How To Access Your Police

Michigan State Police Search, Seize Records From Home Of Chatfield’s Former Chief Of Staff

Members of the public have the right to request records containing their personal information from the Ontario Provincial Police or a municipal police service. Individuals who make these requests may have, for example, played a role in a suspected offence, been involved in a call for service or some other police-attended incident or had a relative who died in circumstances that led to the involvement of a police service.

Someone else, such as a lawyer or other person acting on your behalf, may make the request for you, or you may do so yourself. You may file a request by submitting a form and paying a fee, either by mail or in person.

Commonly requested records include:

  • officers notes and
  • police-related 911 calls.

Many people think that they cannot request a police officers notes, but a police notebook is generally in the custody or control of the police service and is subject to freedom of information requests.

Requesting information from a police service follows the same process as asking for records from other types of government institutions. However, the nature of police-held information means that frequently some of these records or some passages within these records are exempt from disclosure under Ontarios access to information legislation.

In all cases, if you disagree with a police services decision to deny your access request in whole or part, you may file an appeal with our office.

Who Is My Criminal Record Visible To

The RCMP criminal records database is not accessible to the public but is visible to authorized persons.

Friends, colleagues or neighbours cannot check up on you but many figures of authority can, including:

  • Border security officers
  • Police officers
  • Businesses

This means that, unless you can successfully seal the record, employers, insurers, and immigration officials can run a criminal record check.

If they do conduct a name check, details of any charge or conviction from your past will be visible, no matter how distant.

An employer is entitled to use this information when considering a job application and, in many cases, it will count against you.

This is a particularly common practice in some sectors more than others, including:

  • Government agencies
  • Volunteer organisations
  • Any work involving children

You can see how this could affect your career but there are other potential consequences too.

A border official may refuse a visa application or an insurer may choose to refuse your insurance application, all because of a criminal incident from 20 years ago that you were found not guilty of.

The potential consequences of a criminal record are far-reaching and serious, as you can see.

How Do I Get A Copy Of A Police Report

Police investigations may seem secretive, but did you know you can get your hands on a copy of an official police report? Whether youve been in a car accident, youve witnessed a crime, or you simply want to know about an incident that happened in your jurisdiction, there are steps you can take to request access to police reports.

The exact process may vary by jurisdiction, but it is generally the same across the country. Agencies have different policies for releasing sensitive information that is in police reports, so be sure to check with your local police department to confirm how they handle requests. As you are researching, you may find the request titled a Freedom of Information Request or a Public Access Request. Different areas use varying language, but they both mean the same thing and are referring to the Freedom of Information Act , which makes it entirely legal for citizens to request certain government information.

Reports will include details of the incident, where it took place, who was involved, witnesses, and much more essentially, it is anything that is even remotely relevant to the case. But keep in mind, you will not be able to receive a copy of a police report until after the police investigation has been closed.

So, how do you get a copy of this information? Check out the steps below.

A traffic violation will not be stored in a criminal record, unless there will be a trial. Normally the traffic fine is given by a police officer, and the payment is generally done by banking. There will not be a trial, nor an addition in a criminal record. In case of sexual crimes the criminal record will be destroyed after 80 years.

    What Is A Background Check

The police collect, retain, and use a wide variety of information about the individuals whom they come into contact with. These records are maintained and stored in a variety of databases. Each database does not necessarily contain the same information.

Police services have wide discretionary powers about the type of information that is stored and released about individuals. Generally speaking, there are three types of record checks that may be requested, which become progressively more expansive and intrusive.

    • Criminal Record Checks CRCs disclose criminal convictions referred to in RCMP or local police databases. CRCs will also include findings of guilt under the Youth Criminal Justice Act within the applicable disclosure period.

Generally, a CRC is released to the subject matter of the check . That person may provide the results to the relevant prospective employer, volunteer agency or other requesting organization.

    Where To Find Police Records

First off, if you are or were a criminal and have a criminal record, you are entitled to a copy of that record thanks to the Freedom of Information Act. As stated earlier, police records are a matter of public record, therefore they are available for free access to the public. The Freedom of Information Act states that any person has the right to request access to federal agency records or information, except for exemptions that are listed. This means that anyone in the U.S. can request basic information that is considered public record, such as voter’s registration, property deeds, or criminal records.

The U.S. system of recording and storing these police records isn’t always the easiest to navigate. Records can have issues crossing state lines, which is why it’s important to find a database that checks all states and compiles the findings. A lot of people say the U.S. should make it easier and have all records in one pool, but that’s just not how things are done.

Police records are recorded in the states where such crimes occur, then are voluntarily submitted to federal databases for access. Not all crimes are recorded and submitted in this manner though, which is what leads to contrary records. With the CheckPeople search we are able to look through all sources of information quickly so you will be able to save a bunch of time on your search.

    Warrant And Capias Information

Q: What is the difference between a warrant and a capias?

A: A warrant is an order which authorizes a law enforcement officer to arrest and bring a person before the judge. A warrant may be issued when a person is charged with a crime, convicted of a crime but failed to appear for sentencing, owes a fine or is in contempt of court. A capias is also an order for arrest of a person, typically issued by the judge or magistrate in a case. It is commonly issued after a defendant fails to attend a scheduled court hearing.

Q: How do I know if I have an outstanding warrant or capias?

A: Respond to any Police District or ask an officer on the street to run a query on your social security number. You should provide some type of identification, if possible. To protect your privacy, police will NOT run a query if you simply call a district on the telephone.

Q: If there is an outstanding warrant or capias, will I be arrested on the spot?

A: Most capiases allow an officer to re-cite, meaning you will be given a new court date. However, if you have been re-cited numerous times and have continued to ignore the court date, the officer may choose to physically arrest you. Most warrants require an officer to physically arrest the person. Once you are re-cited or processed through the Hamilton County Justice Center, the warrant/capias is cancelled by the Hamilton County Central Warrants Department .
