What Are Duis In Arkansas

DUI in Arkansas is a serious traffic violation which is interpreted typically as the willful disregard for public safety. Once a drivers state is impaired as a result of a higher blood alcohol content , this often results in damage to property, serious bodily injury, and death. As per Arkansas motor vehicle laws, traffic violations attract different kinds of penalties depending on the severity of the damage. Drunk driving or driving under the influence of an intoxicant often results in the driver getting points on their license. Accumulated points often result in temporary license suspension and the payment of fines and fees. However, most DUIs have penalties that include jail time.

The Arkansas Office of Driver Services is tasked with overseeing the process of tracking the violation point system and communicating warnings and proposed actions to drivers. Drivers who accumulate between 14 to 17 points risk a 3-month license suspension while 18 to 23 points may result in a 6-month license suspension and 24 or more points may lead to a possible 1-year license suspension.

Warrant And Capias Information

Q: What is the difference between a warrant and a capias?

A: A warrant is an order which authorizes a law enforcement officer to arrest and bring a person before the judge. A warrant may be issued when a person is charged with a crime, convicted of a crime but failed to appear for sentencing, owes a fine or is in contempt of court. A capias is also an order for arrest of a person, typically issued by the judge or magistrate in a case. It is commonly issued after a defendant fails to attend a scheduled court hearing.

Q: How do I know if I have an outstanding warrant or capias?

A: Respond to any Police District or ask an officer on the street to run a query on your social security number. You should provide some type of identification, if possible. To protect your privacy, police will NOT run a query if you simply call a district on the telephone.

Q: If there is an outstanding warrant or capias, will I be arrested on the spot?

A: Most capiases allow an officer to re-cite, meaning you will be given a new court date. However, if you have been re-cited numerous times and have continued to ignore the court date, the officer may choose to physically arrest you. Most warrants require an officer to physically arrest the person. Once you are re-cited or processed through the Hamilton County Justice Center, the warrant/capias is cancelled by the Hamilton County Central Warrants Department .

Why Am I Not Able To Obtain A Police Report

The most common reason why people cannot get a copy of a police report is because of an ongoing investigation. Once the case is closed, you should be able to obtain a copy.

If you believe you have been unfairly denied access to a police report, you may wish to have a lawyer speak to the authorities on your behalf. Juvenile records may sometimes be sealed or withheld to protect the privacy of the victim. Generally, though, the process to obtain a police report is relatively simple, depending upon who is trying to obtain the report.

Newspapers typically include a section on local happenings or local news. Frequently, traffic accidents are reported within the local section. Sometimes, an old article from a newspaper is an excellent source of information if you were a victim in the accident. For instance, the article may include the name of a witness to the accident or provide a description of the other driver or the vehicle in the case of a hit and run. If you have hit a brick wall trying to investigate an accident that happened weeks, months or even years ago, old newspaper articles may provide crucial information.

Locate the name of local newspapers. A simple Internet search should turn up the names of any newspapers that report on the city or town where the accident took place.

They are typically requested by the District attorneys office for state law enforcement agencies, and they are issued by judges or magistrates. Arrest warrants may also authorize the search and/or confiscation of the property of the arrestee. How Do Insurance Companies Use Police Reports

Off-Duty Chicago Police Officer Charged After Kneeling On Teen

After a car accident, when a claim is reported, the insurance company will conduct its own investigation. One of the first things that an insurance company will ask for is the police report. This is because, as we discussed above, the report contains a vast amount of information pertaining to the car accident.

Sometimes the insurance company and police officers opinions are different. This is why there are times when the police report is in your favor in terms of a fault determination, but the other drivers insurance company still denies your insurance claim.
