Dont Try To Beat A Breathalyzer At The Station

The Intozilyzer 8000 is also more advanced than the PBT in that it allows the law enforcement operator to determine if the subject is actually blowing air into the machine. This breathalyzer tells the operator exactly when enough breath has been blown to obtain deep lung air, and the result is printed out on a paper, not just displayed on an LED display.

Often someone will try to beat a breathalyzer by blocking the machines straw with their tongue, or blowing air out between their cheeks and the straw. The Intoxilyzer 8000 actually has an audible buzzer that indicates when a proper breath sample is being blown into it. So if youre trying to beat the machine, it will tell the operator what you are doing. The machine also determines when deep lung air is achieved and takes the sample itself, instead of the officer pressing a button, as with the PBT. Essentially, the Intoxilyzer 8000 takes the human error out of the equation and allows the breathalyzer to do almost everything.

Use Of Preliminary Breath Test Or Preliminary Alcohol Screening Test In The United States

In the US, the primary use of preliminary breath test or preliminary alcohol screening devices is for screening and establishing probable cause for arrest, to invoke the implied consent requirements.

In US law, this is necessary to sustain a conviction based on evidential testing . In order to sustain a conviction based on evidential tests, probable cause must be shown . Police are not obliged to advise the suspect that participation in a FST or other pre-arrest procedures is voluntary. In contrast, formal evidentiary tests given under implied consent requirements are considered mandatory.

Refusal to take a preliminary breath test in the State of Michigan subjects a non-commercial driver to a âcivil infractionâ fine, with no violation âpointsâ, but is not considered to be a refusal under the general âimplied consentâ law. In some states, the state may present evidence of refusal to take a field sobriety test in court, although this is of questionable probative value in a drunk driving prosecution.

Different requirements apply in many states to drivers under DUI probation, in which case participation in a preliminary breath test may be a condition of probation, and for commercial drivers under âdrug screeningâ requirements. Some US states, notably California, have statutes on the books penalizing preliminary breath test refusal for drivers under 21 however the Constitutionality of those statutes has not been tested.

How Does The Intoxilyzer 5000 Work

The Intoxilyzer 5000 is a very technical device. It has a computer display that informs the police officer who operates the machine of its status, and provides information about the progression of the testing process.

The way that the Intoxilyzer analyzes a breath sample is complicated. The machine first conducts a primary diagnostic where it does a self-check to let the officer know it is working properly. Next, the machine calibrates itself by taking a reading of a pre-determined alcohol-based solution of which the percentage of alcohol is known. If the machine reads the alcohol content of the test solution correctly, it moves on to the third stage called an air blank. In this stage of the testing process, the machine clears itself of the calibration solution to ensure that the sample taken from the driver is not affected by any alcohol left in the machine from the calibration process. In the last stage of the testing process, the machine analyzes the actual breath sample from the driver. The driver is told to blow into the machine until they have provided an adequate sample. When an adequate sample has been collected, the machine indicates this and the driver is told to stop blowing by the officer operating the machine. The sample is then analyzed and the four steps discussed above are repeated automatically. The machine produces a final print out of the results, and tabulates a correlation between the BAC reading of the two samples taken.

What Breath Test Machines Are Used In California

California is an unusual state, because it has a lot of different jurisdictions that all get to choose what instruments for breath tests or blood testing machines they want to use. We have just about every manufacturer and every machine used throughout the state of California, and various agencies use different evidentiary tests within just the county of Los Angeles.

Someone who was in the city of Los Angeles would be taken to the Los Angeles Police Department and given a breath test on the ECIR-II breath testing machine. Somebody who was in the county of Los Angeles, would be taken to a sheriffs station or maybe a CHP station and/or one of the local police stations like the Beverly Hills Police Department, and they would be given a breath test on a Data Master DMT machine which would be maintained by the sheriffs department.

Other cities, such as the Long Beach Police Department, have their own crime lab and their own breath testing machines, the Intoxilyzer 5000 machines. Just in LA County alone, various stations would be using various machines from various manufacturers, and different police departments would also use different breath testing instruments out in the field.

There is a lot of variability, and it would be important to know what machines were being used so the attorney would know what analysis was being done. The attorney would know what questions to ask and what evidence to get to properly interpret what was going on in a particular persons case.

When Is A Breathalyzer Or Intoxilyzer Test Performed

The police will make a breath demand when a person is exhibiting obvious signs of impairment. For example, when a person who is flagged over by a R.I.D.E. program is slurring their speech, there is an odour of alcohol on their breath, they are unsteady on their feet and they are driving badly the police will make a breath demand. In this situation, the police would not have to provide him or her with an approved screening device demand. They would likely immediately arrest the person, based upon reasonable and probable grounds that their ability to operate a motor vehicle is impaired by the previous consumption of alcohol.

Upon arrest, the police officer would then read a formal demand to provide breath samples at the police station. Again, this is a completely different situation from an approved screening device demand. It is not necessary for the police officer to go through the approved screening device demand procedure if they have reasonable and probable grounds that the person is impaired upon observation. Merely exhibiting an odour of alcohol and perhaps bloodshot and glassy eyes would only lead to a suspicion that the person had been drinking and had alcohol in their system It would not lead to reasonable and probable grounds that they are impaired or over the legal limit.

How Do You Calibrate A Breathalyser

In order to perform calibration technician needs to set a breathalyzer to the calibration mode, it is done with the use of specially designed pin tools. Next it is connected to calibration devices. During this process air in quantity similar to a human exhalation with predefined alcohol content is pumped into it.

Infrared Analysis Vs Fuel Cell Technology

Breathalyzer machines used by police are error

Infrared breath tests such as the Intoxilyzer 5000® are a very common type of breath test technology but are not the only type. Fuel cell technology is also frequently utilized to measure an individuals blood alcohol content. The different testing procedures work in different ways. For example:

Infrared Instruments are the most commonly used breath tests because they are stable and reliable and may be automated. The theoretical basis for IR tests are based on the Beer-Lambert Law of Absorption, which demonstrates that molecules absorb electromagnetic radiation at their own specific unique wavelengths. Each molecule has its own infrared fingerprint, including Ethyl Alcohol, which absorbs radiation at wavelengths of approximately 3.0, 3.39, 7.25, 9.18, 9.50 and 11.5. Because no other compound absorbs radiation at all of these wavelengths and only at these wavelengths, a greater absorption of these wavelengths means a higher concentration of alcohol exists. When an IR test is performed, an individual breathes into a sample chamber and an IR energy beam emerges. Energy loss at the appropriate wavelengths is then measured to determine the level of absorption and thus the amount of alcohol that is present. IR tests are generally performed at police stations and are stationary units.

A Portable Breath Test Is A Type Of Field Sobriety Test

Portable breath machines are not sophisticated instruments, like an infrared spectroscopy device. A simple electrochemical detector, coated on one side of a small plate, will react with alcohol molecules in a persons breath. Using a software algorithm, the fuel cell counts the molecules that stick, and then generates a numeric result that is displayed, but is not supposed to be stated or shown on camera. Essentially, the more alcohol molecules that reach the plate of the fuel cell, the higher the reading.

All the Georgia preliminary breath test machines use a fuel cell to measure positive ions on a small, coated plate which is about the size of a dime. A narrow, hollow, plastic collection tube leads to the sample chamber, and about 5 seconds of forcible blowing is all that is needed to get a reading. The objective is to reach your deep lung air, and thereby get the reading that will be closest to your true blood alcohol content.

Other Causes Of False Positives

If you have been pulled over and charged with a DWI in Rochester, and you absolutely dispute the accuracy of the Breathalyzer Test administered to you, it is important to consider whether any of the following might have led to the questionable results offered by the test.

Ethyl alcohol, found in alcoholic beverages, is similar to Methyl alcohol, which is found in breath molecules. Acetone, found on the breath of Diabetics and those on low-calorie diets, can cause a false positive. High protein diets release more ketones, also resulting in false positives.

Blood, alcohol, or vomit present in the mouth can lead to a false positive, as can temperature fluctuations. Both human and ambient temperatures can cause some interference. Police radios, mobile phone, dirt, and moisture can all affect a Breathalyzer Test. Even smoking a cigarette, vigorous physical activity, and intense anxiety can affect the results . Some reports have shown that drinking tea and eating ice cream can also result in false readings.
