Are Police Reports Admissible In Court

While police reports are commonly used in car insurance settlement negotiations, admitting a police report as evidence when you file a car accident lawsuit is not quite as clear cut.

In small claims courts, litigants are usually permitted to use police reports as evidence in their car accident case. You will not be expected to know all the rules of evidence, so judges typically will allow plaintiffs and defendants to use the police report in explaining what happened.

If your car accident case goes to trial in your states court of general jurisdiction , you should know that parties in these cases are held to the rules of evidence and must contend with whether the police report falls within the rule against hearsay evidence, which keeps out many out-of-court statementsby definition, any assertion made in a police report is a statement that was made out of court.

In some jurisdictions, the police report may fall within the public records or business records exception for admissibility. In other jurisdictions, different exceptions to the hearsay rule may apply and allow you to admit some or all of the police report as evidence.

Why Are These The Only Crimes Shown

With the Police Reports Map and 9-1-1 Response Map, SPD is making almost all of our reports available online. The Department attempted to be very thoughtful about what information was released and what was not. These decisions were not made to hide types of crimes from the public, instead decisions were made about who to protect.

The only reports that are not being released under this system are when the rights of the victim, age of the victim, possibility of revictimization or overall public safety/security issues take clear precedence over the public right to know.

Information on Rape and other sexual offenses, Domestic Violence, Child Abuse, Kidnapping, Suicides, locations that are sensitive , Homeland Security issues and tactical information that might compromise the safety of our officers are not being released in this system.

If the event is one of the many types we do show, but the location code was entered into the system incorrectly, the location of the event cannot then be verified. In this scenario, this particular event will not appear on the map at all, rather than providing possibly misleading information.

Car Crashes Causing Death

If the accident involved a fatality, the Arizona Crash Report will have a fatal supplement. It will list the name of the victim, the victimâs address and physical description. It will also list where the victim was removed to and who he was removed by. This may be identified by the MCMEO, Maricopa County Medical Examinerâs Office . The fatal supplement will list the date of death, time of death and whether the victim was deceased at the scene or transported to a hospital. The fatal supplement will list any safety device failure, improper usage of a safety device, any ejection from the car or ejection path .

The supplement will list whether an air bag was available. It will also list an extrication supplement which details how the victim may have been extricated by ambulance attendant, by police, by fire department, etc. There is a section on the fatal supplement that will be completed if any driver is tested for alcohol/drugs. This will detail the alcohol test type, alcohol test results, and drug test results. The fatal supplement also contains information about the crash configuration and whether it is an underride / override. An underride crash configuration is when a car travels under a vehicle, lifting it up. An override configuration is when a vehicle ends up on top of another car. This section also lists whether the override / underride had a compartment instruction.

How To File A Police Report

If you are involved in an accident, you may need to call the police and file a police report. In most states, if an accident results in death or injury or property damage exceeds a certain threshold then by law you are required to call the police. That threshold can vary depending on whether or not the motorists involved in the accident are insured. In Illinois, for example, the property damage threshold at which police must be called to an accident is usually $1,500. However, if any driver involved in the crash is uninsured then that threshold is just $500.

Even if you think your accident doesnt meet the minimum threshold, it is usually still a good idea to file a police report. Thats because a police report is an official account of the accident and it can have a huge impact on your insurance claim. Remember that even if you call the police and the police dont come to the accident scene you can still visit the police department later and file a report there. Some police departments, such as the Los Angeles Police Department, even allow you to file police reports online so long as it relates to a non-emergency incident.

    Police Report Vs Police Record

First, lets clarify something that is bound to cause some confusion: the difference between a police report and a police record. While these two items have similar names, they are in fact very different. A police report is a document filed by a police officer that essentially offers a summary of an arrest, incident, or accident. A police record, on the other hand, is usually the same as a criminal record and it includes a list and summary of an individuals history of interactions with law enforcement, including arrests and convictions.
