occurring within past 30 minutes
    • Violent crimes, completed or attempted
    • Sex crimes
    • Theft or loss of a firearm
    • Theft or loss of prescription drugs or other controlled substances.

    • Stolen license plate
    • Burglary of your home or business

    How to File a Police Report Online

    PART I CRIMES: The four crime types currently posted here Burglaries, Robberies, Aggravated Assaults and Homicides are among those known as Part I or Major Crimes. These terms refer to seven crimes designated by the FBI Uniform Crime Reporting System as a basis for charting crime trends across the United States. The seven crimes chosen by the FBI as Part I crimes are: homicide, rape, robbery, and aggravated assault, which comprise Violent Crimes and burglary, larceny/theft and vehicle theft, which comprise Property Crimes.

    People sometimes confuse the criminal behavior involved in a burglary versus a robbery. They may also not realize there is a difference between aggravated assaults and less serious assaults. The official FBI definitions of the crime types posted here are, as follows:

    BURGLARY: the unlawful entry of a structure to commit a felony or theft.

    ROBBERY: taking or attempting to take anything of value from another person by force, threat or force or violence and/or by putting the victim in fear.

    AGGRAVATED ASSAULTS: an unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury. This type of assault is usually accompanied by the use of a weapon or by other means likely to produce death or great bodily harm.

    What Types Of Crime Reports Can I See

    General Offense Reports in PDF format are available for almost all crimes reported to SPD. These reports are made available within 8 hours after the event is closed. For the major crimes of Burglaries, Robberies, Aggravated Assaults and Homicides, additional information is made available through a redacted full narrative. These reports are available within 5 business days after the event.

    Request An Accident Report Online

    Most accident reports written by the Walnut Creek Police Department can be obtained online. However some may not. Reasons an accident report may not be available online are:

    • The accident did not occur in the jurisdiction of the Walnut Creek Police Department.
    • There were serious injuries and/or a fatality as a result of the accident.
    • There was a crime associated with the accident report.
    • The report is not complete.
    • The report cannot be released by applicable laws.

    Reports are typically available within 5 to 10 days. If the report is not available online after 10 days, please contact the Walnut Creek Police Records Division at 925-943-5890.

    Cost of an online accident report is $5.00, which is paid directly to Lexis Nexis.

    The Walnut Creek Police Department reserves the right to restrict the availability of online accident reports.

    Georgia Criminal Background Checks

    The Criminal background checks are a review of an individuals history to determine any criminal activity within the State of Georgia. Background checks are $15.00.

    In order to obtain a criminal background check, you may appear in person at the Cobb County Police Department Central Records, or send a request form by mail. Please refer to the request form for more instructions. A valid form of identification is required.

    How Long Will My Report Take To Process

    • Normally, you will receive a response from the CORP reviewer within five business days.
    • In the meantime you will be given a temporary transaction number to document your submission. This temporary number is NOT your police report number.
    • Once your report has been reviewed and approved, your report number will be issued to you by email.

    If you have already filed a report and realize you need the report approved quicker than 5 days – you can do that by calling the non-emergency number 206-625-5011 and asking to file the report with the Communications Section.

    Be sure to tell them you have already filed the same report through the online reporting system, and give them the temporary transaction number you were provided when you filed the report online so they may include it in the narrative of your report.

    Will My Case Be Investigated

    Police Report Vs Police Record

    First, lets clarify something that is bound to cause some confusion: the difference between a police report and a police record. While these two items have similar names, they are in fact very different. A police report is a document filed by a police officer that essentially offers a summary of an arrest, incident, or accident. A police record, on the other hand, is usually the same as a criminal record and it includes a list and summary of an individuals history of interactions with law enforcement, including arrests and convictions.

    Another point that deserves clarification is the difference between a police report and an accident report. In fact, theres not really a difference between these two items. An accident report is simply a type of police report that details the circumstances of a traffic accident. A police report, meanwhile, can include accident reports, but they cover a much broader range of incidents that may involve the police, including crimes.     • This is not an Emergency
    • The incident does not involve personal violence nor a hate crime
    • You must have a valid email address to use this system. Your email address will not be used for any other purpose.
    • There are no known suspects – either person or vehicle – and there is no visible physical evidence at the scene
    • If the incident occurred on a provincial highway or outside the Saskatoon Police Service jurisdictional limits – refer to the FAQ.
    • Only the below types of reports are allowed to be completed online – see definitions for each type.
    • Reports may not be filed on behalf of a 3rd party except in the case of children. Reports must be filed by the actual complainant, owner or authorized representative.
