    Criminal Record And Judicial Matters Check

    This check is intended for people who require a criminal records check along with a search of outstanding entries and charges. Examples: Border crossing, Immigration, Taxi Licence, Employment .

    This check will show:

    • Every criminal offence of which the individual has been convicted for which a pardon has not been issued or granted
    • Every summary conviction if the request is made within 5 years after the date of the summary conviction
    • Every finding of guilt under the Youth Criminal Justice Act in respect of the individual during the applicable period of access under that Act
    • Any conviction for which a pardon has been granted if disclosure is authorized under the Criminal Records Act
    • Every criminal offence of which the individual has been found guilty and received an absolute discharge within 1 year after the date of the absolute discharge
    • Every criminal offence of which the individual has been found guilty and received an conditional discharge within 3 years after the date of the conditional discharge
    • Every criminal offence for which there is an outstanding charge or warrant to arrest in respect of the individual
    • Every court order made against the individual except: court orders made under the Mental Health Act or under Part XX.1 of the Criminal Code , court orders made in relation to a charge that has been withdrawn, restraining orders made against the individual under the Family Law Act, the Children’s Law Reform Act or the Child and Family Services Act

    Applicants Living Outside California/united States Must Submit Manual Fingerprint Cards

    Print out the Application to Obtain copy of State Summary Criminal History Record and follow the instructions on the form. A Spanish version of this form is also available . Please contact your local law enforcement agency for fingerprinting services. PLEASE NOTE: Your fingerprint card must contain your full name, date of birth, sex and return mailing address. If you are having difficulty in obtaining a blank fingerprint card, please contact the Record Review Unit at 227-3849.

    Manual submissions must be accompanied by either personal check drawn on a U.S. bank, money order or certified check. The check or money order must be made payable to the California Department of Justice. Mail your application, fingerprint card and processing fee to:

    Once you have received your Record Review response, if you want to challenge the contents of your criminal record, you must complete the âClaim of Alleged Inaccuracy or Incompletenessâ , which will be included with your Record Review response if there is criminal information on your record. Mail the completed form, along with a copy of your criminal history record, to the address indicated on the form. Your challenge must specifically state the basis for the claim of inaccuracy or incompleteness and include any available proof or corroboration to substantiate your claim.

    Do I Need A Criminal Record Check Or A Vulnerable Sector Check

    Police Criminal Background Checks

    Different employers or institutions require different types of background checks.

    A criminal record check simply verifies whether or not you have a criminal record.

    A vulnerable sector check is a special type of criminal record check required for situations where you will be in a position of trust or authority over children, the elderly, the disabled, or another vulnerable group.

    A vulnerable sector check involves a name-based search of the national repository of criminal convictions, a search of locally held convictions at Halifax Regional Police and a query of the pardoned sex-offender database. In some cases, you may be required to submit your fingerprints if there is a match based on either your name or a combination of your gender and date of birth to a pardoned sex offender record. Applicants with a potential match will be contacted by Halifax Regional Police and asked to come to Police Headquarters to have their fingerprints taken electronically. You can have your fingerprints taken Monday to Friday between 8:30 a.m. to 4 p.m.

    Dishonorable Discharge From The Military

    Military service and law enforcement are relatively similar career paths, and as such, they follow many of the same standards. Because of this, many employers and agencies value a candidates past military service. However, dishonorable discharge from the military is one of the top police background check disqualifiers. A dishonorable discharge occurs when an active member of the military commits a serious offense, such as an act of violence or desertion. This offense carries over into a law enforcement career, and agencies may automatically discard a candidate who has received this sentence.

    The standard pre-employment, pre-volunteer check for the Regina Police Service is the Police Information Check.

    Standard Police Information Check/Criminal Record Check The standard police information check includes in addition to a CPIC criminal record search, a check of the local indices of the Regina Police Service. The following information, if applicable, shall be included in the letter:

    • All printable and non-printable convictions with respect to the subject which are found in the local records of the agency performing the Criminal Occurrence Security Check.Note: There is no time limit on the inclusion of convictions, other than what is stated in the Youth Criminal Justice Act for youth records, and in the Criminal Records Act for offences for which pardons have been granted and not revoked, absolute discharges, and conditional discharges.
    • If someone has to be printed to confirm a criminal record in the National Repository, they will additionally receive a Certified Criminal Record from the National Repository in Ottawa.
    • Apprehensions, orders, or other matters related to The Mental Health Services Act or to The Youth Drug Detoxification and Stabilization Act will not be disclosed.

    In some cases, an organization may require a person obtain only a Certified Criminal Record Check or in addition, a Certified Criminal Record Check from Ottawa confirmed by prints. The standard Federal form is used to consent and print and can also be done by the Regina Police Service.

    How Do I Apply

    You can apply on line using two pieces of government issued identification through this website.

    Navigate to the Police Background Check application form in blue below and click on the link to get started.

    Provide any other names used that you may use in the appropriate box.

    Provide proof of a permanent address within the Niagara Region.

    All police record checks are processed on a first come, first served basis. The turnaround time is two weeks for all application types.

    We are processing most Records checks on-line only at this time. If you experience a failed authentication notice while processing your request on -line someone from the Records Office will contact you within 24 hours to continue processing your request.

    Record Checks For People Living Outside Of Canada

    Background Checks and Criminal Records

    The Waterloo Regional Police Service does not provide police record checks to people living outside of Canada. If you live out of the country, and need confirmation that you have no criminal record in Canada, you may obtain a copy of your Canadian Criminal Record through the Royal Canadian Mounted Police .

    How To Apply For A Criminal Record Check In

    You can apply in-person for a criminal record check Monday to Friday between 8:30 a.m. to 4 p.m. at the following location:

    You must present two pieces of identification with your current address. The address must be within Halifax Regional Municipality. Accepted identification includes:

    • and one other of:
    • passport
    • social insurance number card

    If you are a new resident to the Halifax-area and you ID has your old address on it, you must bring some form of proof of residence, e.g. a tenant agreement.

    The results of your criminal record check will be shared with you and then you can decide whether you want to share it with the organization requesting the check. Halifax Regional Police wont share the results of the criminal record check without your consent.

    Get A Copy Of Your Police Records

    You have the right to ask for a copy of records the police have about you. This is called a subject access request.

    You might need a subject access request if you move to another country.

    A subject access request has records from:

    • police forces in England, Wales, Northern Ireland, Jersey and the Isle of Man
    • the British Transport Police

    When And Why Are Police Record Checks Used

    How Long Does a Police Background Investigation Take ...
    • A PRC may be required by law or organizational policy
    • A PRC may be a useful tool to help determine an individuals suitability for certain types of opportunities
    • PRCs are just one of the tools available, in addition to interviews, reference checks, verification of credentials/licences/certifications, and in some cases, more thorough background checks
    • Agencies can only require an applicant to apply for one of the three types of PRCs and are not permitted to ask applicants to provide any additional police records

    Did You Receive An Attend Letter

    If you receive an “attend” letter after submitting your application, follow instructions andcall 3-1-1 for an appointment at Westwinds location only.

    Individuals are requested to “follow-up” and attend the Police Information Check for a variety of reasons. Follow-up requests may be related to:

    • submission of fingerprints to confirm or eliminate a criminal record associated to an applicants information
    • submission of fingerprints for the Vulnerable Sector search to confirm or eliminate a pardon associated to applicants information. Please see the RCMP website for more information:
    • to deal with outstanding warrant on the National Police Computer System
    • disclosure of police related relevant occurrence report
    • Failure to submit a self-declaration form if you have existing criminal conviction

    NOTE: The above information cannot be discussed over the phone however the Police Information Check Unit will disclose this follow-up request when you attend.

    Important Vulnerable Sector Search Criteria: After May 31, 2017, applicants who have made application for a Police Information Check and fingerprinted for a Vulnerable Sector Search by the Calgary Police Service with a negative result to a pardoned sex offender file will not be required to re-submit fingerprints for 4 years.

    How Can I Get A Criminal Record Check From Canada

    The Royal Canadian Mounted Police is in charge of issuing Criminal Record Checks. During your application, you may or may not be required to provide your fingerprints. It all depends on the amount of information you can provide about yourself. The police decide whether or not thats sufficient to distinguish you from someone else of similar name/date of birth etc. OR if there is, indeed, a criminal record to verify.

    Heres where to start:

  • Contact your local police station and enquire about applying for a Criminal Record Check. Check the RCMP website for more details
  • If you are required to provide fingerprints, you will receive a Certified Criminal Background Check
  • If there is NO criminal record, expect to receive your document within just a couple of days
  • Once you have your document. You must have it notarized by a local solicitor, notary public or Canadas Commissioner of Oaths
  • Have your document authenticated by the aptly-named Authentication Office of Global Affairs, in Canada
  • Finally have the doc authenticated, once more, by the Chinese Embassy of Canada
  • IF you are living outside of Canada, you can obtain your Electronic Criminal Record Check through your local Canadian Consulate or Embassy or. Alternatively, through a third-party Canadian agency.

    Disclosure Of Youth Records

    How can I get my Local Police Records Check done?

    This is one of the most significant changes to record checks in Ontario. Youth records are only permitted to be disclosed in two circumstances:

  • To the youth themselves, who is not permitted to further disclose Findings of Guilt and must remove any results from the record check before sharing with agencies or
  • To the Government of Canada or the government of a province or a municipality for purposes of employment or the performances of services, with or without remuneration
  • Only federal, provincial and municipal government agencies will receive youth records.

    The PRCRA regulates how police services release Police Record Checks containing youth records to applicants. Up until now, police services have released a PRC containing youth records directly to the applicant who then provide the PRC to the organization or volunteer agency. The federal and provincial government has found this approach to be contrary to the Federal Youth Criminal Justice Act .

    The only authorized release of a PRC containing youth records will be to a federal, provincial or municipal government. Applicants can gain access to their own record through the Federal Access to Information process but this record is not a PRC and is not allowed to be shared with any other agency.

    Police services are unable to disclose whether or not there is a youth record.

    Once youve finally secured your certificate, youll need to get it notarized and authenticated by the local government and then have it legalized by a Chinese Government.
