What Is An Arrest Record

An arrest record, or arrest report, are the documents generated when law enforcement officers take an individual into custody. Generally, law enforcement will take a person into custody when the individual has an arrest warrant for a suspected crime. Law enforcement officers can make arrests without warrants if there is probable cause to take the individual into custody. In any case, the arresting officer must create an arrest report describing the circumstances surrounding the arrest. The arrest report will also contain information on the outcome of the arrest, such as court arraignment. An arrest record can be a stand-alone document or part of a person’s criminal record.

Arrest records are one piece of the police records that are compiled by law enforcement. Although arrest records include police records, police records are not included in arrest records. Police records include police reports, police logs, and incident reports.

An arrest record alone cannot be used as a criminal record. This is because people arrested are not necessarily found guilty of their alleged crimes. Despite this, they may be arrested and imprisoned, meaning that both arrest records and inmate records can exist for a person eventually found not guilty. Generally, the arresting agency is the primary custodian for arrest records. In most cases, this is the police department or the sheriff’s office. Either way, arrest records are considered public records and are available upon request.

Did You Receive An Attend Letter

If you receive an “attend” letter after submitting your application, follow instructions.

Individuals are requested to “follow-up” and attend the Customer Service Unit for a variety of reasons. Follow-up requests may be related to:

  • submission of fingerprints to confirm or eliminate a criminal record associated to an applicants information
  • Failure to submit a self-declaration form if you have existing criminal conviction
  • submission of fingerprints for the Vulnerable Sector search to confirm or eliminate a pardon associated to applicants information.
  • A vulnerable sector check is conducted as part of a criminal record check. It is a search of records suspended sexual offences. The vulnerable sector check is national RCMP policy and requires applicants who have a combination of name and/or gender and/or date of birth as a pardoned/suspended sex offender to undergo fingerprinting to verify their identity. The vast majority of those fingerprinted will not have a pardoned/suspended sexual offence however fingerprinting remains a necessity as it eliminates the possibility of an offender changing their name to circumvent a criminal record. This is not an accusation of criminal activity or guilt fingerprints are used to confirm your identity only. Please see the RCMP website for more information.

NOTE: The above information cannot be discussed over the phone however the Police Information Check Unit will disclose this follow-up request when you attend.

How To File A Police Report

If you are involved in an accident, you may need to call the police and file a police report. In most states, if an accident results in death or injury or property damage exceeds a certain threshold then by law you are required to call the police. That threshold can vary depending on whether or not the motorists involved in the accident are insured. In Illinois, for example, the property damage threshold at which police must be called to an accident is usually $1,500. However, if any driver involved in the crash is uninsured then that threshold is just $500.

Even if you think your accident doesnt meet the minimum threshold, it is usually still a good idea to file a police report. Thats because a police report is an official account of the accident and it can have a huge impact on your insurance claim. Remember that even if you call the police and the police dont come to the accident scene you can still visit the police department later and file a report there. Some police departments, such as the Los Angeles Police Department, even allow you to file police reports online so long as it relates to a non-emergency incident.

Police Report Vs Police Record

First, lets clarify something that is bound to cause some confusion: the difference between a police report and a police record. While these two items have similar names, they are in fact very different. A police report is a document filed by a police officer that essentially offers a summary of an arrest, incident, or accident. A police record, on the other hand, is usually the same as a criminal record and it includes a list and summary of an individuals history of interactions with law enforcement, including arrests and convictions.

Another point that deserves clarification is the difference between a police report and an accident report. In fact, theres not really a difference between these two items. An accident report is simply a type of police report that details the circumstances of a traffic accident. A police report, meanwhile, can include accident reports, but they cover a much broader range of incidents that may involve the police, including crimes. Note that some police departments call police reports incident reports. Remember that some accident reports may also be criminal reports, such as if the accident may have been caused by drunk driving.
