I Have a Criminal Record, How Do I Get A Job?

Victoria Police provides fingerprinting services at various locations throughout Victoria. We provide two types of fingerprinting services â Livescan and Ink. Please ensure you select the appropriate service for the fingerprints you need. We are unable to accommodate wrongly booked services.

Livescan

Residents of Victoria requiring a national name and fingerprints records check will need to make an appointment to have Livescan fingerprints taken. Fingerprints are taken electronically and copies of the fingerprints will not be provided.

Once the check has completed, Victoria Police will issue a national name and fingerprint certificate. Common purposes that require Livescan fingerprinting include:

  • Victorian Security Licence
  • Victorian Armed Guard/Cash in Transit
  • Victoria Police Contractor

Victoria Police can provide sets of Ink fingerprints for the following purposes:

  • Immigration/Visa/Passport
  • Employment/Other

Please check with the requesting agency whether the ink fingerprints need to be taken on a specific form. We will be unable to offer a refund if the fingerprints are rejected due to the form being incorrect. We do not keep other countries/agencies forms on hand.

Each applicant will need their own appointment. The number of sets in a booking is for one applicant. If you are booking for more than one person, please ensure they are booked separately.

The sets of fingerprints will be given to you at the conclusion of your appointment to take away.

What Is The Crra And Crrp

The Criminal Records Review Act ensures that people who work with or potentially have unsupervised access to children or vulnerable adults undergo criminal record checks by the Criminal Records Review Program . The CRRP is for provincially funded, licensed, or contracted organizations. The program accesses the Criminal Records Review Unit for searches of law enforcement databases to contribute to CRRA checks and the decisions made by the CRRP.

Upon adjudication by the Deputy Registrar, a person who is found to present a risk of physical or sexual abuse to children or a risk of physical, sexual or financial abuse to vulnerable adults will not generally have access to these groups.

To support British Columbias non-profit sector, volunteer organizations that have volunteers working with children or vulnerable adults, can have criminal record checks done by the CRRP for free.

For-profit organizations not covered by the CRRA that require criminal record checks for employees or volunteers are encouraged to contact their local police.

To help police provide a common approach to record checks, the Police Information Check Guidelines were developed. The guidelines detail the type of information police should or should not release about the findings of a police information check. The BC Association of Chiefs of Police has endorsed the guidelines.

What does non-conviction information include?

Checks By Interstate Police/acic Accredited Bodies

If you submitted an application via an interstate police jurisdiction you need to lodge your dispute with them according to their dispute process. Please make direct contact with the specific police jurisdiction.

If your check was conducted by an Australian Criminal Intelligence Commission Accredited body you must raise your dispute with them. The accredited body will arrange for you to complete an NPCS Dispute form which they will lodge on your behalf.

National Police Certificate Security Features

Victoria Police issues two types of national police check certificates – digital and paper.

  • Digital certificates are issued by Service Victoria on behalf of Victoria Police. The certificate features:

  • secure locking of the PDF to prevent changes to the document
  • password protection
  • the Victoria Police and Victoria State Government logo in the top right corner of the page in a blue banner
  • a watermark on the left side of the page extending to the centre of the document

How To Request Records Contained In A Major Collision File

Major Collision Bureau investigates all Motor Vehicle Collisions resulting in a fatality or serious personal injury that occur in the Region of Peel.

  • Company letter or personal/company email requesting the records, including date, time, location, occurrence number, officer in charge of the collision. How you are involved or your relationship to the involved party.
  • Clients signed consent or two copies of your government issued identification and your contact information.
  • Our office will advise you in writing regarding the status of the case or any known court dates.

    Can I Lodge My Completed Application Form At A Police Station

    This will need to be forwarded by mail to the Public Enquiry Service to the address specified on the application form. Victoria Police will not accept faxed applications and we do not fax or email certificates to the applicant.

    Can My Employer Make Me Provide A Copy Of My Summary Criminal History Record

    Do You Have a Criminal Record and Want to Join the Military?

    Normally, no. With very few exceptions, your employer may NOT ask you to provide a copy of your summary criminal history. California Penal Code § 11126 and § 13326 make it a misdemeanor to request someone elses summary criminal history records without authorization. If your employer is entitled to the information, it must request it directly from the appropriate agency, NOT from you.

    What’s In A Criminal Record

    Let’s break it down, an individual’s criminal record can consist of the following things:

    • Arrest records
    • Conviction Records
    • Warrants

    Keep in mind that some of these reports can be considered null and void if the criminal charges were dropped or if a person was found innocent of the crime. This will likely depend upon the jurisdiction. A criminal record will also have a list of crimes that a person was convicted of and the sentence. These include jail or prison terms served, time of probation served, parole grants, and even violation of probation or parole. A criminal record will also show any warrants for a person.

    Disclosure Of Youth Records

    This is one of the most significant changes to record checks in Ontario. Youth records are only permitted to be disclosed in two circumstances:

  • To the youth themselves, who is not permitted to further disclose Findings of Guilt and must remove any results from the record check before sharing with agencies or
  • To the Government of Canada or the government of a province or a municipality for purposes of employment or the performances of services, with or without remuneration
  • Only federal, provincial and municipal government agencies will receive youth records.

    The PRCRA regulates how police services release Police Record Checks containing youth records to applicants. Up until now, police services have released a PRC containing youth records directly to the applicant who then provide the PRC to the organization or volunteer agency. The federal and provincial government has found this approach to be contrary to the Federal Youth Criminal Justice Act .

    The only authorized release of a PRC containing youth records will be to a federal, provincial or municipal government. Applicants can gain access to their own record through the Federal Access to Information process but this record is not a PRC and is not allowed to be shared with any other agency.

    Police services are unable to disclose whether or not there is a youth record.

    Whats The Difference Between A Misdemeanor Vs Felony

    The definition varies with jurisdiction, but in most states, a felony is a crime that carries a sentence of more than one year in jail. Colloquially known as true crimes, most jurisdictions consider felony offenses as the most serious of offenses. Thus, persons convicted of felony charges typically serve a sentence in a correctional facility under the supervision of the state department of corrections or the Federal Bureau of Prisons if the felony is a federal crime. The security level at these facilities is high, given the nature of the crime and the offender. Besides jail time, non-sentencing alternatives for felonies are typically punitive, and the conditions for parole upon release are strict. Common felonies include:

    • Murder in the first degree
    • Burglary
    • Human trafficking
    • Multiple DUI or aggravated DWI, or drunk driving

    Compared to felonies, misdemeanors are less serious crimes. In most states, misdemeanors are offenses punishable with less than one year in a county or municipal jail. If the offense is not serious enough for imprisonment, the court will impose sentencing alternatives like fines and probation.

    The Waterloo Regional Police Service does not provide police record checks to people living outside of Canada. If you live out of the country, and need confirmation that you have no criminal record in Canada, you may obtain a copy of your Canadian Criminal Record through the Royal Canadian Mounted Police .

    Spent Convictions In Victoria

    On 1 December 2021, a spent convictions scheme began in Victoria. Once a conviction becomes spent, it no longer forms part of your criminal record and, in most cases, you do not have to tell anyone about it.

    There are three different types of spent convictions:

    • convictions that are immediately spent, for example infringement convictions
    • convictions spent automatically, provided that you do not reoffend for a particular period
    • convictions spent following a court order.

    Informed Warning And A Caution

    Irene is 22. She received an informed warning for theft in 2015 and a caution for burglary in 2016.

    She has two offences but none of this information will be on her check. Unlike convictions, more than one caution or informed warning can be filtered. The offences aren’t on the specified list. More than two years have passed since the caution and one year since the informed warning.

    Information That Cant Be Included

    When the rules apply, there’s some information about contact you had with the police that can’t be included in any record check.

    For example, a record check can’t include information about you:

    • being stopped and questioned by police
    • being arrested but not charged with a crime
    • having contact with the police because of a mental health crisis
    • contacting the police to report a crime

    Will My Interstate Convictions Appear On My Certificate

    Victoria Police conducts national police record checks. If information is obtained from other police jurisdictions, the relevant legislation is applied by that jurisdiction before it is disclosed. In relation to legislation applied by states or territories other than Victoria, please refer to the relevant police jurisdictionâs website for more information.

    How Long Are Non

    There are no set guidelines for how long the police services will keep non-conviction records. Different records may be kept on file for different periods of time and some may be kept indefinitely unless a request is made to have the records destroyed. Non-conviction records related to major offences which have an aspect of violence or predatory behavior may be kept indefinitely. One police service will keep non-conviction records for a more definite period of 25 years.

    What Can I Do If There Is Inaccurate Information On My Dbs Certificate

    Your right to access does not cover criminal records checks for employment purposes, known as a DBS check . If a criminal records check is required for your work then your employer should explain how to apply for this appropriately.

    If you have any complaints about the accuracy of personal data on your DBS certificate, you can raise this with the DBS. This could include incorrect personal details, incorrect conviction information or other discrepancies.

    If the inaccuracy relates to an offence you did not commit, this would have to be raised with the local police force. If you are concerned about an entry in the Police National Computer record, you will have to raise this with ACRO.

    Get The Police Certificates You Need

    Do Your Neighbors Have Criminal Records?

    You must include police certificates when you apply for permanent residence.

    Our online system will ask for a police certificate for:

    • you and your family members who are 18 years or older
    • and
    • every country you stayed in during the last 10 years for 6 months or more in a row

    You dont need to give us police certificates for any period of time before you were 18 years old or for time spent in Canada.

    After you apply, an officer may ask for additional police certificates from any time in your life since you were 18 years old.

    If You Cant Get A Police Certificate From Your Country Or Territory

    If youre unable to get a police certificate from a country, youre responsible to show why you cant get one.

    To prove that you cant get a police certificate, you must:

    Can My Employer Ask Me About Past Convictions

    Generally, yes. It is legal for your employer to ask about all convictions, including misdemeanors as well as felonies. However, when your employer can ask you about your past convictions may be restricted by law.

    Effective January 1, 2018, most public and private employers are not be permitted to inquire into an applicants criminal conviction history until after giving the applicant a conditional offer of employment.
