Bringing Important Facts To Policing Debate
USA TODAY’s collection of police misconduct records began in 2016 amid a nationwide debate over law enforcement tactics, including concern that some officers or agencies unfairly were targetting minorities.
A series of killings of black people by police in Ferguson, Missouri, Baltimore, Chicago, Sacramento, California, and elsewhere had sparked protests and renewed anger about police targeting minorities and needlessly using force to subdue them.
The Trump administration backed away from more than a decade of Justice Department investigations and court actions against police departments it determined were deeply biased or corrupt. In 2018, then-Attorney General Jeff Sessions said the Justice Department would leave policing the police to local authorities, saying federal investigations hurt crime fighting.
Laurie Robinson, co-chair of the 2014 White House Task Force on 21st Century Policing, said transparency about police conduct is critical to trust between police and residents.
Its about the people who you have hired to protect you, she said. Traditionally, we would say for sure that policing has not been a transparent entity in the U.S. Transparency is just a very key step along the way to repairing our relationships.”
Today, the panel is a “paper tiger” organization, Cunningham said. A tiny fraction of cases result in discipline, and an even smaller fraction are available for public inspection.
How Do I Get Police Records

- File for record information through the county court
- Request the federal government for police records
Any time you request information from a government facility, they will have you fill out paperwork and pay the requested fees. It can take months, even years, to get the information.

What’s In A Criminal Record
Let’s break it down, an individual’s criminal record can consist of the following things:
- Arrest records
- Conviction Records
Keep in mind that some of these reports can be considered null and void if the criminal charges were dropped or if a person was found innocent of the crime. This will likely depend upon the jurisdiction. A criminal record will also have a list of crimes that a person was convicted of and the sentence. These include jail or prison terms served, time of probation served, parole grants, and even violation of probation or parole. A criminal record will also show any warrants for a person.

No one is in a position to assess whether an officer candidate can do the job well and the way that we expect the job to be done better than the officers former employer, Stoughton said.
Officers are public servants. They police in our name,” he said. There is a “strong public interest in identifying how officers are using their public authority.
Dan Hils, president of the Cincinnati Police Departments branch of the Fraternal Order of Policemen union, said people should consider there are more than 750,000 law enforcement officers in the country when looking at individual misconduct data.
The scrutiny is way tighter on police officers than most folks, and thats why sometimes you see high numbers of misconduct cases, Hils said. But I believe that policemen tend to be more honest and more trustworthy than the average citizen.
Hils said he has no issue with USA TODAY publishing public records of conduct, saying it is the news medias right and responsibility to investigate police and the authority of government. Youre supposed to be a watchdog.
The bulk of the records USA TODAY has published are logs of about 30,000 people banned from the profession by state regulators.
For years, a private police organization has assembled such a list from more than 40 states and encourages police agencies to screen new hires. The list is kept secret from anyone outside law enforcement.

Why Police Reports Matter
Police reports are public records and in some states they may be viewable by just about anybody. Usually there are restrictions on how those records can be used, particularly by employers, landlords, and financial institutions. As already mentioned, police reports are particularly usefuland they may even be necessarywhen filing a claim with your insurer. The contents of a police report are important, so you need to make sure that any police report pertaining to you is accurate and does not cast you in an unnecessarily bad light.

Police Records: The Basics
Though this may change on a case-by-case basis, logs of arrests and responses to incidents by the police, search warrants and coroner’s office reports are typically open to public inspection, while arrest and incident reports may be more difficult to obtain. State laws pertaining to the public’s access to police records and other public records vary across the U.S., too. In California, for instance, the California Public Records Act makes detailed arrest logs and certain information from incident logs public. Commonly, similar state laws make common-sense exemptions to public disclosure, granting law enforcement agencies the right to withhold information or documents that may jeopardize a criminal investigation or put someone at risk, for example. Information on juvenile cases is typically protected.
Because police don’t charge people with crimes , you won’t always find these documents available in the public court system. Unless charges have been filed, these records live at the precinct or in an external archive.
Police Department Request Form
If you cannot submit a police report request online or through the mail, then you will have to visit the police department in person and file a request there. Call beforehand since some departments only allow in-person requests on certain days. You can find your local police department here. Then you can find out about filling out a Police Department Request Form in person and how to get the information you need. Typically these police department request forms can be fulfilled that day.
A request will typically require you to provide your personal and contact information as well as details about the incident, including the type of incident, date, and who else was involved. Be aware that if the report pertains to an ongoing investigation then your request could be denied. If you are unclear about why your request was denied you should talk to an attorney.

- Due to the fact that information might change on a daily basis, checks of police records are only good for the day they were issued.
- They are nothing more than a snapshot in time. It is not up to the police to decide when a license will expire rather, that decision is made by the agency or company.
- Some may be willing to take a background check that is between three and six months old, while others may insist on a more recent one.
Warrant And Capias Information
Q: What is the difference between a warrant and a capias?
A: A warrant is an order which authorizes a law enforcement officer to arrest and bring a person before the judge. A warrant may be issued when a person is charged with a crime, convicted of a crime but failed to appear for sentencing, owes a fine or is in contempt of court. A capias is also an order for arrest of a person, typically issued by the judge or magistrate in a case. It is commonly issued after a defendant fails to attend a scheduled court hearing.
Q: How do I know if I have an outstanding warrant or capias?
A: Respond to any Police District or ask an officer on the street to run a query on your social security number. You should provide some type of identification, if possible. To protect your privacy, police will NOT run a query if you simply call a district on the telephone.
Q: If there is an outstanding warrant or capias, will I be arrested on the spot?
A: Most capiases allow an officer to re-cite, meaning you will be given a new court date. However, if you have been re-cited numerous times and have continued to ignore the court date, the officer may choose to physically arrest you. Most warrants require an officer to physically arrest the person. Once you are re-cited or processed through the Hamilton County Justice Center, the warrant/capias is cancelled by the Hamilton County Central Warrants Department .

What Can I Do If There Is Inaccurate Information On My Dbs Certificate
Your right to access does not cover criminal records checks for employment purposes, known as a DBS check . If a criminal records check is required for your work then your employer should explain how to apply for this appropriately.
If you have any concerns about the accuracy of personal data on your DBS certificate, you can raise this with the DBS. This could include incorrect personal details, incorrect conviction information or other discrepancies.
If the inaccuracy relates to an offence you did not commit, this would have to be raised with the local police force. If you are concerned about an entry in the Police National Computer record, you will have to raise this with ACRO.
For support and advice on criminal records, contact Unlock or NACRO.

What Type Of Records Do I Still Not Have Access To
The only records of police misconduct that you can access are those that fall under the three categories listed above: serious uses of force, sexual assault, and dishonesty related to investigations. Records of other types of police misconduct are still secret. Also, while you can access the records of investigation for serious uses of force regardless of whether the agency found that the use of force was wrong, for allegations of sexual assault and job-related dishonesty, you can only access those records if the agency determined that the officer was guilty of misconduct in violation of policy, and the time to appeal that determination has passed.4
In addition, the agency has the right to redact or withhold certain confidential information, like the names of witnesses, or the home address of the officer involved.5
