    In order to release or confirm confidential information regarding your criminal record, or lack thereof, we require sufficient proper identification to verify your identity. The applicant must produce two pieces of appropriate identification that confirms their name, date of birth and address. One piece of identification presented must include a photo.

    The following is a list of items that are considered acceptable forms of identification.

    Government agencies, such as law enforcement agencies, can access your criminal record without your consent. If you are charged with a crime, your defense attorney will get a copy of your criminal record and examine it carefully for any errors.     The Ontario Provincial Police is moving record checks online as of June 13, 2022.

    The new process will allow those living in OPP-policed communities to submit requests for police record checks at opp.ca/recordchecks.

    You may use your Personal Record Review response for any personal reason.

    An employer or licensing entity cannot ask you to provide this information as a condition of obtaining or continuing a job or holding a license: this is prohibited by New York State Labor Law. This law does not apply to: employees of state or municipal departments employees of legally incorporated hospitals, and employees of medical colleges associated with such hospitals and employees of private proprietary hospitals.

    Access to criminal history records for employment or licensing is only permitted if there is a state law, federal law, or local law of a New York State village, town, city or county that specifically authorizes a fingerprint-based criminal history record check for employment or licensure.

    State Labor Law also requires every employer to post a copy of New York State Correction Law Article 23-A, which deals with the licensing and employment of individuals convicted of crimes. The information must be posted in a place accessible to employees.

    Noncriminal Justice Volunteer Background Checks / Volunteer Care Provider Program :

    N.J.A.C. 13:59-1 et seq. provides background checks for non-criminal justice volunteers to the following:

    • Any person who volunteers with a qualified entity, as that term is defined by the National Child Protection Act of 1993, 42 U.S.C. §§ 5119, 5119c

    If you believe that the criminal history requested for you is actually about a different person, you can submit a criminal history challenge for review by CIB. To do so, you will have to submit a completed applicant fingerprint card . The minimum data required for this submission includes: full name, sex, race, date of birth, reason fingerprinted , and information regarding the official capturing the fingerprints. This fingerprint card will be submitted along with a completed Wisconsin Criminal History Challenge Form to the address listed on the challenge form. Fingerprint cards should not be folded for mailing. There is no fee to request a challenge.

    CIB will compare your fingerprints with the fingerprints of the person who gave a name similar to your name in connection with an arrest reported to the criminal history database. If the fingerprints are not the same you will get a WiUPIN letter. You can use this letter to prove to prospective employers or others that the criminal history that shows up in response to a criminal history search request for a name similar to your name does not belong to you.

    As part of the identity confirmation process, your fingerprints will be compared with other fingerprints on file at CIB.
