Use Of Preliminary Breath Test Or Preliminary Alcohol Screening Test In The United States
In the US, the primary use of preliminary breath test or preliminary alcohol screening devices is for screening and establishing probable cause for arrest, to invoke the implied consent requirements.
In US law, this is necessary to sustain a conviction based on evidential testing . In order to sustain a conviction based on evidential tests, probable cause must be shown . Police are not obliged to advise the suspect that participation in a FST or other pre-arrest procedures is voluntary. In contrast, formal evidentiary tests given under implied consent requirements are considered mandatory.

How Does The Intoxilyzer 5000 Work
The Intoxilyzer 5000 is a very technical device. It has a computer display that informs the police officer who operates the machine of its status, and provides information about the progression of the testing process.
The way that the Intoxilyzer analyzes a breath sample is complicated. The machine first conducts a primary diagnostic where it does a self-check to let the officer know it is working properly. Next, the machine calibrates itself by taking a reading of a pre-determined alcohol-based solution of which the percentage of alcohol is known. If the machine reads the alcohol content of the test solution correctly, it moves on to the third stage called an air blank. In this stage of the testing process, the machine clears itself of the calibration solution to ensure that the sample taken from the driver is not affected by any alcohol left in the machine from the calibration process. In the last stage of the testing process, the machine analyzes the actual breath sample from the driver. The driver is told to blow into the machine until they have provided an adequate sample. When an adequate sample has been collected, the machine indicates this and the driver is told to stop blowing by the officer operating the machine. The sample is then analyzed and the four steps discussed above are repeated automatically. The machine produces a final print out of the results, and tabulates a correlation between the BAC reading of the two samples taken.

What Breath Test Machines Are Used In California
California is an unusual state, because it has a lot of different jurisdictions that all get to choose what instruments for breath tests or blood testing machines they want to use. We have just about every manufacturer and every machine used throughout the state of California, and various agencies use different evidentiary tests within just the county of Los Angeles.
Someone who was in the city of Los Angeles would be taken to the Los Angeles Police Department and given a breath test on the ECIR-II breath testing machine. Somebody who was in the county of Los Angeles, would be taken to a sheriffs station or maybe a CHP station and/or one of the local police stations like the Beverly Hills Police Department, and they would be given a breath test on a Data Master DMT machine which would be maintained by the sheriffs department.
Other cities, such as the Long Beach Police Department, have their own crime lab and their own breath testing machines, the Intoxilyzer 5000 machines. In this situation, the police would not have to provide him or her with an approved screening device demand. They would likely immediately arrest the person, based upon reasonable and probable grounds that their ability to operate a motor vehicle is impaired by the previous consumption of alcohol.
Upon arrest, the police officer would then read a formal demand to provide breath samples at the police station. Again, this is a completely different situation from an approved screening device demand. It is not necessary for the police officer to go through the approved screening device demand procedure if they have reasonable and probable grounds that the person is impaired upon observation. Merely exhibiting an odour of alcohol and perhaps bloodshot and glassy eyes would only lead to a suspicion that the person had been drinking and had alcohol in their system It would not lead to reasonable and probable grounds that they are impaired or over the legal limit.

A Portable Breath Test Is A Type Of Field Sobriety Test
Portable breath machines are not sophisticated instruments, like an infrared spectroscopy device. A simple electrochemical detector, coated on one side of a small plate, will react with alcohol molecules in a persons breath.
