How To Obtain A Police Report

The Police Records Division handles public requests for reports. Crash Reports are free of charge if you visit the Records counter or you can access it through the online system.

The majority of requests are traffic accident reports, or incident reports. Crime Reports include all reports taken by the police department, in person or by telephone, other than a traffic accident.

Police Report Vs Police Record

First, lets clarify something that is bound to cause some confusion: the difference between a police report and a police record. While these two items have similar names, they are in fact very different. A police report is a document filed by a police officer that essentially offers a summary of an arrest, incident, or accident. A police record, on the other hand, is usually the same as a criminal record and it includes a list and summary of an individuals history of interactions with law enforcement, including arrests and convictions.

Another point that deserves clarification is the difference between a police report and an accident report. In fact, theres not really a difference between these two items. An accident report is simply a type of police report that details the circumstances of a traffic accident. A police report, meanwhile, can include accident reports, but they cover a much broader range of incidents that may involve the police, including crimes. Note that some police departments call police reports incident reports. Remember that some accident reports may also be criminal reports, such as if the accident may have been caused by drunk driving.

How Long Will It Take To Get A Copy Of A Report Once It Is Requested

  • In most cases, if you attend in person to obtain a report, it will be prepared while you wait. If the report is incomplete , it will be released to you when it is completed. There may be an additional wait time for archived reports.
  • Requests by mail will be responded to by mail as promptly as possible.

Third Parties Obtaining Reports

Sometimes third parties who were not involved in the actions mentioned in police reports might want copies of them. In these instances, most states will only allow third parties to obtain copies of police reports if the matters enclosed within the reports have already been closed. However, some states may allow third parties to obtain copies of police reports even when the cases are pending. Generally, third parties must know the case number of the reports that they want and must go to the county clerks office where the police report was filed to obtain a copy of the reports. There is usually a fee for the reports to be printed as well.

The process of obtaining copies of police reports is slightly different for different groups of people. However, they typically are not difficult to obtain, no matter who wants them.

The most common reason why people cannot get a copy of a police report is because of an ongoing investigation. Once the case is closed, you should be able to obtain a copy.

If you reported online via 105.police.govt.nz you should receive your PAF within 24 hours of making the online report.

What’s In A Police Report

At the scene of the car accident, if you pay close attention you may notice the investigating officer inspecting vehicles, talking to people, measuring distances, writing notes, and taking photographs. The officer is taking some or all of these steps in preparation for drafting the police report. In short, the police report is a summary of the police officer’s investigation of the accident. The report will often contain some or all of the following information:

  • approximate date, time, and location of the collision

When To Call 311

Other reports can be made online using the 311 Customer Service Centers self-service options, which then get routed to the appropriate servicing agency . Staff can assist you in over 175+ languages:

  • Graffiti : Report buildings, public property, and other objects that have been vandalized with graffiti.
  • Abandoned Vehicle: Report a vehicle that is suspected to be abandoned, or has been parked in the same space for more than 72 hours.

Police Department Request Form

If you cannot submit a police report request online or through the mail, then you will have to visit the police department in person and file a request there. Call beforehand since some departments only allow in-person requests on certain days. You can find your local police department here. Then you can find out about filling out a Police Department Request Form in person and how to get the information you need. Typically these police department request forms can be fulfilled that day.

A request will typically require you to provide your personal and contact information as well as details about the incident, including the type of incident, date, and who else was involved. Be aware that if the report pertains to an ongoing investigation then your request could be denied. If you are unclear about why your request was denied you should talk to an attorney.

Redacted Copy Of Police Report

A redacted copy of a police report may have personal and numerical identifiers including, but not limited to, name, home and email address, phone numbers, date of birth, social security numbers, and medical, financial, and juvenile information blacked out. Are Police Reports Admissible In Court

While police reports are commonly used in car insurance settlement negotiations, admitting a police report as evidence when you file a car accident lawsuit is not quite as clear cut.

In small claims courts, litigants are usually permitted to use police reports as evidence in their car accident case. You will not be expected to know all the rules of evidence, so judges typically will allow plaintiffs and defendants to use the police report in explaining what happened.

If your car accident case goes to trial in your state’s court of general jurisdiction , you should know that parties in these cases are held to the rules of evidence and must contend with whether the police report falls within the rule against “hearsay” evidence, which keeps out many out-of-court statementsby definition, any assertion made in a police report is a statement that was made out of court.

In some jurisdictions, the police report may fall within the “public records” or “business records” exception for admissibility. In other jurisdictions, different exceptions to the hearsay rule may apply and allow you to admit some or all of the police report as evidence.

When To Request A Police Report Or Case Number

Instead the case number or the CAD information will meet the requirement for documentation. For Family Court domestic-related issues when the judge is requesting proof of a police call for service, most often, the CAD information will suffice. CAD information can be available in less time than the release of the police report.

How Are Police Reports Obtained And How Much Do They Cost

Accident Reports, Incidents, and Crime Reports: can be obtained from the Records Bureau as soon as they become available. You may request the report in person, but reports take time to prepare and we strongly recommend that you call ahead for a copy of a report so that we can have it available to you when you come in. If the report you are interested in obtaining is for insurance purposes or for a lawyer, you may prefer to have them request the report for you.

Accident Reports:

You may obtain a copy of an official Accident Report that the officer completed if you were an operator of one of the vehicles in the accident, or the owner of a vehicle involved in the accident, or an injured party, or an insurance company requesting on behalf of their clients, or attorneys representing clients in a civil action.
